paper to the Eaqan Chronicle.
I received the latest issue dated Feb.l
on 6iednsday Febuary 9rd. This issue ad-
vised me that a council meeting was being
held on Tuesday, February 3rd.
The micruets as published did not pertatn
to my involvement; however, I wonder if
I may be forced to misa a notice of an
agenda item that would involve me.

A building permit application has been submitted on my behalf to the Ciry to add an
addition and renovate an existing home into a limited business. The rezoning
process has already been approved and the structural plans are now in the process
of evaluation.
It was brought to my attention that a 6" difference in rise between two areas of one
leasable office is not to code. Based on existing conditions and the expense
required to make the two areas match in elevation, the 6" difference is to be left as
is shown on the plans.
I am not installing a ramp at this time with the assurance given to the city that if, at
any future time, any complaints are received by either the City of Eagan or myself, a
code complying ramp will be installed at no cost to the tenant.

[n response to your letter of September 19, 1996, I am sorry that you feel that you received very
little inforination from our staff regarding development in your area.
You did indicate that you have received many notices regarding informational, City Council and
Advisory Planning Commission meetings and had attended some of them. i apologize if you feel
there was not enough information expressed at those meetings for your satisfaction. I want you
to know that our staff is available to discuss development matters with you privately or with a
group of your neighbors at anytime you care to make ali appointment.
We treasure you as long time residents of the City of Eagan and I sympathize with you regarding
the changes in your area because of the development of the City of Eagan. The rapid
development of the City has been hard on all of us, but you must realize that when proper
procedures arc followed, the City cannot refuse to let a landowner develop his or her land within
certain parameters.
You asked for a copy of the Jwic 27, 1995 Advisory Planning Coinmission minutes regarding
Itcm C, pertaining to the Promenade and the Healey project. A copy of those minutes is
euclosed.

On Monday, July 7, you fonNarded to me a voice mail message from Councilmember
Sandra Masin regarding three issues associated with the Ketcham residence on
Lexington Avenue. At 2:30 p.m. on that same date, I met with Mrs. Ketcham on her
property to discuss the following three issues:
1. Utility Location Flags
By the time I met with Mrs. Ketcham, she had learned that these are merely
Gopher State One-Call markers that the various utility companies (gas,
telephone, cable, electric, etc.) use to indicate the location of underground
facilities. In regards to the Ketcham property, the flags that we reviewed
were by the telephone company indicating no buried utilities existed. I have
been unable to determine who requested the utility locates, but Mrs. Ketcham
seemed comfortable just knowing their purpose.
2. Telephone Pole Location
The referenced telephone pole is a private electric and telephone service
support pole for their residence. It is located at the crest of the hill from
Lexington Avenue (close to their residence) to ensure proper ground
clearance within their yard. While there is no setback requirement for these
private service poles, it did not appear unusually close to their residence.
Mrs. Ketcham was more concerned about the length of time it took to restore
the turf grass (approximately 9 months) which has been completed within the
past week by the utility company.
3. Retaining Wall Construction
The Oaks of Promenade has constructed a retaining wall along the south
property line that varies in height from 3-7' and is located approximately 10-
12' south of Mrs. Ketcham's south property line. After reviewing the
approved site plans and field inspecting the construction and location of this
wall, it appears to have been done properly. Mrs. Ketcham's concern related
more to how the area was going to be restored. I explained that it would
have to be established with vegetation to mitigate erosion problems but it
would probably not be a maintained area and would grow wild similar to much
of their common property line.
Mrs. Ketcham explained more frustration about the entire project (tree loss,
construction noise, proximity of development, etc.) than about the three issues
identified in this memo. She felt comfortable when I offered my phone number and
willingness to work with her if she should have any future concems.
I hope this has satisfactorily addressed the issues and Councilmember Masin's voice
mail message. If further action is necessary, please let me know. ,

appurtenances.
The grant of the foregoing temporary construction easement for site grading purposes
includes the right of the City, its contractors, agents and servants to enter upon the premises at all
reasonable times to construct, reconstruct and inspect site grading and the further right to remove
trees, brush, undergrowth and other obstructions. After completion of such construction,
maintenance, repair or removal, shall restore the premises to the condition in which it was found
prior to the commencement of such actions, save only for the necessary removal of trees, brush,
undergrowth and other obstructions, subject only to permanent easement alterations.
And the Landowners, their heirs and assigns, do covenant with the City, its successors and
assigns, that they are the fee owners of the lands and premises aforesaid and have good right to grant
and convey the easements herein to the City.

