On September 12, 1989, during routine inspections, Plumbing
Inspector Bill Adams spotted a crew replacing blocks on the
foundation of an existing home at 4115 Havenhill Circle. He
stopped and talked with the construction crew who stated that they
were redoinq a foundation that had settled. Craig Knudsen of the
engineering department was contacted to see if this was a City
project.
Yesterday morning Craig Knudsen and Bill Bruestle found it to be
a City proj ect-- install ing a storm sewer through two lots. An
appointment was set up for an 8:30 inspection by Craig, Bill, Scott
(the superintendent of Rottlund Construction), and myself.
Scott explained what has taken place with this home. The east wall
had to be torn down and rebuilt, and the foundationJfooting area
had to be solidified in order to get down to load-bearing soils.
This was being done in coordination with Braun Engineering. There
was not a problem with the City's storm sewer project; it was the
sanitary sewer main that ran along the rear property lines of this
project which were excavated out and were not re-compacted. The
excavation boundaries were inside the foundation area of the home.
This sanitary sewer comes from the Country Hollow area and ties
into the City's sewer system as it c:omes ac;ross Dodd Road. Craig
is going to check with the engineering department to see if this
is a public engineerinq project.
I pulled the file for Lot 38, Block 7, Hills of Stonebridge, and
found that the buildinq permit was applied for on March 15, 1989
and picked up on March 21, with completion of the home on May 31,
1989. The superintendent from Rottlund Homes stated that the
homeowners have been very cooperative and that Rottlund Homes will
restore the home to its original condition before settlement. All
bills are beinq turned over to the developer who will then turn
them over to the City.
It is my concern that if the City was aware of this situation, the
building inspections department should have been notified so this
could have been followed-up earlier. I will forward more
information to you as it becomes available.

In reference to our telephone conversation on Monday, November 26, 1990, relative
to the above-referenced GAB file number, the City has been contacted by Larry
B. Guthrie on behalf of Ronald C. Helmer of United Mortgage. Your files will
indicate a claim by United Mortgage for expenses incurred as a result of what
United Mortgage claims to be improper utility trench construction compaction in
the building pad areas of the above-referenced lots as a result of utility
construction under a City contract. It seems as though United Mortgage is
desirous of challenging your denial of the claim as referenced in your
correspondence dated February 27, 1990, to United Mortgage Company. At this
point, the City's contractor's warranty period expires on December 6, 1990. If
there is a potential for a claim against the City, it seems appropriate to advise
the contractor, regardless of the liability issue, of a potential claim under
the warranty provisions of the contract. This notification should be made this
week.

referred to as "LANDOWNER" and the CITY OF EAGAN, a municipal
corporation, organized under the laws of the State of Minnesota,
hereinafter referred to as the "CITY".
WITNESSETH:
That the LANDOWNER, in consideration of the sum of One Dollar ($1.00)
and other good and valuable consideration, the receipt and
sufficiency of which is hereby acknowledged, does hereby grant and
convey unto the CITY, its successors and assigns, permanent easement
for drainage and utility purposes, over, across and under the
following described premises, situated within Dakota County,
Minnesota,_to-wit:
The east 10.00 feet, as measured along the east line, of Lot 38,
Block 7, HILLS OF STONEBRIDGE, according to the recorded plat
thereof.
The grant of the foregoing permanent easement for drainage and
utility purposes includes the right of the CITY, its contractors,
agents and servants to enter upon the premises at all reasonable
times to construct, reconstruct, inspect, repair and maintain pipes,
conduits, mains or ponds and the further right to remove trees,
brush, undergrowth and-other obstructions. After completion of such
construction, maintenance, repair or removal, the CITY shall restore
the premises to the condition in which it was found prior to the
commencement of such actions, save only for the necessary removal of
trees, brush, undergrowth and other obstructions.
And the LANDOWNER, its heirs and assigns, does covenant with the
CITY, its successors and assigns, that it is the LANDOWNER of the
premises aforesaid and has good right to grant and convey the
easement herein to the CITY.
IN TESTIMONY WAEREOF, the LANDOWNER has caused this easement to be

