sheet).
A. Welcome and Introduction
City Engineer Maithys welcomed the property representadves. He also explained that the public
hearings for Project 749 and 784R will be held at the next council meeting oa August 7, 2001.
B. Presentation of Project Details
City Engineer Matthys explained the street and utility improvements made and that the assessmenu
proposed to be levied are in accordance with the Ciry's Assessment Policy.
C. Questions/Comments
1. Why assess $22,500 to close Access Road when it does aot benefit Hwy. 55 resIdents? Cos1
to close access from frontage road to TH 55 was not assessed. State gave City S250,000 wLy
was that not in letter? Detailed information on the sources for 5nancing the City's portion of
the project costs were not included. Why is City paying less than residents once the State
money is subtracted? The use of the Cooperative Agreement funding is handled the same
way State Aid funding is handled on aay project with special assessments. The Ciry's
Assessment Policy treats all properties equally, whether or not they are on a State Aid street.
2. Do you think this sssessment is fair to the Hwy. 55 residents? The assessments are in
accordance with the City's Assessment Policy.
3. Why s6ould Rosann pay for 21ots when sLe only Las 1 home there? The size of the lot and
the locarion of the house provide an opportunity to sub-divide the property into 21ots.
4. Are Crane Creek resideats able W drlve down the Hwy. 55 Frontage Road? Yes, the
frontage road is a public street.
5. When I signed the easement I didn't know about Crane Creek being able to use the Hwy.
55 Frontage Rosd. Development application was not in at the 6me. Previous development
proposals had been denied by the Ciry Council. City staff did not lmow what plan was for
future access W undeveloped property.
6. Added sdditlonsi road to Chapel Lane to 6elp oat Frontage Rosd for Crane Creek.
7. I was told the Frontage Road was to hetp ont only Hwy. 55 residents and oow tt is being
used by t6e residents of Crane Creek. The frontage road is a public street.

8. Why was rosd reconstructed, nothIng was ever kept up here before? Frontage road was
built by MnDOT and sdll is MnDOT's road today. Typical of many MnDOT frontage roads,
MnDOT has not maintained or snow plowed frontage road. City has snow plowed road due w
need of Eagan residents. Ciry forces have responded to rosidents' maintenance requests, even
though MnDpT road. As part of Cooperative Agreement, MnDOT will transfer ownership of
frontage road to City of Eagan.
9. On November 28, John Gorder said only 376 trips were made on Hwy. SS frontage rosd
per day, whst is typical oa ihis rosd today? Typical haffic today would be neighborhood
residential traffic plus construcdon traffic for Crane Cnek. Crane Creek has approved
construction access off of TH 55 and new Chapel Lane access.
10. I signed the easement because of misinformation, was it fsir that I signed because they
were at my 6ouse so much and they said they would condemn my land? The only
informaeon presented by City staff and ffie consultants was based on the facts at the time of the
discussions. Changes made by the City Councit and developer afterwards as a part of the
development of Crane Creek were made at public meetings at which you attended and were
given the opportunity to express your concems.
11. Was it fair that they were here so much? 7 days for over 12 hours totat. Was it proper to
bother me night after night? If I did not want to speak to someone lmocking on my door, I
would tell him or her so. As a steward of your tax dollars, it is cheaper w negotiate for
easements with the property owners than to go through the condemnation process.
12. Who pat up the sign on Hwy. 55 that says no construction trucks can go down road?
Crane Creek Development did at the encouragement of Mr. Earl E12iag.
13. Roger Schsaf discussed his residential ssaessment, whicL was different that the cost
induded in the feasi6ility reporG City staff will review. (The resideatial lot was subject to a
comer lot credit. The feasibiliry report referenced the maximum credit of 75', whereas the size
of the lot warranu a 67.5' credit. The addidonal cost of $382.86 was expIained to Mr. SchaaPs
satisfacrion in a letter.)
14. How long is Hwy. 55 frontage road? 21001inear feet W6y is Hwy. 55 & Louis Lnne street
assessment almost t6e same? Almost the same cost when length so diiferent Street
constcuction costs wen similar due to nazrowness of &ontage road and extra width and heavier
secrion of Louis Lane. However, residential assessments arc based upon standard City street
width (32') and section.
15. Frank's house is lower than road, isn't assessment bssed ou beneIIt to property? A real
estate appraiser deterntined the benefit w Mr. Huml's property.
16. Was any money allocated from State to Louis Lane? Funding was only allocated for access
improvemenu at TH 55, not for Louis Lane.

