(the "Assessment").

WHEREAS, the Landowner has requested that the City defer the Assessment until the
Property is sold, subdivided or developed; and
WHEREAS, the City is willing to defer collection of the Assessment upon the terms and
condiYions contained herein.
NOW, THEREFORE, in consideration of the mutual promises contained herein and other
good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged,
the Parties do hereby agree as follows:
DsFEttaED AsSESStvieN'r. The Parties agree the Assessment is hereby deferred
until the Property is sold, transferred, subdivided, platted, or otherwise developed,
whichever occurs first, at which time the Assessment shall be immediately due
and payable. The Assessment shall bear interest at the rate of four and one-half
percent (4S0%) pex annum as set forth in the assessment roll for the Project. The
Parties agree that, notwithstanding anything in this Agreement to the contrazy, the
Assessment and all intexest thereon must be paid in full no later than
December 31, 2035. In the event the Assessment has not been paid prior to
December 31, 2029, the Assessment shall be payable in annual installments
commencing .ianuary 1, 2030 and payable over the next five years.
2. Wncvea. The Landowner hereby accepts the Assessment and hereby waives the
right to object or appeal the Assessment pursuant to MIMV. STn'r. § 429.081 and
further waives notice of hearing on this Agreement.
BitvDING EFFeCT. This Agreement shall be binding upon and inure to the benefit

Commissioners were duly appointed by the Court and that all damages by agreement of the
garties have been paid by the City of Eagan; that the proceedings for the taking of certain rights
in said lands are now complete; and that said City now owns a perpetual right-of-way, drainage
and utility easements and temporary construction easements with the exclusive control of same.
The grant of the foregoing permanent easement for right-of-way purposes includes the right
of the City, its contractors, agents and servants to construct, reconstruct, inspect, repair and maintain
a roadway and erect and maintain signs in conjunction with the public's use of said roadway and
appurtenances and any signs erected in conjunction with the use of the roadway and appurtenances.
The grant of the foregoing permanent easement for drainage and utility purposes includes
the right of the City, its contractors, agents and servants to enter upon the premises at all
reasonable times to construct, reconstruct, inspect, repair and maintain pipes, conduits and
mains; and the further right to remove trees, brush, undergiowth and other obstructions. After
comple5on of such construction, maintenance, repair or removal, the City shall restore the
premises to the condition in which it was found prior to the commencement of such actions, save
only for the necessazy removal of trees, brush, undergrowth and other obstructions.
The grant of the foregaing temporaly construction easerrient ior site grading purposes
includes the right of the City, its contractors, agents and servants to enter upon the premises at all
reasonable times to construct, reconshuct and inspect site grading and the fiuther right to remove
trees, brush, undergrowth and other obshucfions. After completion of such construction,
maintenance, repair or removal, the City sha11 restore the premises to the condition in which it was
found prior to the commencement, of such actions, save only for the necessary removal of trees,
brush, undergrowth and other obstructions, subject only to permanent easement alterations.

Dear Mr. Parranto:
The first contact that was made with this office regarding a
plumbing problem in the residence of 3400 Hwy. 55 was
approximately Wednesday, November 2, 1988. The exact date is not
known. At that time, the tenant informed the Building
Inspections Division that there was a sewage back-up problem in
the house and wanted this department to assist them in getting
the problem corrected. The tenant stated he had been trying to
contact you for some time. He also stated he had talked with
someone from our office approximately a week earlier, although
our records do not confirm that.
During the next two days, our Plumbing Inapector made two
inspections at 3400 Awy. 55., noting that there was about 4" of
sewage on the lower level floor and that at some point, someone
had started to dig a hole in the yard.
On Monday, November 7, 1988, it was apparent that some work had
been done over the weekend. Our office did not inspect this
work. No further contact was ever made regarding this problem.

Dear Sir:
We recently completed extensive pipe replacement and
plumbing improvements at 3400 Highway 55. Your office
inspected the work while under construction and again at
completion. I have now been informed by former tenants of
the building that they claimed to have moved from that
building because I was negligent in making the repairs on
the plugged sewer.
My records show that we received a notice from the tenants
on a Wednesday, had a rooter service man on the project on
Thursday, were notified that the damage was more severe than
just being clogged by sanitary napkins and had an emergency
crew on the job on Saturday morning. I would appreciate it
if your office would give me your log on the times involved
in your inspections and notifications. If there is any
charge for this service please bill me at my office.

WHEREAS, the Landowner has requested that the City defer the Assessment until the
Property is sold, subdivided or developed; and
WHEREAS, the City is willing to defer collection of the Assessment upon the terms and
conditions eontained herein.
NOW, THEREFORE, in consideration of the mutual promises contained herein and other
good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged,
the Parties do hereby agree as follows:
DEFexReD AssessMENT. The Parties agree the Assessment is hereby deferred
until the Property is sold, transferred, subdivided, platted, or othenvise developed,
whichever occurs Ylrst, at which time the Assessment shall be immediately due
and payable. The Assessment shall bear interest at the rate of four and one-half
percent (4.50%) per annum as set forth in the assessment roll for the Project. The
Parties agree that, notwithstanding anything in this Agreement to the contrazy, the
Assessment and all interest thereon must be paid in full no later than

