General Costs a. Includes $250 City Building Permit, of which $200 is an allowance for actual Permit costs. b. Provide and follow detailed project schedule and timeline, c. Provide dumpsters needed for demo and repair work to collect and remove debris. d. Provide scaffolding necessary to complete work. e. Remove and reinstall all electrical fixtures and vent covers after work is done. f. Provide a clean, neat, and safe job site while we are doing our work and before we leave. g. Provide complete professional house clean in the areas affected by work after repair work is completed. 2. Demo and Prep Work a. Interior i. Poly and seal off repair areas from rest of existing house. 1. Add two zipper accesses to upstairs bedroom ii. Cover all wood floors in the construction zone with rosen paper covered by plywood throughout the construction process. iii. Cover railings, and other finished areas in work areas with protective coverings, iv. Remove base trim as on damaged wall. v. Remove any remaining wet drywall and wet insulation on the Living room north wall as necessary, saving drywall around fireplace. vi. It is our understanding you have been aware of their concerns for some time and have attempted to correct them. It is also our understanding that the main coacerns now are some defective windows, rrhieh you have indicated to the City vill be replaced, and moisture along the horizontal laminated beam that spans over the dining and living room areas. In an effort to assist in eliminating the moisture problem, several inspections of the home hane been made by the Building Inspeetions Department. It is this department's opinion that the moiature causing the staining on the ceiling at the beam may be a result of inadequate ventilation in that roof area. We feel it may improve conditions in that roof area by increasing air movement in an effort to prevent frost build-up on the beam (above the ceiling line) and on the styrofoam insulation. This may be aecomplished by bloQking off some of the soffit ventilation on the east side of the home, thereby Poreing the roof turbines to draw air up over the diaing/liviqg room area from the soffit vents on the yteat aide of the hame. I contaeted Mr. Fred Sobottka and arranged an inspection appointment on Monday, August 15, to walk through his home and discuss some of the complaints he has. Mr. Bill Bruestle accompanied me on this inspection. Mr. Sobottka stated that since he moved into the home in 1986, he has been experieneing excessive moisture buildup in the ceiling, 6eams, and windows to a degree that some of the window trim and moulding had to be replaced. There are still water stains on the horizontal beam through the living room/dining room area which have not been removed. Mr. Sobottka states that all the windows in the home, with the exception of the laundry room and kitchen, have some moisture damage. A humidity gauge in the home revealed a 20% humidity level whieh is normal, however there is still excessive moisture buildup on the windows and leaking onto the beam. It is the owner's feeling that the condition of his home makes it unsalable and would like to have these problems taken care of so he can sell the home. It is his feeling that Tollefson Builders has never completed the home; they keep trying to repair it, but never complete the work. Tollefson Builders remcved ceiling sheetroek and insulation to the roof boards to make any correetions/changes that were necessary for ventilation of the vaulted area. In the spring of 1988, Tollefson Builders finished everything, adding soffit and roof turbine ventilation to assure more positive ventilation in the vaulted roof area. Some of the other problems the homeowner has are damp spots on the basement walls; as well as being unhappy with the quality of paint used after the ceiling was repaired. It is Ytis desire to inform the City he has some neighbors who are unhappy with Tollefson Builders. I informed Mr. Sobottka we would meet with Tollefson Builders to find out what they have done, plan to do, and how these problems can be corrected. On August 18, 19$$, Tollefson Builders Superintendent, John Wilhelm, met with us to review the complaints we received. John began work for Tollefson Huilders in December 1987 and has been working with the Sobottkas ever since, trying to satisfy some of the problems with their home. John W3lhelm stated he did notice moisture coming through the ceiling by the beam and the windows had moisture on them. An investigation of this problem showed frost in the attic area which is conclusive there is a ventilation problem. John showed us pictures taken during the removal of the vaulted area which showed they added an additional 1-112" member to the rafters depth to assure more positive ;. ventilation in the vaulted area. They have also added soffit ventilation and turbines as Mr. Sobottka has stated. Tollefson Huilders felt it was a ventilation problem as they have built this same model five or six times previously and have not experienced any problems. The builder also stated that they replaced some of the moulding and stops around the windows which showed moisture damage. Mr. Wilhelm stated they have met with different painting suppliers to find a product to remove the stain from the wood beam and as of this time, there does not seem to he