*ntrodLCt+on:_ On Juiy 28, 1990 a portion of the easterly
part of Eagan, including Lexington $quare, experieaced en
intense thunderstorm. Obsexwers reported experiencing 4 to 5
inches of rain within a period of 1 to 3-1/2 hours. Two
homes located adjacent to the low point on Gibralter Trail
south of Savannah Road (3912 6 3916 Gibralter Trail)
experienced basement flooding.
The residente adjacent to the Gibralter low point have had
storm water drainage conCerns eince the "super stoxm" of July
27, 1987 when extensive flooding occurred. Since that
experience the city has conatructed edditional storm sewers
to improve the drainage from the low poiat. Since flooding
hae occurred again the residents are concerned that their
homes are still not grotected to an aoceptable level oE
safety. They view their property ee tlood prone and believe
their property values are siqnificar,tly irapacted. in view oE
this, it the purpose of this report to review the situation
and provide comment.
Storm intpnsit;: The rainfall amount and iater?sity used to
evaluate this storm event ie basad upon observatione by
zesidenta in Lexington Square and the nearby vicinity. A
storm o£ 4 to 5 inches within 1 to 1-1/2 hr. as reporied is a
hiqhly improbabie event that exceeds the severity of the
design storm end, as a xesult, the desiqn capaoity of the
storm water drainage eygtem. Statiatically the probability
af this storm o?as greater thaa a 500-year event (see attached
precipitatioa frequency curve).
Performanee 2.f Jb& drainace s_,vstem: Dusing the July 28,
1990 storm, the vtater elevation in the law point reached
890.2. This ie approximately S' above the low point ground
elevation and 2' above the loweet basement window. Witaessee
believe the law poirit rvsa quick2y drained after the storm
ended which indicates the pipe was free of blockages.
II.-ainaae gxstem ;a ; y• The foliowing information provides
a summary of the storm water drainage system characteristics
of the Gibralter low poiat storm water drainage syatem.
The current drainage system (after the improvemente of 1988)
is sized to haadle runolf from a 6 inch-24 hr rainfall (100
yr. event). Such a reinfail event has a 311/hour max3mum
peak intensity.
Estimatea of the peak runoff rate from a 100 yr. event range
from 90 to 110 cfs. The additional storm sewer improvementa
constxucted in 1988 added 38 c£s to the discharge capacity af
the low point. Thia represente a 34 ta 41 percent increase
in the capacfty over the oriqinal deaign and installation,
ro mtents: Following fs incidental informatioa that is
pertinent to this issue.
After the flooding of 19674 hydrologic / hyflraulic
evaluetiona Mera oonducted by city coneulLants and the
developer'e design enQineers. Their conclusions were
not aonsistent. The developer's engineera concluded
that the eystem, as designed and installed, provided
adequate protection from flooding. The City argued that
improvemente were necessary to offset the lack of
ponding, overland drainage and iow house elevations.
Consequently the city decided to install a storm aewer
pipe to provide additional diecharqe capacity from the
low point end iaitiated a 1aw suit agaiast the Lexingtoa
Square develoger to recover the coets for the
improvement. Litigation is pending.
mhe original drainaqe system did not incorporata
recommended storm Nater drainage practicea such ass
- propex siting of houses (some are too low),
- aite gradiag provisions for overland drainaqe routes
to safely convey exoess storm water runaff that can
not be convep¢d in the storm sewer pipe eystems, and
- lack of ponding to pravide storage aad reduce the peak
runoff.
Because the above problems were not discovered until
after the nrea was almost fully developed, the feasible
options for improvemente were limited. The best and
most feasible option gor improving the flooding eafety
factor was to install a pipe lrom the low point to
Lexinqton Avenue. Although this pipe eignlficantlp
improved the floodinQ safety factor it was in lieu of
the more prefetred preventive meaeures lieted in the
previous point. Furthermore the discharge capacity of
the pipe to Lexington Avenue is at or near the feasible
limlta cf pipe hydraulice and cost etfectiveneea.
The eancerne o4 the home ormers of 3912 and 3918
Gibralter aro not to be dimiaished or taken lightly.
However aoneideration must be given to the fact that
this aree hea experienced two highly improbable storm