Dear General Manager Austin P. Keller Company:
Please be advised that the City of Eagan has received various
complaints and potential claims from United Mortgage and Braun
Engineering claiming that United Mortgage has suffered damages on
the two above specified Lots in the Hills of Stonebridge Addition
and that these losses and damages were caused by your company's
improper and incomplete compaction of the sanitary sewer trench
backfill which you constructed for the City of Eagan under Project
No. 491A, City Contract No. 87-21.
While the City does not admit the correctness of any of the
assertions made by United Mortqage regarding the alleged damages
to Lots 37 and Lot 38, Block 7, please be advised that if, in fact,
United Mortgage has suffered any damages which were caused by your
work in the vicinity of the subject Lots, it is the City of Eagan's
position that under the terms of the contract between your company
and the City of Eagan, your company is liable for any and all
claims, damages, liabilities and other losses which the City might
be subjected to due to the subject United Mortgage claims.
Once again, in advising you of these claims, the City of Eagan is
in no manner agreeing with the assertions made by United Mortgage,
but is only putting you on notice of these claims and advising you
of the City's position regarding your liability to the City if the
claims are, in fact, valid.

Hills of Stonebridge
Eagan, Minnesota
Dear Mr. Helmer;
As you requested, we have provided excavation observations
and compaction testing for Lot 37, Block 7 in the Hills of
Stonebridge subdivision. The purpose of the excavation
observations was to aid in evaluating that the previous
placed fill was removed from the footprint of the house and
its oversizing, and to evaluate the natural soils at the
excavation bottom for house and fill support. Also, during
our observations we tried to determine the lateral extenL or
the backfilling for the deep utility trench placed at the
rear of the house. The purpose of the compaction testing was
to aid in determining the density achieved in the fill
subsequently placed for house support.
Excavating and backfilling of this lot was completed during
the mass gradinq in the summer of 1987. Braun's observation
and compaction test records indicate we observed the lot on
June 9, 1987, and tested the fill on June 11, 1987.
A soil investigation of this lot was performed in August,
1989, due to problems that occurred to the house to the west.
Braun's soil report dated September 27, 1989, indicated loose
to very loose silty sand fill was encountered below the upper
5 feet of the proposed house pad. In this report we
recommended all the existing fill belov the house pad and its
oversizing be removed down to natural soils. The existing

fill could then be reused and recompacted. For more information why
we recommended the existing fill be removed, we refer you to our
report dated September 27, 1989.
EXCAVATION OSSERVATIONS
Excavation observations on this lot were performed by an
engineering assistant from April 23 through May 1, 1990.
The existing fill was removed from Lot 37, Block 7, exposinq
naturally deposited silty sand. The fill was removed in 12 to 15-
foot strips starting at the rear of the lot. During our
observations, undisturbed natural soils were encountered at
elevations ranging from 847 to 864 feet.
The natural soil generally consisted of fine to medium grained
silty sand. Based on the turning resistance of the hand auger
probe, the soil is estimated to be in a medium dense condition.
The excavation extended to the east and west lot lines, which
allowed for approximately 15 to 20 feet of oversizing along the
east and west proposed house lines. The north and south excavation
limits extended to the proposed front house line on the north side
and approximately 23 feet south of the proposed south house lina,
which allowed for a minimum of 20 feet of oversizing.
Adjacent to the existing sanitary sewer, the existing fill was
removed to elevation 843± feet, which is within 8 feet or the
sanitary sewer invert elevation.
After the existing fill was removed, the natural soil slope was
benched prior to replacing the excavated fill.
COMPACTZON TESTING
The fill which was removed from Lot 37, Block 7 during the
excavation was reused during the backfilling of this lot. The fill
soils generally consisted of silty sand.
A total of 16 compaction tests (#1 through $16) were performed from
April 23 through May 4, 1990. The compaction tests met or exceeded
the recommended density of 95% of standard Proctor. The compaction
test results are attached to this report.