a produet available for this. They have tried sanding it, with no success. With the request of Mr. Sobottka and an agreement of Tollefson Builders, an energy consulting firm was hired to take infrared pictures of the home to see if there is any leakage through ventilation or heat loss. Mr. Wilhelm shared those pictures with us and showed a couple of areas where there was some wet insulation prior to removal of the ceiling. He stated Tollefson Builders came back this spring and sealed any eracks on either side of the beam to make sure moisture could not go into the attic airspace of the vaulted area. He feels that by adding insulation and making sure there is positive cross ventilation in the vaulted roof area, they have the problem corrected. Agreement as to removal of the stains from the horizontal beam has not been reached, and Mr. Sobottka is also complaining about the paint matching in the living room/dining room area. Tollefson Builders has offered to wrap the horizontal beam with a plywood oak veneer, however there would be joints every 8' and this is not aeceptable to the owner. This department feels the Sobottka home is an airtight, energy efficient home, equipped with a pulse energy high efficiency furnace which uses outside air for combustion and discharges the produets of combustion (a closed loop system). The Sobottkas both work outside the home, have no children, and there is not a lot of air change in the home during the day. There are a number of plants in the home whieh create moisture. It is my opinion the above help aggravate some of the moisture problem they have experienced in the past. In reviewing the pietures and information Tollefson Builders has furnished, we feel the new ventilation system should help to correct the moisture problem. The upcoming heating season should help to determine if the added ventilation has solved the problem. As for the painting and patehing of the walls and ceilings, it is this department's feeling that this should be resolved between the builder and owner. If the moisture problem is not solved, I would suggest the representative from the energy agency review the problems for correetion. Since then two representatives from the City have looked at the house and agreed Tollefson's did a less than satisfactory job. I have written Mr. Tollefson requesting he take care of the existing problems, but he continues to ignore us. I told him I would quit writing letters to consumer agencies if he would finish the house, but he still remains idle and doesn't answer any letters. Since no one else can do anything, I feel the City has a certair, responsible to protect it's citizens from disreputable builders, such as Mr. Tollefson. I can provide you with the names of many others who have been treated unfairly by Tollefsons, which appears to be the rule rather than the exception. I understand Mr. Tollefson is suing the City for some surveying problems which occurred in 1985. I would be happy to testify on how incompetent Mr. Tollefson is and I am sure several others would be willing as well. I think the only way to force Mr. Toliefson to clean up his act is by suspending his building license, un:il he can demonstrate better building practices. Since the last time I wrote, I was contacted by Mr. Tollefson's Brother in Law, Gary Wollschlager. Mr. Wollschlager came to the house, looked over all the outstanding problems and said he wanted to finish them in the next couple of weeks. I attribute their sudden interest to an investigation by WCCO's I Team. That was over two months ago and most of the problems still exist. In addition to the existing problems, three thermopane trapezoid windows are leaking and have condensation between the panes. They have not done any further checking into the ceiling moisture problem, which appears not to be corrected. During the week of December 5, when the temperature was oscillating between freezing and the 40's, several wet stains appeared on the ceiling in the living room. Since very little frost could have been built up in the vaulted ceiling, this indicates the moisture problem will be back when the temperature remains below freezing for several days, followed by a thaw. I have monitored the humidity level very closely, which has been between 30% to 40%. When it gets to the upper end of the band I open the deck door and windows. We also have a dehumidifier running constantly in the basement. After all steps I have taken, it appears the only waq to solve the moisture problem is to reduce the humidity level in the house to zero. I have been talking to the I Team and I am amazed at the number of people sueing Tollefson's or in the situation I am. When the city building inspectors were in the house earlier, they indicated someone may be interested in examining the house if the moisture problem continues. I would be happy to get some outside opinions, because I don't think Mr. Tollefson is taking a very serious interest in this matter. Please do what you and the City council can do to protect the citizens from this disreputable person. As an elected official, I believe you should take away Mr. Tollefson's building license until he can demonstrate he csn be more responsible. Since Mr. Tollefson has been in trouble before in Eagan, 1 had hoped something could be done to force Mr. Tollefson to