F. Pmject 596, Woodlands North Addition (Streets & Utilities)--On August 7, a public
hearing was held to consider the installation of streets and utilities to service the proposed
Woodlands North Addition. At that time, the public hearing was continued until
September 4 due to ihe deve]oper's request to pursue a revision to the original approved
preliminary plat which was scheduled to be heard by the Planning Commission on August
28. The feasibility report was then to be revised to be consistent with the revised
preliurinary plat. However, the staff did not receive the detailed information associated
with this revision within an adequate time frame to allow the feasibility report to be
revised prior to the deadline for formally notifying all affected property owners of this new
public hearing. Subsequently, this public hearing should be continued unti] September 18.

Tntrodtction: On Juiy 28, 1990 a portion of the easterly
part of Eagan, including Lexiagton Bquare, expexienced an
intense thunderstorm. Obserwers reported experiencing 4 to 5
inchea of rain within a pericd of 1 to 3-1/2 hours. Two
homes located edjacent to the low point on Gibralter Trail
eouih of Savannah Road (3912 & 3916 Gibralter Trai3)
expezisnced basement flooding.
The residents adjacent to the Gibralter low point have had
storm water drainaqa concerns since the Nsuper storm^ of July
27, 1987 when extensive Elooding occurred, Since that
experience the city has conatructed additional ertorm sewers
to improve the drainage from the low goint. Sfnce flooding
has occurred again the residents are concerned that their
homes are still not protected to an acceptable level oE
safety. mhey view their property ae flocd prone and believe
their property velues are aignificantly impacted. In view o#
this, it the purpose of this report to review the situation
and provide comment.
Storm rntens±tys The rainfall amount and intensity used to
evaluate this storm event ie based upon observations by
xesidents in Lexington Square and the nearby vicinity. A
storm flf 4 to 5 iaches within 1 to 1-1/2 hr. as reported 3s a
highly imgrobable event that exceeds the severity of the
design etorm and, as a resultr the deeign capacity of the
atorm water drainage eyaLem. Stati.stically the probability
of this storm was greater than a 500-year event (see attaohed
precipStatioa frequeney curve).

1990 etorm, the water elevation in the low oint reached
890.2. Thie is approxiamately 5' above the p lorv point qround
elevation and 2' above the loweet basement window, witneeaee
believe the low point wna quickly dreined after the storm
ended which indicaC.ea the pige was free of biockages.
Drainaae sys mcs8acityi The followinq i.nformation provides
a 6ummary af the storm water drainage system characteristics
of the G3.bralter low point storm water drainage system.
The current drainage system (after the improvemente of 1988)
is sized to handle runoft from a 6 inch-24 hr rainfall {100
yr. event). 6uch a rainfall event has a 311/hour maximum
peak intensity.
Estimates of the peak runoff rate from a 100 yr. event range
from 40 to 110 cfs. The additicnal storm sewer improvements
constructed in 1968 added 38 cfe to the diseharge tapacity of
the low point. This represenLe a 34 to 41 percent inerease
in the capacity over the original deeign and installation.

