claim submitted by Mr.Pan Piekarski for past maintenance of the T.H. 55 frontage road.
Enclosed on pages 2;lthrough Z is a coy of correspondence from the Public Works
Director to Mr. Piekarski informing him of the Council's review of his Gaim and future
maintenance activities by the Public Works Department. The frontage road maintenance
and sealcoat are scheduled to be completed by August 15,1993. If any Council member

Thank You. Volunteers
At a recent work session, the City Council expressed their appreciation for the efforts all
our volunteers are making to their various commission activfties. First, the City Council
sends their appreciation to everyone and secondly, they are considering a form and
process in which the City's mission statement and goals can be preserited. Time is a
precious commodity and the CRy Council would like to further bridge their philosophy,
views, goals and mission statement with each of the advisory commissions through either
a meeting of the chairpersons from each commission with Mayor Egan or a larger forum
involving Ciry Councilmembers and all advisory commission members. Look for this to
happen in the early fall.
John Grfags Recognition
A special recognition to John Griggs, who receritly resigned from the Advisory Planning
Commission to accept a new posRion of employment in Winona.
Community Develonment Director Position
The hiring of the Community Development Director position is progressing along with the
assistance of an executive recruiter from the Brimeyer Group. The City Council advertised
nationally and received 80 applications which has now been narrowed to a final 17
candidates that are under consideration by the City Council. Further screening, first
round of interviews and finai interviews wili occur during the next 45 days with the finalist
named at that time.
Rightsizing Analysis
The City Council has undertaken a rightsizing analysis which is coordinated by the City
Administrator. During the past several months, each department has been asked to

At the March 2 Council meeting, Mr. Stan Piekazski of 3350 TH 55 approached the Gouncil
under the Visitors To Be Heazd agenda requesting Council action regarding the frontage
road servicing his property on the north side of TH SS at the intersection with TH 149.
The Council directed Mr. Piekarski to meet with the Director of Public Works to discuss
the issue which would then be presented to the City Council if appropriate. Subsequently,
Mr. Piekarski met with Public Works Director Colbert on Monday, March 15, at which time
the claim for frontage road maintenance enclosed on page was submitted. Enclosed
on page is a location map showing the relationship of Mr. Piekarski's property to the
frontage road in question. Enclosed on pages through ate copies of past
correspondence the Ciry has had directly with Mr. Piekarski or documenting meetings held
with him. This provides good background information for the Council to help them address
the claims submitted by Mr. Piekazski.
ACTION TO BE CONSIDERED ON THIS ITEM: To approve/deny the claim for T'H 55
north frontage road maintenance as submitted by Mr. Piekarski. Also, direct staff to either
1) perform routine maintenance or, 2) enter into a contractual relationship with Mr.
Piekarski for future public road maintenance.

Dear Mr. Piekarski:
on March 15, 1993, you submitted a claim for $5,000 representing 25
years of maintenance for the frontage road located in front of your
residence. This claim was presented to the City Council at its
meeting of April 5th and was subsequently denied as explained to
you at that meeting.
In regards to future maintenance obligations, the City Council
directed the City staff to add this frontage road to its regular
Citywide snow/ice control maintenance program. Due to the fact
that these routes are reviewed and updated annually as additional
miles are added, we cannot tell you where in the 10 to 12 hour
progression your particular frontage road will be plowed for any
significant snowfall event.
Also, as indicated to you in a letter dated February 2, 1993, the
City of Eagan will regrade this frontage road, install Class V
crushed rock and sealcoat the surface for stability during this
summer's maintenance program. All of this will be at no cost to
you and will be considered part of the City's maintenance program
for public streets.
As you are aware, the City has assumed this maintenance obligation
when the frontage road was turned back from the State of Minnesota.
Please be assured that we will attempt to provide you with the same
level of service as provided to all other citizens within our
community. However, recognizing the level of expectations you have

1. Project #182R was properly noticed, heard and approved by the City
Council. Project #182R xas heard on September 16, 1980, Oetober 21, 1980 and
November 18, 1980 and approved on November 18, 1980.
2. The contract for Pro,ject #182R, i.e., contraet 4k81-3 was properly
noticed, bid, and awarded by the City Couneil.
3. In 1976, Stanley Piekarski petitioned the Citq of Eagan to install
storm sewer improvements but most of the neighboring property owners ohjected
to the improvements, and they were not installed at that time.
4. In 1980 flooding of the area, ineluding the Piekarski property,
reoccurred and the City Council approved storm sewer improvements.
5. The Piekarskis installed a berm on their property at their own
expense, but the berm did not control flooding after heavy rainfall.
6. Constructlon of the improvements was completed in August of 1982.
7. A hearing on special assessments for the property was held on July
5, 1983 at which time the Piekarskis filed ob,jections to the propoaed
assessment, and the City Council levied the assessments.
8. The assessments vere scheduled for reconsideration on October 11,
1983, at which time the Piekarskis Nere present with their attorney, Joseph
Perry. The City Couneil heard testimony from witnesses for the City and for
Piekarskis. Cross-examination took place by each party and a record was kept
by a court reporter. The hearing was clossd and each party was given 15 days

to submit additional information to the Council, 20 days after the close of
the hearing to request by motion that further testimony or informtion be
submitted and 30 days from the close of the hearing for each party to submit
proposed Findings, Conclusions and Order.
9• The Stanley Piekarski property, Parcel No. 10-03800-080-02, located
in the North 1/2 of Section 12, Township 27, Range 23, Dakota County,
Minnesota, consisting of approximately 10.32 acres, has been benefited by the
storm sewer improvements installed pursuant to Project 4F182R by reason of
elimination of flooding problems, elimination of public nuisances, and
elimination of problems which would inhibit development of the property.
10. The proposed reassessment is based upon uniform rates established
in 1980 in aceordance with the City's Special Assessment Policy, i.e., at the
rate of $.034 per square Poot of single family residential property, and is
based upon 331,520 square feet after a credit oP 20$ Por estimated street
coverage resulting in an assessment of $11,272.00.
11. As a result of Project #182R the fair market value of the Piekarski
property was increased by $15,500.00.
CONCLUSIONS
1. The Piekarski property has been specially benefited by Project
4182R.
2. The proposed assessments are uniform across the same elass of
property.
3. The special benefit to the Piekarski property from Project #182R as
measured by the increase in market value, is $15,500.00 and exceeds the
proposed assessment.
4. The proposed assessment of $11;272.00 meets a11 criteria of special
assessment law and procedure under M.S.A. Chapter 429.

The City Council hereby approves and orders the levy of the assessment
against the Piekarski property in the amount of $11,272.00.