change his business practices or face losing his building permit. It appears you are unable to do anything considering this situation, so I would appreciate any help you can provide as to who I should contact in the City of Eagan to bring action against Mr. Tollefson. I have spoken to several people who are experiencing similar problems with Mr. Tollefson and have found suing provides more pain than gain. The only way to get Mr. Tollefson's attention is through his wallet. Apple Valley, MN 55124 Dear Sir or Madam, Another month has past and the house is far from completed. As other people have told me, Tollefson Builders builds a lot of houses but hasn't completed one yet. I recently heard from John that the water stains cannot be removed from the beam. If they can't be removed, I can't sell the house, so they wi11 be removed. In addition to the major stains they have been working on, there are several smaller stains running the width of the beam, which also need to be removed. When the water stains on the ceiling and walls were finally started in July, the job which was done was not acceptable. The paint on the ceiling and walls does not match the current paint, so it's obvious it was repainted and looks like hell. The stains on the ceiling over the beam were also not done and are still visible. I want someone to come back and repaint the entire ceiling and wall. The water stains on the ceiling over the beam in the loft were not completed, so the entire ceiling will have to be repainted in the loft area also. There are also several places that needed to be painted and patched which were not' done. I am enclosing a list of the outstanding problems and the current status of the problems. There are only a few months left for any repairs to the moisture problem and it doesn't appear you are going to do anything. The basement walls are wet and there are areas on the floor where the floor is wet. I recently installed a dehumidifier and that does not seem to reduce the humidity in the basement. I suggest you investigate the source of the moisture and consider the consequences on the rest of the house. This has been going on for two snd a half years and I still expect the moisture probiem to return this winter. Why don't you take some time now to alleviate the problem for good, so I don't have to continually try to get you to fix the problems caused by the excessive moisture. I will continue to be vocal regarding our situation until I feel the problem is finally resolved. If you cannot fix the outstanding problems, please let me know and I will find someone who can, but I expect you to pay for any repairs. Since you continue to drag your feet on these problems, I intend to assist other people who are also experiencing problems with you. I will gladly testify for anyone who asks and will continue to try to find someone who will do a piece on your bad business practices. I will also continue to contact consumer agencies and people associated with home builders until I am satisfied with the outcome of my house. Water sta?ns 1) Wood on bottom and lower sides of window sills for most windows and the deck sliding door and the side lights off the deck door are black and rotting from excessive moisture. Since the humidity level was in the normal range last winter(less than 30%) it appears there is a problem with the varnish, windows or insulation. 2) Various places running the length of the beam from the dripping. 3) On the ceiling over the beam and above the fireplace wall. If covering the stains results in spots, the entire ceiling will have to be repainted. 4) On the wall where the fireplace is, between the wall and ceiling. STATUS: Item 1- Most of the work is done,but the wood was black and varnished over without removing the black stains. The exact cause has still not been found, so it will probably turn black again next year. Item 2- not done yet. Items 3&4- As expected, the new painting is spotty so the entire wall and ceiling need to be repainted. The ceiling over the beam has not been started. Walls/Ceilin¢ 1) Cracks and seams around basement doors. These have been done twice already and reappear, so something better needs to be done. 2) Corner in loft is rippled. 3) There is a white spot on the ceiling between the ceiling fan and the window in the Master Bedroom. STATUS: Item 1 was redone the same as before, in other words it will probably reoccur. Items 2& 3- nothing has been done. Exterior 1) Need to apply CWF to deck steps and railing. 2) Dining room window is scraped and dented on the outside. This happened when sheet rock was brought in last summer. 3) Locaer c,alkout faucet leaks and needs to be replaced. STATUS: Item 1 is complete. Item 2 was started, but not finished. Nothing has been done for item 3. Paint/Patch 1) Scratches around dining window. Happened when sheetrock was - brought in last summer. 