parties have been paid by the City of Eagan; that the proceedings for the taking of certain rights
in said lands aze now complete; and that said City now owns a perpetual right-of-way, drainage

The grant of the foregoing easement for nght-of-way purposes includes the right of the City,
its contractors, agents and servants to construct, reconstruct, inspect, repair and maintain a roadway
and erect and maintain signs in conjuncrion with the public's use of said roadway and appurtenances
and any signs erected in conjunction with the use of the roadway and appurtenances.
The grant of tYte foregoing easement f'or drainage and utility pruposes includes the right
of the City, its contractors, agents and servants to enter upon the premises at all reasonable times
to conshvct, reconstruct, inspect, repair and maintain pipes, conduits and mains; and the further
right to remove trees, brush, undergrowth and other obstructions. After completion of such
construction, maintenance, repair or removal, the City shall restore the premises to the condition
in which it was found prior to the commencement of such actions, save only for the necessary
removal of trees, brush, undergrowth and other obstructions.
Said lands aze situated in Dakota County, Minnesota, and aze described in particularity on
Exhibit A, attached and incorporated by reference.
And notice is hereby given that the above-capUOned condemnation proceeding has been
completed; that payment far the taking of lands above described has been made and that the
Partial Final Certificate was executed and approved on the dates shown and endorsed herein.

APPLICATION SUMMARY: An application has been submitted requesting a Special Use
Permit renewal to allow for the continued use of 3.5 acres of undeveloped industrial land
for a concrete recycling, processing, and stockpiling facility located west of Highway 149,
south of Yankee Doodle Road in the NW '/. of Section 13.
COMMENTS: The applicant initially received City Council approval for this use on July 18,
1989, subject to annual review, as well as other conditions which have been met. The
applicant's permit was renewed by the Council on July 10, 1990. Staff is not aware of any
complaints regarding this operation in the past two years.
The operation involves importing rubble concrete. When the concrete has accumulated to
20,000 cubic yards, a crushing plant is brought to the site to reduce the rubble to reusable
class 5 aggregate. The operation utilizes approximately one acre of the 3.5-acre site owned
by Gopher Smelting.
If renewed, this Special Use Permit shall be subject to the following conditions:
1. Dust control procedures shall be utilized.
2. Hours of operation shall be limited to 7:00 AM to 7:00 PM, Monday through Saturday.
3. The operation shall be subject to an annual review. If renewal is denied, the applicant
will be provided with a six-month notice for termination.

TO: THE HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL OF
THE CITY OF EAGAN AND THE EAGAN CITY CLERK.
Notice is hereby given that the undersigned, as fee owners of the real property located at
3070 South Lexington Avenue, Eagan, MN 55121, Pazcel Identification No.10-O1100-010-26,
object to the proposed special assessment of their property for alleged improvements to
Lexington Avenue resulting from Project 771 upon the following grounds:
The subject pazcel has not derived any special benefit fi-om the alleged
improvements. To the contrary, the property has been substantially damaged and diminished in
market value as a result of the so-called improvements.
2. The City has failed to obtain any before and after mazket value appraisal to
sustain any assessment against the subject property.
3. The proposed criteria and method used to determine the assessments upon the
subject property aze not proper for the imposition of a special assessment, are not in accord with
the constitutional, statutory or municipal assessment policy requirements, and aze, therefore,
arbitrary and capricious, and thus, deprive the undersigned of property without due process of
law, contrary to the requirements of the United States Constitution.
4. The proposed assessment includes costs and contingency factors not authorized
under Chapter 429 and is therefore, void.
5. The proposed assessment is contrary to and violates Minnesota Statutes, Chapter
429.
The proposed assessment is arbitrary, capricious, confiscatory and unreasonable.
7. The proposed assessment does not result in any benefit, special or otherwise, to
the subject property.
8. The subject property is not specifically benefited by the improvements.
9. The subject property has not and will not increase in mazket value as a result of
the improvements.
10. The levying of said assessment constitutes an unconstitutional taking of the
undersigned's property.
11. The public hearing in said assessment was not proper notice in conformity with
Minnesota Statutes 429.061 and 429.081.
12. The subject pazcel has been unfairly and unequally assessed in comparison to
other sitnilazly situated properties in violation of state and federal law.
13. The City has failed to assess every assessable lot, piece or parcel of land as
required Minnesota Statues § 429.061.
