My name is Roxanne B. Baumann and I live at 3245 Highway 55 in
Eagan. I am writing regarding the notice of special assessment on Project
10P749 which I received.
This letter is written to notify the Council that I object to the
second assessment ($5,000) but am wiiling to accept the first assessment
of $2500.
I realize that my lot is large enough to make it into two single-
family lots but I have no desire to ever do that as long as I hold fihe title
to the property. My property should be considered as a single family lot
just like all my Rei,ghbors. If my land is ever divided the city can assess
accordingly.
I appreciate the Council's time and help regarding my assessment.

ASSESSMENT AGREEMENT
This Assessment Agreement ("Agreement") is made this R?? day of _... ?J ,
2001, by and between ROXANNE B. BAUMANN, a single person, (hereinaRer "L downer"),
and the CITY OF EAGAN, a Minnesota municipal corporation (hereinafter "City") (hereinafter
collectively referred to as the "Parties").
WHEREAS, Landowner is the fee owner of property located in the City of Eagan,
County of Dakota, State of Minnesota and legally described as:
The East 249 feet of the West 582 feet of that part of Lot 10, Auditor's Sub. No.
38, Egan, lying in the NE Y< of the NW '/< of Section 12, Township 27, Range 23;
Also The East 249 feet of the West 582 feet of the North 370 feet of Lot 8 of
Auditor's Sub. No. 38, Egan, lying in the SE'/a ofNW1/4 of Section 12, Township
27, Range 23 all according to the Plat thereof now on file and of record in the
office of the Register of Deeds within and for Dakota County, Minnesota
(hereinafter the "Property").
WHEREAS, as part of Public Improvement Project No. 749 (hereinafrer the "Project"),
the Property was assessed $5,000.00 for street chazges using a two lot equivalent (e.g. $2,500.00
per lot);
WHEREAS, Landowner has requested that the City defer one lot equivalent charge from
the assessment and collect the same upon subdivision or development of the Property; and
WHEREAS, the City is willing to defer one lot equivalent lot charge all upon the terms
and conditions contained herein.
NOW, THEREFORE, in consideration of the mutual promises contained herein and other
good and valuable consideration, the receipt and sufficiency of which aze hereby acknowledged,
the Parties do hereby agree as follows:
Deferment of Lot Equivalent CharQe. The Property is hereby immediately
assessed the sum of $2,500.00 for one lot equivalent. The other $2,500.00 lot
equivalent charge shall be deferred, with interest at the rate of 7% per annum.
The deferment shall end if the Property is subdivided, platted, otherwise
developed or December 31, 2029, whichever occurs first. Then, the deferred lot
equivalent shall be payable in one lump sum.
2. Waiver. Landowner hereby waives her right to object or appeal any connection
chazges pursuant to MrNN. STAT. §429.081 and fiirther waives notice of hearing
conceming this agreement.
Bindin Effect. This Agreement shall be binding upon and inure to the benefit of
the Parties' heirs, succe ssors and assigns d shall run with the land.

1. Deferment of Lot Equivalent Charge. The Proper7 is hereby immediately

equivalent charge shall be deferred, with interest at the rate of 7% per annum.
The deferment shall end if the Property is subdivided, platted, otherwise

2. Waiver. Landowner hereby waives her right to object or appeal any connection
charges pursuant to Mitvlv. STnT. §429.081 and further waives notice of hearing
concerning this agreement.

My name is Roxanne B. Baumann and I live at 3245 Nighway 55 in
Eagan, i am writing regarding the notice of special assessment on Project
10P749 which I received.
This letter is written to notify the Council that I object to the
second assessment ($5,000) but am wifling to accept the first assessment
of $2500.
i realize that my lot is large enough to make it into two single-
family (ots but I have no desire to ever do that as long as I hold the title
to the property. My property should be considered as a single family lot
just like all my neighbors. If my land is ever divided the city can assess
accordingly.
I appreciate the Council's time and help regarding my assessment.
