I have enclosed a copy of a packet of information I received from Michelle
Newmann of 3861 Gibraltar Trail, Eagan. Ms. Neumann's question, "...If
a manufacturers installation instructions are m ore restrictive than
the Uniform Building Code which applies?"
The 1985 Uniform Building Code Section 3702 defines a"Fzietory-built
Fireplace" as follows"...A fireplace composed of iisted factory-built
components assembled in accordance with the terms of the Iisting to
form the completed fireplace." Ms. Newmanns concern is in regard to
the requirement for clearance from the outlet grille to a combustible
mantle. Page 11, Section H-3 "finish wall" of the installation manual
for the MBC36A Magestic Fireplace states (in bold), "Do not install
a combustible Mantle...less than 15 inches (MBC 36)...above the outlet
grille." The next sentence of Section H-3 refers to "local Building
Codes". 1985 UBC Section 3707 (h) applies to masonry firplaces only
and does not supercede manufacturers requirements. Therefore, the
15 inch clearance requirement governs.
As you are the Building Official having jurisdiction would you please
contact Ms. Neumann to resolve her concern.

This letter is in follow uo of the telephone conversation we had
on January 27, 1987, regarding my fireplace finish wall.
My question for you is if a manufacturers' instal].ation
instructions are more restrictive than the'Uniform Builcling Code
which applie5?
Enclosed are two photoqraphs of my fireplace, also the
correspondence between myself and Majestic, as well as the
installation manual (reference to situation is located on paqe
11 of this manual).
I appreciate your takinq the time to look over this matter and
will look forward to hearing your response and recommendations
regarding this problem. Z really feel like I ICP.Pp hitting a
brick wall resolving this prohlem. The cost of chaxiging my
fireplace to look attractive and safe is hundreds of dollars and
as a new homeowner (with a warranty still on my home), I don't
have the money to chanqe this, and I also feel it should be
under warranty. I also would appreciate a written
recommendation from the State as to their stand on this matter.
