WI-TEREAS, on December 4, 2006, the City of Eagan (the "City") adopted special
assessments in connection with City Rublic Improvement Project 776 (the "Project"); and
WFIERBA3, Properties owned by Appellants Gopher Resoixrce Coxporation, a/ic/a
Gopher Smelting & Refining Company and Lo Nidy Company, Inc. ("Appellants") were
specially assessed for improvements associated with the Project; and
WHEREAS, Appellants appealed the special assessments to the District Court (the
"Assessnient Lifigation"); and
WHEREAS, the Parties engaged in mediation and have reached a settlement conceming
the Assessment Litigation.
NOW, THEREFORE, the Appellants and the City agree as follows:
1. DEk'ERMExT oF ASSESSMENrs. The assessmenfs against Property owned by
Appetlant Gopher Resouroe Corporarion.(PIN 10-01260-010-77) aze hereby
deferred in accordance with the terms of the Assessment Deferral Agreement
attached hereto as Exhiibit "A."

good and valuable consideration, the receipt and sufficiency of which are herehy agree as

DEFERRED ASSESSMENTS. Pursuant to Minn. Stat. § 429.061, subd. 2, the
Parties agree that the payment of the first installment of the Assessments,
including interest thereon, shall be deferred until the Properiy is so1d,
subdivided, platted or otherwise developed, whichever occurs first, at
which time the first installment of the Assessments shall become due and
payabte. The Assessments shait bear interest at the rate of five and one-
halF percent (5'/:%) per annum as set forth in the assessment roil for the
Project. When the first instaIlment of the Assessments becomes due and
payable, interest accrued on the Assessments from December 4, 2006, to
December 31 of flie yeaz that the first Snstallment of Assessments becomes
due and payable shall be added to the original principal amounts of the
assessments, and the totals of those amounts shalt becozne the "Principal
Assessment Amounts Payable." The Principal Assessment Amounts
Payable shall be divided for payment into ten equal annual installments, or
such lesser number of equal annual installments as is necessary for the iast
installment thereof to ba payable not more than 30 yeazs after the levy of
the Assessments. The first installment of the Principal Assessment
Amounts Payable, plus one year interest thereon unril December 31 of the
year in wluch the first installment is to be paid, shall be included in the
first tax rolls completed after it becomes due and payable, and shali be
paid in the same yeaz as the taxes contained therein, and to each
subsequent installmeni shall be added 'sntexest for one yeaz on the

remaining unpaid installments which shall be paid in a like manner. Tke
Parties agree that, notwitlxstanding anything in this Agreement to the
contrary, the Assessment and all interest therean must be paid in full no

paid prior to December 31, 2026, the Principal Assessment Amounts
Payable shall be payable in 10 annual instaliments commencing January 1,
2026, together with interest thereon at the raYe of five and one-half percent
(5'/:%) per annum and payable over the next ten (10) years. •
2. Waivsx. The Landowner hereby accepts the Assessments and hereby
waives the right to ohject or appeal the Assessments pursuant to MIt1N.
S'rn'r. § 429.081 and fiarther waives notice of hearing on this Agreement.

Project. When the first instaliment of the Assessments becomes due and
payabfe, interest accrued on the Assessments &om Decembez 4, 2006, to
Decernber 31 of the year that the first installment of Assessments becomes
due and payabie shail be added to the original principal aznounts of the
assessments, and the totats o£ those amounts sha11 become the "Principal
Assessment Amounts Payable." The Principal Assessment Amounts
Payable shall be divided for payment into ten equal annual installmenEs, or .
such lesser number of equal annual installments as is necessary for the last
installment thereof to be payable not more than 30 years after the levy of
the Assessments. The first instaIlment of the Principal Assessment
Amounts Payable, plus one yeaz interest thereon until Decemher 31 of the
year in which the first installment is to he paid, shall be included in the
first tas rolls completLd after if becomes due and payable, and shall be
paid in the same year as the taxes cantained therein, and to each
subsequent instaliment shall be added interest for one year on the ,

remaining unpaid installments which shatl be paid in a like manner. The
Parties agree that, notwithstanding anything in this Agreement to the
contrary, the Assessment and all interest thereon must be paid in full no

paid prior to December 31, 2026, fhe Principal Assessment Amounts
Payable shat] be payable in 10 annnal instaltments coinmencing January 1,
2026, together with interest thereon at the zate of &ve and one-half percent
(5'/x%) per annum and payable over the next ten (10) years.

waives the right to object or appeal the Assessments pursuant to MI1vta.

Gentlemen:
Just about one year ago, the reconstruction of the frontage road
incorporating the cul-de-sac in the northeast quadrant of Yankee
Doodle Road (County Road 28) and T.H. 149 was completed. As you
know, the actual connection to T.H. 149 was not included in that
project due to special conditions that would have been placed on
the MnDot highway access permit required.
Recently, the City has been receiving calls and complaints
regarding the condition of this residual unconstructed old entrance
to the new frontage road. It appears that this segment of roadway
is beyond a condition which can be adequately maintained by the
City's general street maintenance operations. Subsequently, there
appears to be a necessity to pursue the completion of this
improvement to its connection to T.H. 149.
Please be informed that the City has directed its consulting
engineers to evaluate in detail the specific requirements of the
access permit associated with this referenced improvement. Once
this information has been made available, it will be sent to your
attention to determine if any or all of you would like to pursue
this improvement and assume its associated financial obligations.

