Reportg of 4 ta 5 inches of rain within a period of 1 to 1-1/2 houra vrere received. Residents in the vicinity of Newtowr? Court and Kattle Creek Road expressed coacern over the large valumes of surface runoff that were experieaced. No home fiooding was know to be reported. Storm t,nte si v: The rainfall amount.and intensity is based uppn observations by resfdents in Lexington 5quare and the nearby vi.cinity. This storm exceeded the magnitude of the storm used to desSgn the storm water drainage system. Statistioally the probability of this storm was greater than a 500-yesr event (aee attached precipitation frequency curve)b Perfprmance 21 tbQ drainaae svs___tems The system perfnrmed adequately considering the severity of the storm and the fact that homes were not floadad or permanently damaged. The runoff exceeded the capacity of the leteral etorm sewer system as would be expected in a storm of this magnitude. AS a reeuLt, the overfiow routes were impacted by high volumes of runoff. Although thi.s was a signi#icant coacern, the apparent lack of permanent damage indicates the system performed adequately. On past occasions, residents have expressed concexns that the performanae of the lateral system in thie area is not adequate. Frequent Ploodiaq of the low paint at Newtowa Court was aited as the primary example of performance inadequacy. After the floads of July 270 19$7, an evaluation ot the eystem was conducted and a stafE report was 3.ssued which recommendsd minor improvements ta the lateral pipe system and overflow routea. These imprcvements have not baen fully implemented due to the pending litigatio;n betvreen the city and the developer. However the improvements, 3t in place at the tf.me of the Juiy 26 storm, aould not have materially changed the performance of the system because of this storm's magr?itude. , The hiqh water elevation of Pond JP-30 resulting from the A U G- 1 3- 9 0 M O N 9 : 4 S H O N E S T R o u kr. ?_^•-- storm was also e concern. Elevatioas tskea of the assumed high water level indicate the pand may have finoded to 881.4. Although this is 2,feet higher than the predicted level of the 100 year sto?rn event, the lack of home flooding, relatively quick ralease of the pond water aad the magaituda of tha storm indicate that the syetein performed adequatelp. Reports of 411-5" of rain within a period of 1-1h hours were received based on observations by residents in Lexington Square and the nearby developments. A rainfall event of this intensity exceeded the magnitude of the storm used to design the storm water drainage system. The design storm used to design the storm sewer system is based on a 6" rainfall over a 24-hour period. A maximum peak intensity of rainfall within that 24-hour period is 3" of rainfall in approximately 1 hour. Statistically, the storm intensity experienced during the July 28, 1990, thunderstorm exceeded the magnitude of the storm used to design the storm water system. The City's storm water drainage system performed adequately considering the severity of the rainfall event and the fact that no permanent structural damage has been reported to date. Attached for your information is a copy of the report on the storm water system analysis prepared by the City's consulting engineering firm of