Based on our excavation observations, it appears the existing fill
was removed from the house pad area and its oversizing. The natural
silty sand soils encountered at the excavation bottom were judged
suitable for house and fill support. Based on the compaction test
results, it is our opinion that the fill placed was suitable for
house support.
Based on our observation of the excavation and the soil borings
previously completed, it is our opinion that the backfill for the
utility placed at the rear of the lot encroached into the house
area and its oversizing. The attached sketches indicate our best
interpretation on how the backfill of this uti2ity trench extended
below the house pad.

Services performed by the geotechnical and materials engineers for
this project have been conducted with that level of care and skill
ordinarily exercised by members of the profession currently
practicing in this area. No warranty, expressed or implied, is
made.

Mr. Shellerud:
As reguested, we have completed a soil investigation at the
above referenced house. The purpose of this investigation
is to aid in evaluating the possible causes of the distress
noted at the southeast corner of the house.
BACKGROUND
Excavating and backfilling of this lot was completed in the
summer of 1987. Braun's observation and compaction testing
records indicate that we observed the lot on June 9, 1967,
and tested the fill on June 11, 1987.
Our observation record indicates that 1 to 1-1/2 feec of
topsoil was stripped from the house pad area. The excava-
tion bottom soils consisted of silty sand, silty clayey sand
and silty clay with sand. These soils were judged to be in
a medium dense condition. The lot was stripped to approxi-
mately 160 feet from the center of Havenhill Circle cul-de-
sac.

After the topsoil was stripped the excavation was benched to
better tie the fill into the existing slope. Fill was only
required in the extreme southeast corner of the house. Our
records indicate 7 feet of fill was placed. Two compaction
tests were then taken in the fill. Both compaction tests
(#11 and #14) exceeded minimum density requirements of 90%
of modified Proctor.
It should be noted that our observation was completed on Lot
41, Block 7. Later, this lot number was changed to Lot 38,
Block 7, Hills of Stonebridge.
Sanitary and storm sewers were then placed in utility ease-
ments on the above referenced lot. A sanitary sewer was
placed in either September or November of 1987. The sani-
tary sewer crossed the lot just north of the southeast lot
corner. A storm sewer was placed along the east property
line.
The house was then built in the spring of 1989. The base-
ment excavation was completed in March 1989, with footings
extending deeper than normal to extend below frozen soils.
The house was then framed in April 1989. Signs of distress
at the southeast corner of the house were not noted until
early July, 1989. The distress coincided with the
sprinkling of the lawn after the sod was placed.
HOUSE OBSERVATION
On July 27, 1989, representatives of Braun Engineering
Testing observed the distress in the southeast corner of the
house. A large crack was observed starting at the east wall
approximately 20 feet north of the southeast corner and
extended diagonally across the basement slab to the middle
of the south wall. The basement slab appears to be settling
at the southeast corner. Cracking of the masonry block
in the east wall was also noted approximately 15 feet north
of the south wall. The masonry block had cracks of up to
1/2-inch in width.
Some distress to the drywall in the upper floors was also
observed. Temporary support of the first floor was being
transmitted down to the basement slab by jacking to try and
minimize the distress to the upper levels of the house.

SOIL BORINGS
To further evaluate the soil conditions at the southeast
corner of the house, two soil borings were completed near
the house. The borings were completed with a flotation-
tired mounted drill rig. Boring ST-1 was taken approxima-
tely 3 feet east of the southeast corner of the house, and
boring ST-2 was taken approximately 17 feet east of the
southeast corner of the house. The attached survey plan
indicates the approximate boring locations.
The two soil borings encountered what was judged to be 14 to
17 feet of silty sand to silty clayey sand fill. Penetration
resistances indicated the fill was in a very loose to loose
condition. Underlying the fill, the borings encountered
poorly graded sand glacial outwash to the borings' ter-
mination depth. The sands were in a medium dense condition.
The soil boring logs are attached to this report.
ANALXSIS
Based on the soil boring results, it appears that the
distress to the southeast corner of the house is likely
associated with the loose fi11. Consolidation of this fill
likely occurred due to heavy sprinkling of the lawn causing
water migration through the loose fill.
There are a number of possible reasons why the loose fill is
present below the southeast house corner. We will outline
these possible reasons in the following paragraphs.
Location of House: One possibility is that the house was
constructed outside of the prepared house pad. If the house was
placed further back on the lot, deeper fill would result and
possibly looser fill could be encountered.
We then measured the house to the property corner, and to
the center of the cul-de-sac. Measurements in the field
indicated that the northeast corner of the house was
approximately 58 feet south of the northeast property corner
and the house was 26.3 feet wide in a north-south direction.
Based on this information and the proposed development plan,
it appears the house was constructed within a couple of feet
of the 50 x 50 foot pad originally prepared in the summer of
1987. Thus, it is our opinion that the location of the
house was not the cause of the house distress.

