On behalf of Mayor Pat Geagan and Counciimember Peggy Carlson, I wanted to get back to you and respond to your concerns. Based on your address and your reference to Holz Farm Pazk, we concluded that your issues relate the Piney Woods development. This is one of a nuxnber of projects being developed by the Manley company. The challenge of managing development is that local govemments are obligated to respect private property rights, while establishing standazds to protect the heaith, safety and welfare of the community. Cities can and do regulate the way in which properties aze developed, but the standazds they apply must balance the interests of the owner and the community at lazge. The City of Eagan has a very detailed tree preservation and replacement ardinance. As outlined in the enclosed memo from our Forestry Supervisor, Gregg Hove, the preferred response to the ordinance is preservation of as many mariue, significant trees. The ordinance recognizes, however, that property development may not occur on some parcels without the removal of some trees. That is why the ordinance permits a maximum removal of 40% of the significant trees without requiring replacement. Significant trees removed in excess of that percentage are required to be replaced with small and medium sized trees in a planting pattem that can be expected to mature with the neighborhood. In reviewing development applications, we also have to consider a variety of other important issues at the same time, including storm water drainage and quality, utility layouts and adequacy, traffic and public safety access, pedestrian features and other factors in the interest of the proposed neighborhood and the rest of the community. These issues must be balanced with one another as well. While there were some areas of Eagan that were intensely farmed and required little tree removal for their development, many other neighborhoods have gone through the preservation, removal and replacement process. As those areas have matured the combination of older growth and newer trees help establish or reestablish a forested environment for the neighborhoods. The need to apply the ordinance has become increasingly important as the more easily developed areas of the City have been built and the more complex areas remain. Most of our recent development requests are infill projects on properties that present unique development challenges. Neighbors sometimes ask why the areas need to be developed at all. The laws of private property permit local governments to set reasonable standazds for development, but not to prohibit it, unless it is acquired through a negotiated purchase or due process. As you are pernutted to use and build on yout property as you wish, within the zoning standards for your area, the owners of undeveloped property have the same rights and we are obligated to review their applicaUons for development on that basis. That being the case, we work hard to apply standards that balance those interests, preserve as many mature trees as we can in the context of the other issues associated with an application and require replacement of the trees over the 40% maximucn removal. We try to insure that the replacement trees aze of a kind and size that will serve the neighborhood and community in the long run. I realize that this explanation does not replace the trees that were removed. I hope that it does help to explain why some tree removal is often part of the development of property and the steps that we take through our review and regulation process to limit and mitigate it. The reason I say this is that Manley currently has 4 development sites along Dodd Road (south of Clift), and two additional sites on Dodd Road (north of Cliff). Five of these six sites have acrive construction occuning on them. For your information and review, Pve faxed to you a map showing the location of these sites, and a database sheet summarizing tree preservafion/removal statistics on these sites. I've assembled this information because Manley daes have many development sites, with a corresponding high aznount of mitigation. The Piney woods site did, before development, have a lot of evergreen trees on it. These were obviously planted by someone years ago. At this time they aze about 12-16' in height. The development application as reviewed by staff had 556 significant trees on site. They proposed to physically remove (cut down) 180 trees (32%). Since this removal percentage is less than what our ordinance allows (40%), there is no required mitigation for this site. They also proposed to transplant 312 of the existing evergreen trees from this site to other Manley sites in town, to serve as required mirigation. So, in actuality, they will be removing (cutting down or spading off-site) 492 trees from tlris site. This is where I think Kevin Benz's email comes in. He is seeing a much different site here than what it used to look like. Construction is an ugly process to most people. I guess he (Benz) should be made aware that Eagan's Tree Preservation Ordiuauce does allow for tree removal, within limits. When limits are exceeded, tree replacement is enforced. If you refer to the database information I faxed to you, you'll see that the "Manley' method of site development typicaliy involves a high percentage of tree removal, with a resulting considerable amount of required tree replacement. Although developers like Manley aze meeting the physical requirement of our ordinance, this is not what residents usually understand, or like to see. This was once a beautiful area with many trees but no more. i would suggest that the city council take a drive to this area if they have not done so. The park once surrounded by trees is nothing but a baron field of lost beauty. I believe Eagan was listed as a"Tree City" but I became sick with the numher of mature trees that were cut down so a few houses could be put in. It irks me that when the Dodd road upgrade was being decided you talked about preserving trees, etc., but why did you waste your time when you now let Manley tear them all down. The city needs to put in place that for every tree remove new ones need to be replanted. Dodd road will never be the same again.