pertinent to thie issue.
+ After the flaoding of 1987, hydroloqic / hydraulic
evaluations xere aonducted by city consultants and the
developer'e de5ign enqineers. Their canclusiona were
not coae3stent. The developer's enqiaeera concluded
that the system, ae designed and iastalled, pzovided
adequate protection from flooding. The City argued that
improvementa were necessary to offset the lack of
ponding, overland drainage and low house elevations.
Consequently the city decided to inatall a storm eewer
pipe to provide additional discharge capacity from the
low point and iaitiated a lew euft against the Lexington
Square developer to recover the costs for the
impravement. Litiqation ie pending.
* The oriqinal drainage eystem did not incorporate
recommended etorm water drainage practices such ess
- proper eiting of houaes (some are too low),
- site gradSag provisions for overland drainage routes
to safely convey excess storm aater runoff that can
not be convepEd in the etozm sewer pipe syetems, and
- lack of ponding to provide etoxage and reduce the peak
rnnoff.
Because the above problems were not discovared until
a#ter the nrea was almost fully developed, the feasible
optiona for improvementa were limited. The best and
most feasfble optioa for improving the flooding saEety
factor was to install a pipe from the low point to
Lexington Avenue. Although this pipe aiqnificantly •
improved the flooding saPety factor it was in lieu of
the more preferred preveative measuzea listed ia the
previoue point. Furthermore the discharge capacity of
the pipe to Lexingtoa Avenue ia et or near the feasible
limits of gipe hydraulics and cosi eElectiveneas.
* The concerne of the home ovmere o£ 3912 and 3918
Gibralter are not to be diminished or taken lightly.
However Coneideration must be given to the fact that
this nrea has exparienced two highly improbable etorm
eventa that have significantiy exceeded tha design
storms. It is normal in these matters to hear comments
that design atandards ehould be increaeed. Hawever
providing protection eqainat a qivea event (euch ea tha
Woret storm on record) does not quarantea that n greater
runoff event wili not oacur durinq the useful life of
the property, Notwithetanding this, we will reopen the
project file oa this matter and conduct addStional study
to determine the Peasibility of sdditional improvements
if you so direot.

Per your request, the following information is provided relative to additional
storm sewer installation in the Gibraltar Trail area of Blocks 5 and 7 of the
Lexington Square Addition.
On Sune 7, 1988, the Eagan City Council awarded City Contract 88-16 (Lexington
Square and Lexington Avenue - Storm Sewer Improvements) to Glendale Contracting,
Inc. The Contract included but was not limited to providing additional storm
sewer capacity in the vicinity of Gibraltar Trail adjacent to Lots S and 7 of
Lexington Square Addition. The additional storm sewer capacity is noted as
CBMH112, CS113, and CB114 on the attached sketch.
In addition to the installation of the aforementioned catch basins, an additional
storm sewer line was run between Lots 6 and 7, and 18 and 19 of Block 5,
Lexington Square Addition, westerly to Princeton Trail. At the easterly right-
of-way line of Princeton Trail, the storm sewer was installed northerly along the
West property lines of Lots 5 and 6 of Block 5 to a point which is noted on the
attached plan as MH-109. From MH-109, the storm sewer continued westerly to the
West side of Lexington Avenue to a point noted as MH-105 on the attached plan.
From this point, the storm sewer was constructed southerly and westerly into Pond
JP-9 located in Patrick Eagan Park. Also attached please find a copy of the
general location plan showing the storm sewer improvements as constructed under
City Contract 88-16.

We represent John and Carla Screeden. Our clients are home
owners who reside in the Lexington Square Addition at 3918
Gibralter Trail in Eagan. I am writing to you in your capacity as
the attorney representing Meritor Development Corporation in
connection with litigation with the City of Eagan.
There was extensive flooding to our clients' home on July 23,
1987. The home experienced flooding again on July 28, 1990.
During the 1987 flooding, the water levels reached six to seven
feet in the home's lower level. This resulted in the near collapse
of one basement wall, the loss of two automobiles, the destruction
of their personal property and other extensive water damage to the
home. The basement wall was replaced. Only the loss of the
automobiles was covered by insurance. In July of 1990, our
clients' Zot floode3, with approximately five to six inches of
water entering the lower level of the house, causing water damage
to the home and various items of personal property.
I have reviewed various engineering reports and other analysis
of the flooding problem in the area of Gibralter Trail south of
Savannah Road. I have also reviewed the court file relating to the
litigation commenced by the City of Eagan against Meritor, Suburban
Engineering, et al. It seems to be abundantly clear that the storm
water drainage system servicing our client's property was
negligently designed and installed. Your client, as the developer,
bears primary responsibility for this situation.
In addition to the substantial out-of-pocket expenses incurred
by our clients, this reoccurring flooding has caused an
extraordinary decrease in the value of our clients' home, and for
all practical purposes has made it unmarketable at this time.

We request that our clients' claim be considered in the
context of any settlement discussions that may take place between
Meritor, and the other defendants in the ongoing litigation, and
the City of Eagan. If the parties are unwilling to include us in
any such discussion, we will have no alternative but to initiate
iegal proceedings against Meritor and the other appropriate
parties.

