W I T N E S S E T H: That tne Landowners, in consideration of L::e sum of Une Doiiar ($1.00) and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, do hereby grant and convey unto the City, its successors and assigns, a permanent drainage and utility easement, over, across and under the following described premises, situated within Dakota County, Minnesota, to-wit: A permanent easement for public drainage and utility purposes over, under and across the North 190 feet of the East 370 feet of LOT 1, BLOCK 4, WESCOTT GARDEN LOTS DAKOTA COUNTY MINNESOTA, according to the recorded plat thereof. Said permanent easement being all that part of the above-described property lying easterly of the following described LINE A and its extensions: Commencing at the northeast corner of said LOT 1; thence on an assumed bearing of North 89 degrees 46 minutes 25 seconds West along the northerly line of said LOT 1 for 10.00 feet to the actual point of beginning of said LINE A; thence South 00 degrees 15 minutes 52 seconds West, parallel with tne easterly line of said LOi i for i60.79 feet; thence South 19 degrees 49 minutes 27 seconds West 31.01 feet to the southerly line of said North 190 feet of the East 370 feet and there terminating. After completion of such construction, maintenance, repair or removal, the City shall restore the premises to the condition in which it was found prior to the commencement of such actions, save only for the necessary removal of trees, brush, undergrowth and other obstructions. The grant of the foregoing temporary construction easement for site grading purposes includes the right of the City, its contractors, agents and servants to enter upon the premises at all reasonable times to construct, reconstruct and inspect site grading and the further right to remove trees, brush, undergrowth and other obstructions.
