Shutoff Valve Adjustment Claim For Damages
Dear Mr. Lamecker:
I am in receipt of your letter dated August 17 wherein you explain
the situation pertaining to the required adjustment of the water
shutoff valve for the above referenced property, and the result
in repair to the driveway that had to be performed. The City's
policy requires that all property owners are responsible to insure
that the water shutoff valve is adjusted to final surface elevation
and readily accessible by City personnel. Due to the fact that
this water shutoff valve was buried beneath the driveway, it is
the owner's responsibility to take whatever action is necessary
to adjust it to accessibility by City forces.
Had the property owners not requested the water to be shut off,
it would have still been required to adjust and expose this water
shutoff valve. However, in response to their request to have the
water turned off while the house was vacant, the City proceeded
to perform the work necessary to expose the valve to perform this
shut off and subsequently adjusted to grade. Any subsequent repair
to the driveway still remains the responsibility of the homeowner.
Therefore, the City is not liable for the approximate $100 repair
cost of the driveway.
I hope this explains the City policy and position in response to
your claim for reimbursement for the approximate $100 repair cost
of the driveway as requested in your letter.

Dear Mr. Colvert;
I am an agent with Edina Realty and have the home at 4287
Jasper Drive, Eagan listed for sale for the owners, Ron &
Cfieryl Sommerfelt.
Because of a job transfer, the Sommerfelt's had to vacate
their home at the beginning of June and they had requested the
city to sfiut off the water to the home. The Sommerfelts had no
idea where the water shut off valve was located and as it turned
out, the valve, which was locate in tfie driveway, had been
covered up by the previous owner when the driveway was repaved.
So the city crews began chopping up the driveway until tfiey lo-
cated the water valve and consequentplg ended up with a hole in
the driveway measuring 7 x 12 Ft.
I as agent for the sellers called the city of Eagan inquiring
as to who is liable for tfie repair of the driveway. I was told
at that time they did not know but they thought tfiat it would be
an owners expense.
After waiting for 2 months the owners decided to have the
driveway repaired because it did make it more diffiault to sell
the home with that kind of repair so evident to potential buyers.
Sust last week the Sommerfelts were back in Eagan and in
talking to people in the neighborhood they learned through a city
employee that the city would have fixed the driveway at their
convenience. They immediately contacted the city and were told
they need to speak with you but that you were out of town-for the
week. They had to leave to go hack to Missouri on friday and so
they had requested that I speak with you when you return. In
trying to contact you I was told to write a letter concerning
all the facts and forward that to you.

In conclusion, had the Sommerfelts known that shutting off the
water would involve chopping up any part of the driveway at all
they would not have had it shut off. Since the damage has 6een
done and nothing had been done about it for over 2 months, they
felt they had to fix the dxiveway in order to faciletate the sale
of their home. The Sommerfelts feel that they should have been
notified of the amount of damage that may be involved, prior to
actually doing such damage to shut off the water supply, and that
the city of Eagan should be liable for the $100 repair cost of
the driveway.
They would appreciate a response on thi,s ASAP, either
through me or you may contact them yourself at -
