I have purchased a vacant residential lot in Eagan and am trying to get a building permit
to build my dream home. I am not a builder or developer and so I do not know a11 the ins
and outs of working with the city council to get a sma111ot coverage variance so I am
writing to you today to ask for your help.
I attended the Eagan City Council last February 5"' to appeal a lot coverage variance,
which was denied last November. As you are aware, you and three other council
members voted to not even hear my new information. With this letter I would like to
present to you just some of the more compelling facts that were unfortunately not heard.
I have been an Eagan resident and homeowner for 20 years. I have been an EAA
volunteer coach for my two daughters for 8 years, volunteered my time at Northview
Elementary School and at Blackhawk Middle School. I have contracted for $88,000 to
purchase a vacant lot so that I might build and enjoy a home style and design which best
fits my lifestyle. My house plan fits well and is consistent with the existing homes in the
Second Addition of Majestic Oaks, neighbors on each side have expressed no objection.
I have downsized my variance request to 2.86%. I have enclosed names, locations and
dates of 6 other variance requests, which were approved by the Eagan City Council. All
but one being approved witlvn the last 2 years. Of particular interest are that approvals
for families Burns and Hutter, there were no submitted hardstups, simply a request for
more living space. Therefore a precedent has already been established. I remain puzzled
as to why I am being treated so differently than other residents of Eagan whose requests
have been heard and approved.

My home plan makes no request for side lot or front set back requirements and as a result
offer no support to the objection of neighbor Mr. Robert Yancy, whose only objection is
that my variance might set a precedent for a side lot set back reduction variance on a
vacant lot to the south of his home. My variance makes no reference to side lot variance
and therefore offers no precedent or support for future side lot variance considerations.
Mr. Yancy's objection is therefore groundless.
In conclusion, my variance request breaks no new ground, lot coverage variance
approvals of up to 28% already exist.
I look to you for a little help, what is my next step in getting my appeal heard? My letter
today is only a portion of the complete information supporting my variance request that I
have gathered since submitting my request. Meg Tilly voiced her concern that Council
was not treating me the same as other residents which had been approved. I would
appreciate your comments and response.

response. As you stated, the City Council declined to hear your appeal subsequent to its
denial of your variance request last November. The appeal process is now exhausted;
however, you may wish to consider one of the following options:
1. The City Code ailows for pursuing the same variance request one year after the
date of original denial.
2. Significantly revise your variance request and submit a new application for
consideration.
3. Revise your building plans to eliminate the need for a variance.

I am writing this letter to inform you of the City's concem regarding the lack of turf
establishment on the above-mentioned property, as there is some evidence of sediment
depositing on the adjacent property to the north. The terms of the development
agreement requue you to restore any turf disturbed by grading, excavation, and
backfilling, etc., in accordance with the restoration portion of the grading plan.
It is my understanding that the property was sold to a third party; however, you, as the
developer, aze still ultimately responsible for the erosion control. Erosion control
includes, but is not limited to, seed/mulch, silt fence, sod, and erosion blanket.
The City is requiring that this issue be resolved and requirements met by May 23, 2002 or
the City will draw on your Letter of Credit #17711 to have the work completed.

During the first week of June 2003 1 dug 3 footing holes in the back yard of a home
located at
4557 Majestic Oaks Place
Eagan, MN 55123
These holes were dug with a 12" power driven auger mounted on a skid loader. T'he
holes were dug to full depth of the auger which has an operational depth of 48"
Following the power auger digging, the owner, Gerald R. Bull used a hand operated post
hole digger to enlarge the bottom of the holes by the width of the post hole digger which
was 4-5" which resulted in a footprint of at least 18-20". All excess soil was removed in