APPLICATION SUMMARY: An application has been submitted requesting a Conditionnl
Use Permit for sales and service for trucks/equipment and open storage. The Light
Industrial zoning district allows said uses by Conditional Use Permit. The site in question
is located on the northeast corner of the intersection of Highway 149 and Yankee Doodle
Road at the end of Kutoff Court.
COMMENTS: The site in question includes an existing building formerly occupied by
General Pump Company. The building has been vacant since February 1990. The
applicant is seeking the Conditional Use Permit to allow a heavy equipment repair and
sales use which will require open storage.
The proposal includes fencing the eastern half of the lot for the purpose of enclosing the
parking and outdoor storage area. This site shall be landscaped and specifically, the south
property line of the storage area will require significant screening materials to buffer this
storage from Highway 149.
SITE PLAN: T'he existing parking lot at the site is bituminous which is in poor condition
because of inadequate drainage. Staff recommends that the parking lot be upgraded to
City standards with concrete. curb and gutter around the edge of the parking lot, storm
sewer to drain the parking lot and a bituminous overlay added to improve the poor
condition of the parking lot. The parking lot improvements shall also provide a handicap
access ramp to the existing office building and handicap parking spaces in the lot.

The east half of the lot that will be used for storing equipment shall be upgraded to a
bituminous or concrete parking lot with concrete curb and gutter. The drainage from this
new lot shall drain to a new catch basin that would drain to the existing 48" storm sewer
that is located along the east property line of the site.
The applicant should prepare a new site plan slowing the parking lot improvements and
a grading, drainage, and erosion control plan to show that the drainage from the site shall
be conveyed to the City's storm sewer.
If approved, this Conditional Use Permit shall be subject to the following:
1. . A landscape plan shall be approved by City staff and implemented by June 1,
1991.
2. A site plan shall be submitted showing parking lot improvements and a grading,
drainage, and erosion control plan.
3. All other applicable City Codes.

approval to operate a temporary outdoor tent saie from June 7-10, 1995 provided there
are no location or size changes in the proposed sale from the 1994 application. The
subject sale shall meet the following conditions:

SUMMARY OF REOUEST
The applicant is requesting a Special Use Permit to allow an outdoor "tent sale" June 15-18,
1994, on the south side of the existing building located on Lot 2, Block 1, Gopher Eagan
Indusuial Pazk 2nd Addition (PID #10-30601-020-01).
BACKGROUND
The applicant requested a special use permit and was granted approval tiy the City Council
for this same event at the same location the past two years. Staff is not aware of any
problems associated with these past events.
The proposed event will be the 3rd Annual Tent Sale and will include the erection of a 20'X
50' tcnt to be located on the driveway on the south side of the Marvin Smith & Son
building. Pazking for the event will be provided on the north side of the building. The
applicant is proposing to set up the tent a week early to air it out and floor plan
merchandise and will start to disassemble the tent on June 20, 1994.
Staff recommends approval of this Special Use Permit subject to the following conditions:

1. This Special Use Permit is temporary and shall valid June 15-18, 1994.
2. Set-up shall not take place prior to June 8, 1994.
3. The tent shall be removed no later than June 21, 1994.
4. The permit shall be subject to all applicable Ciry policies and ordinances.
5. The outdoor sales will be resuicted to the same hours as Smitty's Oudet Store.

As part of the MCES Service Availability Chazge (SAC) policy, all industries holding an Industrial
Discharge Permit aze suhject to a wastewater volume review one year prior to the expiration of the'u
perrnit. SAC is a"connection" fee which has been levied since 1973 for new connections or increased
volume dischazeed by existing users to the Metronolitan Disposal System (MDS). SAC revenue is
used to pay for the unused reserve capacity portion of debt service for capital improvements.
The wastewater volume review serves as a method for detecting wastewater volume increases from a
facility. Clirrent wastewater volumes aze converted to a SAC equivalent and compazed to a SAC
baseline value. Any increases over the baseline value, or the value for SAC credits, whichever is
greater, have the potential to be assessed SAC.
Three years ago, the first wastewater volume review for your facility took place. At that time,
wastewater volumes from your facility were noted to be below SAC baseline and/or SAC credit levels.
For Gopher Resource Corporation, the second wastewater volume review for your facility has been
completed and, a preliminary evaluation of wastewater flows indicates an increased use of the sanitary
sewer, above the 5AC baseline and/or SAC credit levels, equivalent to 74 5AC units. Please refer to
the attached worksheet for the results of the review.
Based on the 1997 SAC rate of $950 per unit, this increase will result in a charge of $70,300 due at the
time of pemut renewal.
A follow-up letter will be mailed to you four months prior to pernut renewal describing two options
regazding a potentiai SAC purcha;e. Tbe fi.-sY opuca ?vill be ta gurchase SAC based on the preliminary
volume review results and SAC rate described above and in the attached worksheet.
The second option will be to conduct a 30-day wastewater volume study to deteanine the updated
SAC equivalent of wastewater flows. The SAC rate applied to the results of the 30-day volume study
will be the rate in effect at the start of the study. The 1997 SAC rate is $950 per unit. (The volume
study option will be beneficial to your company if you choose to initiate wastewater reduction
measures to reduce or eliminate the amount of SAC due.)

that some cities use SAC deternvnations to assess municipal impact or connection fees which aze
