Please find attached a complaint that I recendy sent to the Better Business Bureau. After
receiving the response from them (also attached), it occurred to me that they were not
creaced to promote better business, but to make swe that any business stays in business
no matter how bad their product is. Their biggest concern, it seems, is that the business's
image is protected. Shortly after sending the letter, we began having even more serious
issues relating to the house at 689 McFaddens Trail, Eagan, MN 55123.
Last week the pipes in the master bath started to freeze on cold days. On cold days, water
does not come out of the faucet. We fiave contacted the builder whose representative
visiteti the house but notbing has been done yet to fix the problem. This is a very serious
problem that should n2t have happened to a new house. 'I'his issue combined with the
potentiai mold problem from the basement having been insulated wrong and not to code,
warran,ts an investigation from one of your departments an the building practices of this
company. In reference to one of the complaints in the attached letter regarding the
basement, we decided not to wait for the builder to fix the problem and began tearing the
insWation down ourselves this week. The insularion was frozen to the wall fxom
retainiug moisture then freezing. If we had finished the baseinent the way it was 1eft, we
would eventuatly have a moId problem. I now woader if others in the neighborhood
anknowingly finished their basements and aze experiencing the same problem. A
comment was made that one neighbor is having an issue with nails in their basement
perspiring.
Our garage is finished and according to the City of Eagan we should have had several
vents put into tiie roof, There are ttone. The city said maybe they were asked to inspect
it before ihe work was done. This is another poYential mold problem and no one will take
responsibility to fix it now that we've tumed over the money.

This company is in business with '?mse from the State of Minnesota. Who is
watching them? Sornething must be done to protect the buyer from these issues which
would not have happened were the work done right in the fust place. I'm sure we'll
receive a response sooa from the builder on our letter to the B$B and I can guarantee you
that they will deny any wrongdoing. There's a joke in our neighborhood that "the builder
knows best"

I am sending t]us complaint in a letter format rxther than the foztn that you use online
because I feel it is a little more complicated than your usual complaint.
We recently built a home at 689 McFaddens Trail, Eagan, MTT, with Manley Brothers
Coastructian, 2113 Cli£f Drive, Eagan, Iv1N 55122. T'he pmcess began in early 2002 with
a set of ptans we already had. We chose Manley Brothers Construction (MBC) because
of the location of the property. The problerns began immediately after signing the
contract to build. T'his is the fourth home tlxat we havt built. It was also the most
atressfixl and frustradng experience that T have ever had to endure. The lack of quality
and professionalism was evident once the process with the builder began. It is important
that unsuspecting buyers are made aware of the problems they will face with this bniIder.
Not a day goes by that I am not reminded ef their lack of quality and untrained 9taff when
I took at the damage done to my home.
1. Problem: Our biggest problem is with the handling of all the woodwprk in the home
especially the cabinetry. MBC employs an inexperienced crew to do their painting
and sta;ning n>or}:. The entire ho;:se cabinetry needs to he replaced or repaired due tv
thenr lack of sanding and staining proPerly. I am now told that the bIotchy cabinets
aze due to improperly sanding then stai.ning orer the wood. The cabinets are ruined.
I have included pichues of several doors and the spots that yoa see aze not fmm the
photograph but actual spota on the cabinets. There is so little varnish on the wood
that it feels like they are going to crack. Some of them axe akeady. At the time of
closing I thought the cabinets couid be repaired. Now I find out beCause they are
raised panels that the doors haVe to be rep2aced insteyd of re-sanded. The entire cost
of the cabinets annouated to over $15,000 worth of prodncts that have been destroyed
from lack of any type of quality conuoi whatsoever. When (ooked at by a
professional, he said ii looks like they never wiped off the dust from the sanding or
sanded improperly before spraying on the stain. The builder wrote off a$500 charge
that vve were billed for overages on the stainzng of the cabinets but I still paid for the
Staining of the rest and the cabinets themselves. He told our realtor that he had given
us enough and wasn't doing any more. Not to menrion I'm still stuck with having

