On August 31, 1995, the Minnesota Pollution Control Agency (MPCA) notified the Dakota County
Environmental Management Department (Department) staff of a complaint that lead-acid batteries and
casings were discovered on your property during repair of the Individual Sewage Treatment System
(ISTS). On September 18, 1995, Mr. Stephen Scott of this Department conducted an inspection of your
residence located at 2981 Lexington Avenue South in Eagan. Mr. Scott observed lead-acid battery casing
entrained in the disrupted soils in the viciniry of the septic tank and drainfield. As part of his inspection,
Mr. Scott collected sampies of soil and exposed battery casings for chemical analysis. During an
interview with you at that time, you disclosed that you are connected to the City's water supply but not the
municipal sewer system and that you continue to use the on-site ISTS. Mr. Scott forwarded his findings to
Department supervisors and to me.
Our review of the issues related to your property has focused on the following areas: immediate health
and safety issues; use of the existing septic system; and, what must or should be done regarding the lead
-acid battery casings. We looked at this last issue in terms of both public health and safety as well as the
environmental impacts.
Health and Safety Issues
Testing of exposed lead-acid battery casings and soils at your address indicated concentrations of lead
that exceed the lead level standard of 100 parts per million (ppm) for bare soils in Minnesota Department
of Health (MDH) Rules 4761.0300. In accordance with established procedures, composite samples were
taken from the top two centimeters of the disturbed soils. These samples were analyzed for total lead and
showed 1600 ppm and 330 ppm. The soil samples were also analyzed using the Toxic Characteristic
Leachate Procedure (TCLP) that identified concentrations of 4.2 milligrams per liter (mglL) and 2.0 mg/L.
Each of these levels is below the hazardous waste Ievei for lead, which is 5.0 mglL. Surface scrapings of
the battery casings exceeded 200,000 ppm for total lead.
MDH Rules, Chapter 4761, requires that abatement actions be taken to reduce the human exposure to
identified lead sources at a residence of a pregnant woman or of a child whose blood lead level is equal to
or greater than ten micrograms of lead per deciliter of whole blood. We have not received information that
leads us to believe this requirement applies except that your grandson does visit you on occasion. His
blood lead level was tested and found not to exceed this level. Technically, therefore, the MDH Rule
requiring lead source abatement does not appear to apply to your situation.
Although these Rules may not apply, we believe that the continued presence of the lead contaminated
soils and battery casings at the soil surface represent a possible risk to you, your neighbors and future
residents of the property. Thus, we recommend that you remove or, at a minimum, cover the lead-

regarding abatement activities).
The section below on the Management of Lead Acid Batteries, Casings and Lead Contaminated Soil
furtheraddressestheseissues.
Continued Use of Your Sewage System .
Our records indicate that this septic system was excavated in August 1995, to compiete repairs, at which
time lead-acid batteries and battery casings were identified around the septic tank and drainfield.
According to a neighbor, the drainfield had been repaired in the early 1980s. Battery chips do not meet
the definition of "drainfield rock" in Minnesota State Rules 7080, which set minimum standards for ISTS on
a State-wide basis. Even though the use of battery casings makes your system a nonconforming system,
that in itself does not mean that it is a failing system. At this time there is no State or County requirement
to upgrade a nonconforming system.
Minnesota Rules Chapter 7080 defines a failing system as the following.
Any system that discharges sewage to a seepage pit cesspool, drywell, or leaching pit and any
sysfem with less than 3 feet of soil or sand behveen the bottom of the distnbudon medium and the
saturated soil level or bedrock. In addrtion, any system posing an imminent threat to public health or
safety shall be considered failing".
Minnesota Rules Chapter 7080 Rules define Imminent Threat to Public Health or Safety as the following.
AIl situations that are a pofential to immediately and adversely impacf or threaten public healYh or
safety. At a minimum, ground surface or surface water discharges and any system causing sewage
backup into a dwelling or other establishment shall constitute an imminent threaP'.
A failing sewage system must eventually be upgraded, either at the time of a bedroom addition, or
possibly at the time of property transaction, or by a time set by the municipaliry. Recent amendments to
Dakota County Ordinance No. 113, On-Site Sewage Systems, include additional upgrade requirements at
the time of properry transaction. A system posing an imminent threat to public health or safery must be
upgraded within ten months of the time it is determined to be failing.
If the ISTS system on your property demonstrates any of the above characteristics, it would be considered
failing. All Dakota County municipalities administer their own sewage system permitting and inspection
programs. You may wish to contact Dirk House or Bill Adams with the City of Eagan at 681-4675 since the
City of Eagan may have additional requirements.
Although your sewage system does not appear to be failing, it is clear that the lead contaminated soils and
battery casings are in constant contact with water owing to their presence in the ISTS drainfield. Thus, we
recommend that you discontinue the use of the ISTS system and connect to the municipal sewer system.
Management of Lead-ACid Batteries, Casings and Lead ConWminated Soiis
Battery casing chips have been analyzed by our Department at other locations and have been shown to
contain significant amounts of lead. In addition to battery casing chips, we observed small pieces of lead
plates, wires, and screen intermixed with the chips on your property.
MDH Rules Chapter 4761 state that lead-contaminated soils may not remain on-site if the Commissioner
of the Minnesota Pollution Control Agency (MPCA) determines that burial of the soils on the premises
would threaten the ground water or cause other environmental damage. if this determination is made, the
lead contaminated soils and casings must be excavated and removed from the premises for management
in accordance with MPCA requirements.
In other, similar situations, battery chips mixed with soils have been considered `contaminated media' by
the EPA and MPCA. Removal of the lead-containing chips from the surrounding soils may require that the
chips and associated contaminated soiis be sent off-site as hazardous waste unless the lead-

