As you can see from these photos, there are only a few commercial vehicles (dump trucks and backhoes)stored outside on the property. It does not appear that the proposed uses described in your letter dated August 21, 2007 are consistent with the prior use of the property. As you know, the property was rezoned to T, Transitional in October 2002, which established the permitted use as "the use and scope of use that existed on October 17, 2002." The 2005 and 2006 photos attached are consistent with our records documenting the use of the property in October 2002, Earlier this year the property was rezoned to R-3, Residential Townhouse, making the prior use non-conforming. While the non-conforming use may be reestablished on the property within one year, after one year any use will need to conform to the R-3 zoning. We have the following comments relative to the uses proposed by your client and how it relates to the permitted use of the property: ? The 6000 sq. ft. lease to the concrete contractor appears to be consistent with the prior use that existed in October 2002. 9 Outside storage and parking of approx. 100 vehicles on the existing asphalt area is not consistent with how the prior occupant used the property. Operating a repair business as a primary use - "to repair recreational vehicles and a fleet of 60 trucks of Master Mechanical, Inc." - is not consistent with the prior use of the property. On-site maintenance of the concrete contractor's trucks and equipment as an accessory use may be consistent, but a separate repair business as proposed is not. We are unclear as to what the contemplated rental activities are and how that relates to leasing of the other two buildings to Master Mechanical and Master RV & Truck. Please explain this further - What does Master RV & Truck do? Is Master Mechanical planning to use the building for storage of their own fleet of vehicles? Do they own a fleet of RV's and trucks that they lease to others? Do they lease building space for indoor storage of RV's, boats, etc? Please clarify this part of the proposed use. I understand you anticipated closing on Monday, August 27th, however, we are unable to provide a zoning compliance letter that indicates the proposed use is permitted. As we indicated over the telephone, I was going to try and review the situ- ation on location with you later in the week. Due to.previous commit- ments, I am not able to meet with you within that time frame. I wanted to assure you that I am fully aware of the problem that you are referring to and that we have looked at alternatives to temporarily solve the problem. Because this is a "dead-end pond" there is no where this water can drain to without the installation of a storm sewer system. It is my understanding that this existing problem repeats itself annually and after every heavy rain storm. I would strongly recommend that you and the property owner on the north side of Trunk Highway 55, collectively initiate a petition for the permanent installation of a storm sewer system. Once we receive this petition, we will initiate a study discussing the feasible permanent solution to this problem. We have investigated the possibility of pumping this water into the Burr Oak Pond area. This is not feasible due to the existing high water level on that lake which is presently creating similar problems as you are experiencing. The other alternative of pumping this water into a sanitary sewer system is not acceptable to the potential surcharge it could place on our sanitary lines and lift stations and due to present restrictions by the Metropolitan Waste Water Control Commission.
