Dear Mr. Egan:
I am writing to express my concem over the construction of the new road neact to
Oakridge Elementary School. I haue recently walked along this road and am questioning
why this road is being built so close to the school. It appeazs that this road is as close as
approximately 120 feet from the school and also runs right neart to the school's playground
azea..
I also question why the road is needed in the first place. I don't believe that this road is
even necessary since Diffiey Road is approxunately one eighth of a mile to the north.
Shouldn't vehicular traffic be encouraged to use one of the city's main thoroughfares
instead of a road that runs perilously close to a school and playground?

Please be advised that this Encroachment A¢reement is not effective until siened and
Our Transmission Engineers have reviewed the proposed plan for the Installation of an elevated
residential dick within the transmission line R/W at 4423 Mallard Ct., Ea¢an, MN as submitted May
23, 2007. The encroachment is acceptable to Xcel Energy by adhering to the following:
SCOPE OF PROJECT:
A deck is proposed wit}dn the easement for transmission lines 0976l0989 located approzimately at
mid-span between structures 146 and 147. The deck will be attached to the existing house at 4423
Mallard Court in Eagan, MN with an approrimate size of 12 feet X 22 feet and 9 feet in height The
deck will eatend 12 feet perpendicular to 1he house and then parallel the house for 22 feet This
proposed orienta6on and size will place a comer of the deck 12 feet within the easement. At this
proposed location the deck floor shall not eaceed an elevation of 949 feet or 9 feet above the eaisting
garage floor elevation of 940 feet. Construction of a roof, trellis, arbor, or other similaz enclosures on
top of the proposed deck is not permitted. A conventional railing not to eaceed 4 feet in height is
permitted along the perimeter of the deck.
(1) Grade change within easement
The ground elevation above which the deck will be placed shall mt-be increased above 940 feet
mean sea level. Stockpiling of soil and/or material witlvn the easement will not be permitted.

(2) Clearances to eqwpment and workers.
A working clearance of 25 feet between the electrical conductors and any cranes or digging
equipment used in or near the easement and a clearance of 25 feet to the physical proximiry of
workers must be maintained at all times. In addition, any construction near the transmission line(s)
shall comply with all OSHA Safety Clearances. If tlus clearznce camot be tna+ntained, the
contractor or developer must arrange for a line outage by calling Xcel Energy's System Control
departmem (Steve Rollin 612/330-2875). At least two weeks advanced notice must be providad in
order to schedule a line outage, if an outage is available. There is a fee of approximatcly $350.00
per day, per outage, for this service. This fee must be paid prior to outage.
The preceding twp paragraph(s) must be included in a prominent location on the plan sets and
specifications given to contractors.
(3) Landscaping within the easement.
Generally shorter varieties of trees and shrubs, 10 feet or less mature height, may be considered. If
planting is permitted, the line's voltagc and the tree's mature height will be allowed. For
maintenance purposes there sha11 be no planting within 15 feet of transmission line sVucture sites.
(4) Building on easements.
There shall be no permanent or temporary building or decks except as described in the scope of
project above.
(5) Fuel and refueling on easements.
There shall be no fuel tanks stored or refueling of vehicles and equipmenrt witliln the easement.
(6) Fences on easements.
[f the easement azea is fenced, gates must be installed to provide access to Xcel Energy for
maintenance purposes. Chain link or other types of fences using metal material and constructed on
or near an Xcel Energy easement should be properly grounded.
It is the express condition of this consent that all other terms and conditions of that certain easement granted
by Final Decree on September 20, 1972 and recorded as Documern No. 405155 shall remain in full force and
effect.
A copy of the signed Eocroachment Agreement shall be kept on site, available for review by Xcel
Energy representatives, until all construction and site restoration has been completed.
To aclmowledge receipt of and agreement with the terms of this conseM, prior to the commencement of
any activities, please sign this letter and return it to me by fax. Fax sipiatures aze accepted to expedite
this process. If this signed agreement is not received back within 30 days of the date of this agreement, it
will be presumed that you are not in agreemem with its content and this agreement will be considered null
and void, the file will be closed, your request will need to be resubmitted and the City or County Zoning
Office will be notified of our action. Anv changes to this ori?inal aereement shall make ttris agreement null
and void unless initialed by both parties.