paid for over $15,000 in cabineuy that needs to be repaired. In exchange for this
$500 credit I had to sign a paper saying that they would not come back to paint or
stain any of our house. Tftis was 6ne because I didn't want them messing anyttung
else up with paint or stain. I called premiunn 6yooc{ wbere the cabinets vvere made_
They told me it would cost $3,561 for new door fronts for our cabinets. Th9s is the
only acceptable solution to fix the problem with the cabinets. I was Wld that I azn not
the only one that had problems with the cabinets. MBC should be required to stain
the doors as well but if they plan to use the same group of workess and process they
used the Grst time, l do not want thern to do the staining.
Solution: T'he only acceptable solution is for the builder to replace all the cabinet
doors in the home that tbeir company niined_
2. Problem: We have large cracks behveen our ceiling and the walfs because no tape
was used on the drywail. Tt looks like our ceiling is coming off &om the wall.
• Sotutioa: This must xepaired so that the ceiling is not coming offfrom the wall.
3. problem: When we moved into the home our entire second floor squeaked. We have
repaired some of the floor ouxselves but thete are areas that still squeak. When we
told the builder abont the squeaking, the site manager's response was that the
"squeak" had already been fixed. They had fxed one spot on the floor. They believe
if they fix one of the areas that you have complained about, then the entire azea is
fixed.
• Solution: Builder needs to fix areas of otu floor that squeak.
4. Problems: Accordeng to the City of Eagan our entire basement is improperly
insulated and is not to code and will have to be comp]etely redone. When we told the
builder's site manager whai the city told us, he said, "I told you that you would have
to tear some of that down." Of course, as usual, this was a typical reaction and he
didn't understand that this is a code issue. We did call the MBC office and they
called the company who supplied the insulation. Then the insu,iation company cailed
us and said it was MBC crew who put it up wrong not him and he would call the
MBC office and let them know. Of course, we've never heard back from the Ivi$C
office• What I don't understand is how these ltomes aze passing iaspection by the
City of Eagan .with work that the city is telling us was not done to code. The City of
Eagan also told us that we are mi;sing vents in, the garage that are.also supposed to be
done code. Wnere are they and hovv did the home pass ttis inspection? This
cauld be a very serious mold problem if these are not fixed.
? Solution: We need to have the insulation probletn fixed per code and the roo£vents
in the garage put in that are missing. Also, someone needs to essure that the city is
checldng the work before passing inspections.
5• Problem: To draw up the house plans the builder ez fera you to a planner (someozte to
draw up the lzouse plaus) that he regularly uses. You are given an allowance of
$2,000 (you've paid in the price of your homc) to have flse plans drawn up. We
already had a set of plans that had been started a few years ago. It took weeks to get
the planner, Planco, to draw np the plans in which we made very minor changes to.
We mec with Planco for only approxunately only one hour duting our entire planning
process with them. For some odd reason they, Planco, kept malang changes we did
not ask for which required us to ask them W put the house back the way we had asked
it to be origiually. We were told by the builder's representative that we should not be
aiiYwbere near the $2,000 allowance because we already had a plan. When we got
our Sna1 bill it was for over $1,906, which we did not receive until closing. IYs clear
that Planco lmows what the allowance is and chazges up to the full amount. In
x e x coznparing prices, T called D.C. Desigu in'Roseville. He told me it would cost us $.50
0 p? a square foot to draw our plans. This would malce the tota[ cost approximately
$ I,325. The buyer is seriously being taken advantage of here and should be waraed
not to use the builder's referral but to go somewhere else and pay on their own and
get a credit for the $2,000 plan allowance.
• Solution: We should receive a refund for thc $500 which we were overchazgeti.
6. problem: This is too late for any of the buyers in our neighborhood but it speaks to
the type of company that built our home. We were told by one of our neighbors there
is a document on file at Dakota County that states the buyers in the neighborhood
? were to have been told by the builder about a waier pressure issue in our
o Y development 'I'he water pressure is very low and we did not t"ind out about the issue ,
unril after we moved in. The neighbor told us about the document after we had
? 1y moved into the hovse. There should have been a paper that the buyers had to sign
that stated there would be low water pressure in the house giving the buyer the option
to make an informed decision before buying.
• Solution: I believe all the lots in the neighborhood aze soid, but if this issue exisu in
other developments the builder is doing, somethiag should be required that the buyer
has to sign.
7. Problem; When we began building, the business was beiag run out the builder's
home basement. Neaz our closing date the builder was planning to move into an
office• Our gaxage was used as a spray booth for MBC's new office that was being
built. T'hete is over-spray on all the walls from the staiaing work that was done for
their offices cabinets, 1'he builder has said that he would paint the gaiage but the
issue here is that it created a tremendous amount of disappointrnent regazding the
° buildi
? ng of the house for us and their lack of commitrnent to the customer. A clear
lack of respect for the customer and an attitude that the customer doesn't matter. We
. asked and our reaitor asked for them to stop the work but no one in the MBC office
would admit who was responsible for ihe work being done in our garage. The
customer does nct matter to thein.
• Solution: The Better Business Bureau has a responsibility to inform EVERY
potential buyer about the lack of quality, iack of respect, lack of cooperation that the
buyer will endure while building with this company.
8. Problem: At our first meeting, ?,r signing a contract to build a home, we were Wld
that the builder tacks on 15% to all overages. For example, in the original bid he
gives you a window thai costs $1DD, you want to change to a window that costs $200.
Fie charges you the extra $ 100 plus an extra $15 for an extra profit for himself: This
is something that should be disclosed aL the signing of the contraCt not weeks later. In
the four homes that we have built, thts was the only rime we had to pay this overage
so we had no idea that this practice even existed. Things get even more com,pficated
when selecring the plumbing fixtures. The builder said, don't pay attention to the
prices at the plumbing supply, you get a discount. What actually happens is that by
the time the plumber charges you for your selections and then the builder adds on for