contaminated material is treated on-site to render it non-hazardous. If rendered non-hazardous through
on-site treatment, the material may be managed at local sanitary or industrial waste landfills.
The MPCA Voluntary Investigation and Cleanup Program (VIC) has adopted soil cieanup standards of 400
ppm for Iead for IndusVial sites where limited human exposure is anticipated. By following guidelines
established by the MPCA's VIC progrem, the owner of the property (or the party doing the cleanup) may
receive a letter from the MPCA certifying the cleanup has met MPCA standards.
In the event the MPCA does not require you to remove the lead-contaminated soils and battery casings
and you choose not to do so, MDH Rules, Chapter 4761.0300 Subp. 10.,outlines options for covering
lead-contaminated soils in place. These options consist ofi
A. Promotion of a living ground cover;
B. Construction of an impervious cover, such as concrete or asphalt; or
C. Application of other cover material such as sand, wood chips, etc.
In summary, although we have no specific requirements that you must meet, we do have the following
recommendations:
1. We recommend that you remove or, at a minimum, cover lead-contaminated soiis and any
exposed battery casings on your property even if you are not required to do so. If you choose to
remove them, you may want to enter the MPCA's VIC program;
2. We recommend that you discontinue use of the existing ISTS system and connect to the
municipal system;
3. We recommend that you contact the City of Eagan regarding any requirements it might have for
ISTS systems and connection to the municipal system;
4. We recommend that you contact the MPCA as to whether or not the Agency would require the
removal or clean up of the lead-contaminated soils and battery casings on your property.

Recommendations For Soil Abatement Activities
1. Exposed lead and lead-contaminated materials, including terminal posts, partial lead plates and lead-
acid battery casings, along with lead-contaminated soils should be removed or covered. Precautions
should be taken by the person(s) performing the abatement to prevent lead exposure to self or others and
should comply with items A through E.
A. Protective clothing and respiratory protection should be worn during abatement activities. At a
minimum, a disposabie dust mask, shoe covers and gioves should be wom to minimize contact or
inhalation of lead-contaminated soils. These items should be properly discarded after completion
of each day of soii abatement activities. Work clothes should be laundered separately from other
clothing.
B. Children and other susceptible persons should be prohibited from playing or otherwise coming
into contact with the soil being disrupted during abatement.
C. Precautions should be taken to prevent the wind dispersal of lead-contaminated soils from the
site. Abatement activities should not occur on windy days and dust suppression techniques
should be adopted where practicable.
D. Lead-contaminated soils or materials that are removed must be properiy stored or disposed of
at the end of each work day.
E. Efforts shouid be made to prevent soils from being Vacked, or otherwise dispersed, from the
area of contamination during abatement. Soils tracked onto steps and walkways should be
removed and steps, walkway and foundations should be hosed off with water at the end of each
work day and before applying new cover materials or soils.
2. The area of suspected lead-contaminated soiis and exposed lead should be covered with at least
six inches of topsoil or other appropriate cover materials. The placement of a water-permeable geotextile
fabric barrier or other type of barrier over the lead-contaminated soils and exposed lead would provide
protection against recontamination of the surface soils by the contaminated soil and exposed lead. The
area should be seeded or covered with sod, bark or mulch to prevent erosion.
3. The area of lead-contaminated soils should not be disturbed or used for any purpose which may
result in disturbance of the soil cover or vegetative layer. The Department recommends that the area
never be used for the production of food crops.
4. The exact location and extent of the lead-contaminated soils and ISTS must be determined and
this information filed with the County Recorder, in order to inform future buyers, or other interested parties,
of the presence of the lead-contaminated materials and the land-use restrictions appiied to the site.

SUBJECT: BATTERY CASINGS IN I.S.T.S.
7on, attached you will find a letter from Barry Schade, Dakota County Director of Environmental
Management. Barry has had a number of contacts with Gail McMahon regarding excavation of
battery casings on her property at 1429 Lone Oak Road.
As you can see by Barry's letter, the County has idenrified ten sites in Eagan that used battery
casings in the construction of individual sewage treatxnent systems (I.S.T.S.). It appeazs that four
of ten sites are still pending, or casings remain on-site. Based on this information, I believe we
should place a waming flag on lots containing battery casings that haven't been mitigated, as well
as place a copy of Batry's letter in the relevant pazcel files. A wamiug flag on the PIMS system
would allow us to inform individuals requesting permits of this issue.
Barry has indicated that sites containing battery casings usually don't need to be mitigated until
they aze disturbed. Once they aze discovered, it is Dakota County's policy to require the property
owner to record this information with the property data base at Dakota County.
If you need additional information or if you feel our plan of action needs to be modified, please
advise.

Enciosed are the analytical reports for the samples of water, house dust, and
soils collected from your residence on January 9, 2004. The results indicate that
the interior dusts and the well water supply are free of lead contamination. The
soils collected from the soillbattery casing stockpile in your backyard contained
significant levels of lead.
This suggests that lead from the soiUbattery casing stockpile has not been
transported into your house and has not impacted the well water supply.
However, the lead in the soil/battery casing stockpile represents risk to human
health and measures should be taken to reduce the potential for exposure to this
lead source. While the plastic cover placed over the stodcpile has served to
reduce the potential for direct contact with the lead, bare soils contaminated with
lead are accessible to direct contact or through wind dispersal. We recommend
placing additional plastic sheeting on the stockpile to further reduce the exposure
to the lead contaminated waste and soils. We also recommend that you limit the
use of the backdoor and install additional fencing around the stockpile to prevent
inadvertent contact with the stockpile.
Also enclosed is the list you requested of other situations the County has
encountered where battery casings have been used in the construction of ISTS's
(individual sewage treatment systems).