2) Several areas were previously patched or scratched and not painted. Major areas include: over the dining windows, tha corner of the laundrv room, over the entry from the hallway to the living room. over the basement doors and any new patching that is done. 3) Vents under soffet which were replaced need to be painted. People I have talked to think raising the roof to add additional ventilation in the vaulted area and adding a hot/cold air exchange should provide a permanent fix. I eontaeted Mr. Fred Sobottka and arranged an inspection appointment on Monday, August 15, to walk through his home and discuss some of the complaints he has. Mr. Bill Bruestle accompanied me on this inspection. Mr. Sobottka stated that since he moved into the home in 1986, he has been experieneing excessive moisture buildup in the ceiling, beams, and windows to a degree that some of the window trim and moulding had to be replaced. There are still water stains on the horizontal 6eam through the living room/dining room area whieh have not been removed. Mr. Sobottka states that all the windows in the home, with the exception of the laundry room and kitchen, have some moisture damage. A humidity gauge in the home revealed a 20% humidity level which is normal, however there is still excessive moisture buildup on the windows and leaking onto the beam. It is the owner's feeling that the condition of his home makes it unsalable and would like to have these problems taken care of so he can sell the home. It is his feeling that Tollefson Builders has never completed the home; they keep trying to repair it, but never complete the work. Tollefson Builders removed ceiling sheetrock and insulation to the roof boards to make any correetions/ehanges that were necessary for ventilation of the vaulted area. In the spring of 1988, Tollefson Builders finished everything, adding soffit and roof turbine ventilation to assure more positive ventilation in the vaulted roof area. Some of the other problems the homeowner has are damp spots on the basement walls; as well as being unhappy with the quality of paint used after the ceiling was repaired. It is his desire to inform the City he has some neighbors who are unhappy with Tollefson Builders. I informed Mr. Sobottka we would meet with Tollefson Builders to find out what they have done, plan to do, and how these problems can be corrected. On August 18, 1988, Tollefson Builders Superintendent, John Wilhelm, met with us to review the complaints we received. John began work for Tollefson Builders in December 1987 and has been working with the Sobottkas ever since, trying to satisfy some of the problems with their home. John Wilhelm stated he did notice moisture coming through the ceiling by the beam and the windows had moisture on them. An invesEigation of this problem showed frost in the attic area _wkiieh is conclusive there is a ventilation problem. John showed us pictures taken during the removal of the vaulted area which showed they added an additional 1-112" member to the rafters depth to assure more positive ventilation in the vaulted area. They have also added soffit ventilation and turbines as Mr. Sobottka has stated. Tollefson Huilders felt it was a ventilation problem as they have built this same model five or six times previously and have not experieneed any pro6lems. The builder also stated that they replaced some of the moulding and stops around the windows which showed moisture damage. Mr. Wilhelm stated they have met with different painting suppliers to find a product to remove the stain from the wood beam and as of this time, there does not seem to be a produet available for this. They have tried sanding it, with no suecess. With the request of Mr. Sobottka and an agreement of Tollefson Builders, an energy consulting firm was hired to take infrared pictures of the home to see if there is any leakage through ventilation or heat loss. Mr. Wilhelm shared those pictures with us and showed a couple Of areas where there was some wet insulation prior to removal of the ceiling. He stated Tollefson Builders came back this spring and sealed any cracks on either side of the beam to make sure moisture could not go into the attie airspace of the vaulted area. He feels that by adding insulation and making sure there is positive cross ventilation in the vaulted roof area, they have the problem correeted. Agreement as to removal of the stains from the horizontal beam has not been reached, and Mr. Sobottka is also complaining about the paint matehing in the living room/dining room area. Tollefson Builders has offered to wrap the horizontal beam with a plywood oak veneer, however there would be joints every 8' and this is not acceptable to the owner. This department feels the Sobottka home is an airtight, energy efficient home, equipped with a pulse energy high efficiency furnace which uses outside air for combustion and discharges the products of combustion (a elosed loop system). The Sobottkas both work outside the home, have no children, and there is not a lot of air change in the home during the day. There are a number of plants 3n the home which create moisture. It is my opinion the above help aggravate some of the moisture problem they have experienced in the past. In reviewing the pietures and information Tollefson Builders has furnished, we feel the new ventilation system should help to correct the moisture problem. The upcoming heating season should help to determine if the added ventilation has solved the problem. As for the painting and patching of the walls and ceilings, it is this department's feeling that this should be resolved between the builder and owner. If the moisture problem is not solved, I would suggest the representative from the energy agency review the problems for correetion.
