Bill Huttner of William Huttner Construction, Inc., is constructing a home
on the above referenced lot for the Parade of Homes. In order to meet his
construction time table, it is important that he be able to commence con-
struction immediately.
Tri-Land Partnership of Eagan received final plat approval of Lexington Pointe
Second Addition on Sune 7, 1988. I contacted Norwest Bank and requested they
sign the dedication sheet so that we could record the plat. Norwest informed
me that we must close on our development loan prior to them signing the
dedication sheet. This closing was scheduled for last week and was delayed
until Tuesday of this week. This morning we were notified that this closing will
again be delayed until Wednesday or Thursday of this week.
We would like to assist Mr. Huttner in meeting his construction time table by
requesting that the City Council grant a model home permit for Lotl, Block 2,
Lexington Pointe 5econd Addition, to William Huttner Construction, Inc.

This letter is regarding out concern for the long term effects of the uncom-
pacted trench backfill adjacent to the existing home on Lot 1 of Slock 2 of ,
Lexington Pointe 2nd Addition. ?
The house in question was constzucted prior to the installation of the
adjacent storm sewer. This vas apparently a planning oversight. The pipe
design location put the house footing within the zone of influence of the
trench.
Observation of the construction causes us two concerns. One is that the
excavation adjacent to the house exposed the footing blocks and proceeded
nearly verticle to the bottom of the excavation. This may have introduced the
potential for loss of density of the soil that supports the footing which in
turn could allow for future settlement of the structure. Second, the trench
backfill was noi compacted. We assume this is to avoid damage to the house
due to the impact of the compaction equipment. This leaves a minor long term
liability concerning settlement of the yard area but of more concern is the
question of whether the relatively unconsolidated sails of the trench back
fill vill a11ow lateral movement of the footing support soil over time and
therefore add to the potential for settlement of the soil supporting the
footing.

Our concerns are relative to the long time liability that could fall on the
City if this project were accepted especially with its knowledge of this
situation. It is not appropriate that the City have this potential liability
put upon it. Therefore ve will not recommend the project for acceptance until
this matter is addressed to the City's satisfaction.
We have two thoughts on courses of action that you may wish to investigate and
present to the City for consideration. One thought is to soil grout the soil
beneath the footing and in the zone of influence of the trench. The other
option may be to put up a letter of credit, bond or escrow-satisfactory to the
city attorney-to cover the potential damages for a specific period of time
(recommend no less than 10 years). Your other option could be to dispute our
opinion. For this to he successful I recommend that a registered engineer
experienced in soils and footing design should address the issue and certify
to the City that the installation is acceptable.