Mass Gradinq: There is a possibility during placement of
the original fill that the excavation bottom was not pro-
perly cleaned out of poor soils or fill improperly com-
pacted. However, we have records indicating that 1 to 1-1/2
foot of topsoil was stripped. The excavation bottom con-
sisted of silty sand to silty clayey sand which is typical
for this area. These soils were judged to be in a medium
dense condition. The excavation was then benched to tie the
new fill into the natural 3:1 slope. The excavation was
also oversized 7 to 10 feet to provide lateral stability to
the fill.
The fill was then placed into the house area. Our records
indicate 7 feet of fill was placed in the southeast corner
of the house. The remainder of the house was cut to base-
ment grade. The fill used was primarily silty sand or
silty clayey sand. The fill was compacted and two compac-
tion tests taken in the backfill. Both compaction tests
exceeded the minimum density requirement of 90% of modified
Proctor density.
Based on this information, it is our opinion that after the
mass grading was completed in 1987, that the building pad
was suitable for house support.

It should be noted that an additional 1 to 2 feet of fill
was placed on this lot in the fall of 1988. It was indi-
cated to the grading contractor that the lot was a couple
feet low, and additional fill was placed. This limited
additional fill would only affect the garage floor slab
area. One compaction test (CT-351) was completed` in the
fill placed in 1988. This compaction test met minimum den-

The storm sewer ran along the east property line extended
from 30 to 38 feet away from the house. The invert of the
storm sewer ranged from elevation 844 to 850 adjacent to the
house. This would put the storm sewer approximately 20 to
25 feet below basement grade. At this depth and distance
from the house, it is our opinion that the storm sewer
construction was likely too far away from the house to
affect it.

The sanitary sewer was constructed in the easement southeast
of the house and ran across the lot in a northeasterly to
svuthwesterly direction. The sewer came within 32 feet of
the house southeast corner and had an invert near elevation
835. Since the sewer extends approximately 35 feet below
the basement grade and is within 32 feet of the house, it is
our opinion that the sewer excavation likely extended into
the house pad and may be the reason for more fill below the
house corner than was anticipated after the mass grading.
Attached to this reports is a cross section of the house
location, the original grades, proposed final grades, sewer
location, and possible sewer excavations of 1:1 and 1.5:1
sideslopes. Also, we have attached the sanitary sewer plans
for your information.
Compaction testing of the sanitary sewer backfill was done
randomly along the sewer alignment. It is our understanding
_ that compaction tests were not taken in the backfill placed
between MH#17 and MH#18 which is the portion of the sewer on
this lot.
RECOMMENDATIONS
The primary concern now is to correct the soils for house
support and minimize disturbance as much as possible. Based
on the soil types encountered, it is our engineering opinion
that the best method would be to utilize compaction grouting
below the house. Compaction grouting consists of pumping a
lean concrete into the soils displacing and densifying the
loose fill. It should be anticipated that approximately 17
feet of fill below exterior footings will require compaction
, grouting. Compaction grouting will have to extend below the
footings and extending away from the footings a minimum of
10 feet in each direction. The compaction grouting on
either side of the footings will provide lateral stability
to the foundations. After the grouting the floor slab
showing distress should then be cut out and replaced.
GENERAL REMARKS
Services performed by the geotechnical engineers for this
project have been conducted in a manner consistent with that
level of care and skill ordinarily exercised by members of
the profession currently practicing in this area. No
warranty, expressed or implied, is made.