0 y builder on this issue, they say they know it's a problem but there's nothing they can

• Solurion: Unfortwiatety this is too late for us but cuswmers showld be warned upon
wricing the contract that an extra I S% will be added to overages aad that some
products, mostly plumbing, will cost more ihan their reYail value.
When I called the Better Business Bureau office to see about downloading a fozm online,
one of your workers kept sayiag you need a lawyer, why don't you have a lawyer, get a
lawyer: This is not about having a lawyer to make sure that someone who takes over
$400,000 o£your money to build you a decent house, This is about a company that
builds a model home to show you their product then delivers you something much wotse,
including work not being done per code.
I can't believe that no one else has cannpiained to you regazding this builder. Every one
of our neighbors that we have ta[lced to is upset with the lack of quality in their house. I
don't know why no one else has complained except that building the hpuse becomes such
a long, stressful process that by the time you're done building, you decide to live with the
problems and hy to forget about it Our problem is that we've been left with many
thousands o£ dollars in mistakes and in work still needing to be done that we should not
have to do ourselves or worry about. No one else should have to go through what we
have. Early in ttus pmcess one of the builder's reps told our realtor that "4we're
emotional," I guess it'S in their plan to malce sure of that This isn't all the problems with
the house, bui the biggest ones. We have not done a 90 day punch list with the builder
because we've already been told they will do nothing about the cabinets.
I had planned to send copies of this complaint to the Attorney General and the
Departrnent of Commerce, At this poini I am not sure if I wi11 proceed because the lack
of a company to provide quality in their products is not something they can monitor.
However, the city's passzng of inspections for items not done to code is another issue of
concern, plain and simple this is some of the most poorly done work I have ever seen in
a house and buyers should be warned.
I invite anyone from the BBB to visit our home to see exacily the issues that this letter
addresses.