Bonestroo, Rosene, Anderlik & Associates, Inc. After the floods of July 27, 1997, an evaluatinn of the system rvas conducted and a staff report was iasued which recommended minor improvemente to the lateral pipe eyBtem and averflok routes. These improvemente have not been fully implemented due to the pendinq litigation between the city and the developer. THE CORRECT LIGHTS IN LATE AUGUSTi MODEL HOME FOR SIX WEEKS, BUT THE 1) HOT/I WIRES HAD NOT BEEN RUN VERAL LIGHT SWITCHES AND WALL THE FOLLOW-UP WORK DQNE BY THE ELECTRICIAN WAS PROMPTED BY MY TELEPHONE CALL TO THE EAGAN SUILDING INSPECTOR CONCERNING THE mmomn-- POTENTIAL ELECTRICAL/WIRING HAZARD TO THE HOMEOWNER. IT WAS ALSO LEARNED THAT THE KITCHEN CEILING FAN, INSTALLED BY THE ELECTRICIAN, WAS BARELY SECURED OVERHEAD AND COULD HAVE FALLEN AT ANYTIME. THIS WAS DISCOVERED AND CORRECTED BY THE ESTABLISHMENT WHO SOLD THE FAN TO THE HOMEOWNER AND PERFORMED A SERVICE CALL BECAUSE THE FAN DID NOT OPERATE PROPERLY DUE TO IMPROPER INSTALLATION. --t HAVE ALSO HAD MAJOR PROBLEMS WITH THE PLUMBING. WHEN THE WASHING MACHINE DISCHARGES WATER, THE WATER COMES UP THE BASEMENT FLOOR DRAIN. THE PLUMBERS HAVE BEEN OUT ON TWO SEPARATE OCASSIONS. APPARENTLY THERE IS NO BLOCKAGE PROBLEM BUT RATHER THE PLACEMENT/POSITIONING OF THE PIPES ' UNDER THE BASEMENT FLOOR ARE INCORRECT, AS EXPLAINED TO ME BY ONE OF THE 1 PLUMBERS. CORRECTION OF THE PROBLEM WOULD ENTAIL BREAKING UP THE CONCRETE FLOOR SEVERAL FEET AND RELAYING THE PIPES AT THE PROPER ANGLE. -7 I HAVE ALSO EXPERIENCED DRAMATIC SETTLING AROUND THE ENTIRE FOUNDATION OF HOUSE AND WHERE THE MAIN UTILITIES (WATER AND SEWER) WERE INSTALLED (PHOTOS ARE AVAILABLE). AS A RESULT) THE FRONT CONCRETE SIDEWALK HAS DROPPED CONSIDERABLY AND THERE IS A LARGE HOLE UNDER THE GARAGE SERVICE DOOR SLABP AS WITNESSED BY YOU IN MID-AUGUST. YOUR SOLUTION TO "JACK-UP" THESE CONCRETE PIECES IS NOT ACCEPTABLE AND WOULD SERVE ONLY AS A TEMPORARY SOLUTION AT WHICH POINT IT WOULD BECOME THE HOMEOWNER'S PROBLEM AND EXPENSE. I AM DEMANDING THAT NEW SLABS BE PUT IN. ADDITIONAL DIRT SHOULD HAVE BEEN BROUGHT ItJ, WHICH YOU SAID WOULD BE DONE, BUT LATEft YOU SAID IT WAS NOT NECESSARY. AS A RESULT, THE SOD COMPANY LAID THE 500 YARDS OF 50D INCLUDED IN THE PURCHASE PRICE OF THE HOUSE WHEN THE YARD WAS NOT BACKFILLED PRQPERLY AROUND THE ENTIRE FOUNDATIONP UNDER THE DECK AND WHERE THE MAIN UTILITIES WERE INSTALLED. I HAVE HAD TO ROLL UP OVER ONE-THIRD OF THE FRONT YARD AND HAUL IN 30 WHEEL BARROWS OF DIRT JUST TO EVEN OUT THE FRONT LAWtJ WHERE THE WATER AND SEWER LINES WERE PUT IN, SOMETHING THAT WAS YOUR RESPONSIBILITY. THERE HAS BEEN WATER IN THE CRAWL SPACE, GARAGE FLOOR, AND DAMPENED BLOCKS AROUND THE ENTIRE FOUNDATION.I' HAD TO BRING IN ANOTHER IH WHEEL BARROW LOADS OF DIRT TO PUT ON THE SOUTH SIDE OF THE HOUSE IN ORDER TO OBTAIN PROPER DRAINAGE. THERE IS NO DRAINAGE GOING AWAY FROM THE NORTH SIDE OF THE HOUSE AND I HAVE NO IyTENTION IN FIXING THIS FOR YOU. I HAVE SPENT OVER 15 HOURS AND BROUGHT IN 48 LOADS OF DIRT WHICH 1 FEEL I SHOULD BE REIMBURSED FOR MY TIME AND LABOR. I WILL NOT HESITATE TO CONTACT THE EAGAN SUILDING INSPECTOR CONCERNING THE PLUMBING AND SETTLING/DRAINING PROBLEMS AS I FEEL YOU ARE IN VIOLATION OF ESTABLISHED BUILDING STANDARDS# AS YOU WERE WITH THE ELECTRICAL.