17. Hwy. 55 residents pay $2,500. Frank is paying $25,000 is that fair? Assessments are based
upon real estate appraisers' valuations.
18. It is unfair that I now get Cherrywood Knoll tranc and pay so much? Didn't ask for
utility hook ups, but got charged for them.
19• If I psy part of the sssessment now, do I get cLarged interest on the rest if I pay it aeat
year? You may pay any portion or all of the assessment within 30 days after the close of the
public hearing and the approval of the assessment roll without any interest being accrued on the
portion paid. The remainder would accrue interest for the nmainder of 2001 and all of 2002.
20. Will there be interest if not paid by September 8, 2001? Yes. Any assessment paid this
year aRer September 8, but prior to end of November, check with County on final date of 2001
payment, would be charged interest for the remainder of 2001.
21. Do all jobs ran this way, wit6oat mall for a weely water s6ut off for 4 days? I understand
mail was not delivered for first two days, although post office was reminded of construcdon
change the day prior to use of temporary mailboxes. Coordination with postal service is
sometimes frustrating. I do Irnow that mail delivery did begin when staff contacted post office
and access was available to delivery Uuck every day during conshvction. Unawaze of any
other missed days. Water shut offs were necessary for fue hydrant relocations and service
stubs. Each one occurred aRer residents were given oae-day notice. One shut off period was
extended due to gate valve not be indicated on City records.
22. Is this assessment fair? The assessments are in accordance to the Ciry's Assessment Policy.
Based upon the assessment policy, they are fair.

Earl Elling, 3295 Highway 55, discussed an easement agreement in conjunction with Project 749,
Highway 55 Frontage Road. He questioned why residents that had signed the agreement had not been paid $1.00
as indicated. Public Works D'uector Colbert stated that Mr. Elling bad been offered $1.06 in cash and had refused
to accept. Mr. Elling stated he felt the funds should be paid in the form of a check . Mayor Awada stated that a
check would be issued to Mr. Elling. Mr. Elling also requested the minutes from a July 31" neighborhood meeting
regarding the assessmenu for Project 749. Staff indicated they would mail a copy of the minutes to Mr. Elling. ` V

IN CONNECTION WITH EAGAN C1TY PROJECT NO. 749
This easement, made this day of , 2000, between EARL X.
ELLING and BETTY L. ELLING, husband and wife (herein retaned to as "Landowners"), and the
CITY OF EAGAN, a Minnesota municipal corporation (hereinafter referred to as the "City").
WITNESSETH:
That the Landowners, in consideration of the sum of One Dollar ($1.00) and other good and
valuable consideration, the receipt and sufficiency of which is hereby acknowledged, do hereby
grant and convey unto the City, its successors and assigns, a temporary construction easement for
site grading purposes over and across the northerly 10 feet of the following described premises,
situated within Dakota County, Minnesota, to-wit: ?
The East 103 feet of Lot Ten (10), Auditor's Subdivision No. 38, Egan, except the
South 28 feet fliereof, according to the plat thereof on file and of record in the office
of the Register of Deeds within and for said County and State.
This temporary construction easement expires August 30, 2001.
The grant of the foregoing temporary construction easement for site grading purposes
includes the right of the City, its contractors, agents and servants to enter upon the premises at all
reasonable times to construct, reconstruct and inspect site grad'mg and the further right to remove
trees, brush, undergrowth and other obstructions. After completion of such construction,
maintenance, repair or removal, fhe City shall resfore the premises to the condition in which it was
found prior to the commencement of such actions, save only for the necessary removal of trees,
brush, undergrowth and other obstructions.
The Landowners, their heirs and assigns, do covenant with the City, its successors and
assigns, that they are the owners of the premises aforesaid and have good right to grant and convey
the easement herein to the City.