December 31, 2035. In che event the Assessment has not been paid prior to
December 31, 2029, the Assessment shall be payable in annual installments
commencing January 1, 2030 and payable over the next five years.
2. WnivEa. The Landowner hereby accepts the Assessment and hereby waives the
right to object or appeal the Assessment pursuant to M[NN. S rnT. § 429.081 and
further waives notice of heazing on this Agreement.
3. BItvDING EFt'ECT. This Agreement shall be bind' upon and inure to the benefit

Commissioners were duly appointed by the Court and that all damages by agreement of the
parties have been paid by the City of Eagan; that the proceedings for the taking of certain rights
in said lands are now complete; and that said City now owns a perpetual right-of-way, drainage
and utility easements and temporazy construction easements with the exclusive control of same.
The grant of the foregoing permanent easement for right-of-way purposes includes the right
of the City, its contractors, agents and servants to construct, reconstruct, inspect, repair and maintain
a roadway and erect and maintain signs ia conjunction with the public's use of said roadway and
appurtenances and any signs erected in conjunction with the use of the roadway and appurtenances.
The grant of the foregoing permanent easement for drainage and utility purposes includes
the right of the City, its contractors, agents and servants to enter upon the premises at all
reasonable times to construct, reconstruct, inspect, repair and maintain pipes, conduits and
mains; and the further right to remove trees, brush, undergrowth and other obstcuctions. After
completion of such construction, maintenance, repair or removal, the City shall restore the
premises to the condition in which it was found prior to the commencement of such actions, save
only for the necessary removal of trees, brush, undergrowth and other obstructions.
The granf of the foregoing temporaly construction easement Yor site grading putposes
includes the right of the City, its contractors, agents and servants to enter upon the premises at all
reasonable times to construct, reconskuct and inspect site grading and the further right to remove
trees, brush, undergrowth and other obsiructions. After completion of such construction,
maintenance, repair or removal, the City shall restore the premises to the condition in which it was
found priox to the commencement. of such actions, save only for the necessary removal of trees,

parties have been paid by the City of Eagan; that the proceedings for the taking of' certain rights
in said lands az•e now complete; and that said City now owns a peipetual right-of-way, drainage
and utility easements and tempotary constr¢ction easements with the exclusive control o#'same.
ihe grant of'the foregoing permanent easement for right-af-way piuposes includes the right
of the Ciry, its contractors, agents and seivants to constrvct, reconshuct, inspect, repair and maintain
a roaclway and ereci and maintain signs in coujunction with the public's use of' said roadway and
appuctenances and any signs erected in conjunction with the use of die roadrvay and appurtenances.
I'he grant of the foregoing permanent easement for drainage.and utility purposes includes
the right of the City, its contractors, agents and servants to enter upon the premises at all
reasonable times to construct, reconstruct, inspect, repair and maintain pipes, conduits and
mains; aiid the further right to remove trees, brush, undergrowth and other obstructions. After
completion of such construction, niaintenance, repair or removal, the City shall restore the
premises to the condition in which it was found prior to the commencement of such actions, save
only for the necessary removal of hees, brush, undergrowth and other obstructions.

This letter is in regard to our recent inspection of the T-Mobile Site at the City of Eagan's OLeary Park.
As requested by hoth the City and Vertical Limit, the contractor for T-Mobile, SEH conducted a final
inspection on Apri123, 2009, of the equipment installation. Below represents oar comments:
1. Of the 16 Spirea Fire Light plantings 7 are dead and should be replaced
2. Installed hazdwood mulch has been displaced and washed out within the plastic landscape border and
should be replaced/added to
3. As-built drawings should reflect the actual distance of the ground equipment to the center of the
monopole (the drawing AQ831-C2 indicates 30-0)
4. The ground wire at the monopole, as installed, creates a tripping hazazd and requires adjustment
5. Final as-built drawings should be provided by T-Mobile
T-Mobile and or their representative should contact the City upon completion of these items far final
acceptance. SEH will be providing the City with final closeout information along with as-built drawings
as provided by T-Mohile. If you have any questions regarding the above comments, or require further

Froperty Claim Solutions, A Local Roofing Company, has obtained a permit to re-roof
the property stated above. Upon Final Inspection, City Inspector Jeff Wheeler had failed
the job, due to the lack of Ventilation and Minimum Roof Pitch. We had explained to Jeff
the status of the home before we even started the work. Ventilation was not changed,
because there were no other options for the way the home was designed with the open
and tight vaults that were constructed to the Maximuxn space below Roof Plywood during
its original Construction Period. We were asked by Jeff, and have confirmed with Gerald
Vandam, the homeowner, that his home was built in the early 1970's and therefore his
ventilation issue is to be approved. We were also asked by Jeffto check the Roof Pitch of
the home. He felt that it was currently under a 2/12. Again, Mike Lyden, our Field
Supervisor, and Jesse Segura, our Roofing Sub-Contractor, had visited the property and
confirmed with a Roof Pitch Gauge that the Roof Pitch is actually a 3.5/12. So standard
installation of Ice and Water, Felt and Asphalt Shingles are approved to be installed on
those areas.

Warranty and we plan to stand behind this project like we have with every job we
completed in the past.

1. There is insufficient vertical sepazation from the bottom of the drain field to the high
water table or bedrock.
