At your request, I met with the proposed purchasers at 11:15 a.m. on Friday,
November 19, 1982. The proposed use of that parcel is intended to be sleeping
quarters for three over-the-road truckere and the parking of their tractors
while the trailers are being loaded at the Bulk Mail Plant. They would arrive
around 8:00 a.m. and they would leave at about 6:55 p.m. They naw base at the
Bunker Hill Apartment complex. They are well aware that there is a possibility
that a Conditional Use Permit must be obtained. They verbally agreed to apply
for the permit after January 1, 1983 if Staff finds it necessary.

As you might have read, the City of Eagan is a rapidly growing city that has.
28,000 citizens and they are demanding that zoning ordinances and controls be
enforced.
We did notify you on August 9 that this parcel was in an agricultural zone,
but is considered residential as it is less than a five acre piece of Iand.
Excessive parking of commercial vehicles is not allowed in such a zoning dis-
trict and if you will not control the use, the City will have to take correc-
tive measures.

The property is owned by Mr. Don Michalety dba/Michalety Trucking Company, 100
Park Drive, Rural Route 1, Owatonna, MN 55060. At.City Planner Runkle's request
I met with Mr. & Mrs. Michalety in November of 1982 and they were intending to
purchase the property and use it for sleeping quarters for their drivers while
the trailers were being loaded at the Bulk Mail P1ant. At that time they were
using the Bunker Hills Apartment complex for that purpose. Dale Runkle and I
both explained City policies which included the possibility of a Conditional
Use Permit.
About August 1, 1983 it was found that there was some earth moving. The regrading
did not need a permit per City Code 4.30, Subdivision B, Paragraph 5, which allows
grading, excavating or fi11s of up to 10,000 square.feet and 5 feet deep. The
grading was apparently to provide concealed parking for the truck tractors. A
letter was sent to the property owner on August 6, 1983 for an explanation, but
as of this date we have not received an answer. Our intentions are to pursue this
further as time permits unless otherwise instructed.

Dear Mr. Ketcham:
Councilman Wachter forwarded your questions on the referenced parcel to me.
The property was purchased from the Hoovestols by a Mr. & Mrs. Don Michalety
dba/Michaelty Trucking Company, 100 Park Drive, Rural Route 1, Owatonna, MN
55060. They purchased the property in order to provide their drivers a
sleeping area while their trailers were being loaded at the bulk mail facility.
The grading, which met the no permit requirements of City Code 4.30, Subdivision
B, Paragraph 5-"Excavating and Eills", was apparently to provide partial
concealed parking for the truck tractors as they lay over. The Michaletys have
been warned that the area could not become a truck terminal as defined in the
City Code, but limited truck parking is allowed in areas zoned Agricultural.
I will monitor the site closely in order to maintain City Codes. Thank you

adoption of these assessments by the City Council. Payment can be made at the Eagan Municipal Center. If you
pay after the thirty (30) day period, interest will be charged from the signing date to December 3151 of the current
year.
The undersigned, for themselves, their heirs, executors, administrators, successors and assigns, hereby consent to
the assessment of these improvements and further, hereby waive notice of any and all hearings necessary, and
waive objections to any technical defects in any proceedings related to these assessments, and further waive the
right to object to or appeal &om these assessments made pursuant to this agreement.