At the September 7, public works committee meeting we were
instructed to conduct an engineering evaluation of the
drainage situation at the Gibralter low point. Since then we
have studied the scope of work and developed a project
approach. The followinq summarizes our project plan.
> Check and review the drainaqe boundaries that directly
contribute to the runoff to the low point.
> Develop a hydrologic / hydraulic model of the system.
> Study the engineering alternatives to reducing the risk
of flooding.
> Prepare a written report for the committee to review.
We are in the process of collecting the raw data needed to
perform the work. Since the new topo maps of this area will
be available in the next two to three weeks we suggest that
we wait for this information before significant work on the
study begins. The new topo maps will allow us to better
evaluate the engineering alternatives as well as confirm the
information currently in our files.
In the mean time we will compile the other available
information so we are ready to begin promptly upon receivinq
the new topo mapa. Some of the information needed is in city
files. Therefore we request copies of the following.

Dear Mr. Hedges:
We are writing to you in regard to the flooding of our
property which took place as a result of the rainstorm of
July 28, 1990. Our property was inundated with water, for
the second time in three years, as a result of this event.
As a matter of background, we purchased our home in April of
1986. In July of 1987, our home was extensively damaged by
flooding caused by storm sewer backup which resulted from
heavy rainfall. We incurred substantial damage to the
foundation, as well as interior damage on three of four
levels. Both of our cars were totally destroyed while parked
in our garage. Since none of the damage to the house or its
contents was covered by insuranee, we incurred thousands of
dollars of expense in rebuilding and re-furnishing our home.
Investigation of the cause of the 1887 flooding revealed that
there were serious inadequacies in the storm sewer system in
our neighborhood, both as respect to inadequate pipe
capacity, and lack of overland drainage routes due to
improper site planning and grading. Bonestroo, Rosene,
Anderlik and Associates conPirmed these inadequacies, and
also determined that several homes, ours included, were set
too low relative to the grading plan. Since the development
was essentially complete, the only feasible option was the
upgrade of additional storm sewer pipe, which was done in
1988, at the direction oP the city.
The rainstorm of July 28 of this year again overtaxed the
drainage system to the point that rainwater was in excess of
five feet deep in the street in front of our home. This
precluded proper drainage of our lot, and once again our home
was flooded. Witnesses have told us that, had this rain
continued even another ten to fifteen minutes, we would more
than likely have suffered damage of the same magnitude as
occurred in 1987. We have provided a series oP photographs
to Mike Foertsch which illustrate that this recent flooding
approached the same levels as the 1987 event.

Request For Analysis of City Storm Sewer System

Dear Mr. & Mrs. Screedan:
The City has completed its analysis/review of the storm sewer
system which serves the low point of the 3900 block of Gibraltar
Trail. The first thing that was verified with respect to your
reported flooding problems was that City Maintenance personnel
performed an inspection of the storm sewer system and found it free
of debris and blockages.
The rainfall amount and intensity used to evaluate the storm event
was based on the best available information from the residents in
Lexington Square and nearby neighborhoods. Residents of the area
reported 411-5" of rainfall within a period of 1-1k hours. A
rainfall event of 4"-5" in 1-15 hours as reported is highly
improbable and greatly exceeds the intensity of the storm used in
storm sewer system design. The system is designed to function
properly when a rainfall event reaches a maximum peak intensity of
3" per hour or less, with a total rainfall not to exceed 6" in a
24-hour period. This rainfall intensity design standard provides
an "acceptarle" factor of safety throughout the Twin Cities
metropolitan area. Attached for your information I have included
the report on the storm water system analysis prepared by the
City's consulting engineering firm of Bonestroo, Rosene, Anderlik
& Associates, Inc.

You have reported water levels such that approximately 2" of storm
water covered your garage floor and that storm water entered the
lower levels of your home. You also asked what liability the City
has in this type of situation. The liability question is one which
is beyond the scope of the engineering details involved in the
analysis of the storm water system.

the City Administrator's office, the City Council, and the City
Attorney's office.
