Dear Mr. Ferry:
This ]etter is in confirmation of our telephone conversation on September 19th in regards
to the bituminous trai] adjacent to your property at the end of Heine Strasse.
As I mentioned to you, I have spoken with the City's Director of Parks and Recreation,
Ken Vraa, about the trail, retaining wall, and drainage from the adjoining properties. It
is the City's position that the trail is in need of some repair, including the section which
has been s]ightly heaved as a result of tree roots. In addition, the Street Maintenance and
Park Maintenance Divisions have agreed to work collectively in performing an overlay of
the entire trail this fall as part of our trail maintenance program. As you know, this trail
was originally installed in the early 1980's and it would be appropriate to perform the
overlay operation at this time.
Pertaining to the retaining wall, it appears that the wall is still in good structural condition
even though a portion has slightly bowed and a small bit of washing has occurred at the
low point in the trail. With limited budgets, I have to tell you that the City is not
currently in a position to consider the replacement of this wall or to perform any major
restoration work. With 35 developed parks competing for limited funds, it is simply not
a priority in terms of the overall Park and Recreation system, including vails. This is not
to say that the wall will not need replacement in the future. While this will certainly be
the case, it appears to be premature at this time. If you have an interest in assisting the
City with improving the wall, it would be preferable that it be done at such time as when
the wall is in a condition needing replacement.

I would like to reiterate again the point I made earlier in regards to drainage of water
from adjacent properties onto your lawn. At the time the Heine First Subdivision was
originally submitted to the City for approval, there was an accompanying grading plan
which depicted contours of the land between properties and the direction in which
overland water flow would occur. Thus, the water which spills onto your property from
the surrounding areas is based on the original grading which occurred as part of the
subdivision development. This is not something which the City now has any control over.
Manipulation of the grades to redirect water flow would require the installation of storm
sewer pipes and catch basins, and simply be cost prohibitive.
In a City like Eagan which has an abundance of rolling hills, these sorts of drainage issues
between adjacent properties are fairly common. As pointed out during our on site
meeting, the amount of water draining into your yard is not excessive. The movement of
water across you property could be facilitated by your construction of a small drainage
swale towards the low area behind your home. Additionally, the City may be able to
redirect some of the water flow when the overlay into the trail is performed; i.e, by
sloping the bituminous towards the ponding area as it approaches the curve in the trail.
I trust that this letter has helped to better explain the City's position on this matter.
While we cannot assist you in terms of the drainage situation, we will perform what work
we can, within budgetary restrictions, in performing maintenance on the trail. We thank

My name is Todd Ferry and I am a resident of Eagan living at 4272 Heine
Strasse.
I have previously notified your office regarding the deterioration of a
walking path and retaining wall adjacent to our property. The easement
for this path is on our neighbor's property, however we are suffering
the consequences of the lack of upkeep resulting from what, in my opinion,
is an irresponsible design and construction of the retaining wall which
does not allow for proper water drainage. The improper drainage has
caused the tar to wash away, leaving a hazard (large hole) in the walking
path along with forcing a pile of gravel to erode under the retaining
wall onto our property. The water that collects in this area flows onto
our property and has killed 4 Chinese lilac shrubs, and we have recently
noticed that our ash tree is dying.
Not considering the damage that has occurred, the walking path which has
heen superficially patched many times and the leaning retaining wall are
a sore sight to look at.
It is my understanding that the City of Eagan is responsible for maintaining
this walking path and retaining wall. As I stated earlier, I have called
and discussed this problem with two different individuals who informed me
that the situation would be looked at and that I would be contacted not
only with a proposed solution, but also to give my input on reaching a
solution. I have heard nothing.
We have recently taken photographs of the damage and also a video of the
water which is flowing onto our property rather than being diverted onto
the street.
I am now appealing to your for the last time and asking that this situation
be rectified. I not only expect a phone call from an official who is able
to make decisions, to notify me of what has been done or will be done, but
also expect that the damage to my property will be restored to its original
status.
My intent is not to create a dispute with the City of Eagan. It is to
correct the problem in whatever way is necessary. I am open to any
suggestions you may have to not only correct the drainage problem, but
also to create a more visually enjoyable walking path.
I would appreciate a response no later than Monday, September 17, 1990.