Thank you fvr copying the City on your letter to Healey Ramme regarding the effects you feel
the Promenade development will have on your home. I am asking Lisa Freese of our Community
Dcvetopment Departnient to look into the questions you have about the notification process for
land use applications for the Promenade development. We will share that information with you
when it is researched.
I can clarify a couple of items immediately. To begin with, your property remains zoned
Agricultural as it has been for years. The overall Promenade development is zoned "Planned
Development" which means that a number of uses in an overall development plan are identified
for the entire parcel. In the area surrounding your home, the planned development calls for a
multi-family residcntial use, not a commercial use. Obviously, your request that your property
be purchased is a matter between you and the developer. The City will make every effort to
clarify tlie land use questions you have raised.

Enclosed are copies of letters I wrote to Opus in
regard to the development and conetruction of Eagan
Promenade. I received a phone call from NIr. Murnane
during which he informed me that OPUS has no interest
in our acre as they purchasert land only from the 0'Neals
and that the Healey Ramme Company owns tne land
surrounding our property. He also informed me that this
property has been zoned commercial - but not our<:s.
We find it pretty strange that this piece of land could
be re zoned (excluding our acre) without a word to us
before or after the re-ZOning
I think I made it quite clear in my letters that we
cannot tolerate living here when this project is
underway. I doubt if a_ny of the people involved in tizis
project would approve of being surrounded on three sides
by commereial development and the fourth side by a
right turn lane righ't in fxont of thrir homes. These
letters will give you the background to our resistance
to the easements we have been asked to agree to.
Inasmuch as OPUS says they have no financial (or otherwise)
in ti;is „----in e es art of the Sell Farm on which we built our house
forty years ago, perhaps the Healey Ramme Company
should acquire our property.

I appreciate your letter of the 12th and I hope we can address
your concerns in a timely fashion. You have an excellent idea
concerning the "Blind Driveway" sign. Although we have limited
experience with such signs within the City, they have been
erected both here and elsewhere in the County from time to time.
The policy which is used, however, places the responsibility with
the homeowner or homeowners to request such signage directly from
Dakota County. It is my understanding that Dakota County will
consider erecting such signs provided the homeowner or homeowners
are willing to pay the cost of its preparation. Such a sign
would probably cost in the neighborhood of $50. If you are
interested in pursuing such a sign, either personally or with one
or more of your neighbors, you should contact:

Dear Mrs. Ketcham:
Your letter to Commissioner John Voss was referred to me to
review the concerns you expressed regarding placing a sign on
County Road 43 (Lexington Avenue) warning traffic of your
driveway. After I talked with you on the telephone, I looked at
your driveway and Lexington Avenue approaching your driveway as
well as the standards which govern warning sign placements.
The normal driving task and Minnesota Law requires that motorists
properly adjust their driving to the vehicle in front. Following
too closely or "tailgating" is unlawful. The type of warning
sign you referred to is a variation of the standard sign "BLIND
INTERSECTI0N" intended for use approaching public streets hidden
from view by much worse hills or crests than approach your
driveway. While I understand your uneasiness in driving in the
ever increasing heavy traffic, the design of the road is similar
to many others and does not call for the sign you suggest.

Recently, you forwarded a letter to our City Administrator
requesting information regarding the lack of a trailway along the
west side of Lexington Avenue from Lone Oak Road to Yankee Doodle
Road. Hopefully, this response will provide you with a historical
perspective of our trailways and possibilities or options for their
future installation.
The City of Eagan has a Master Trailway Plan adopted for the City
of Eagan. Various segments of these trailways are constructed and
installed with the development of the adjacent property or
construction/upgrading of the adjacent roadway. The majority of
the trailway network follows our major collector streets which is
comprised of primarily County roads in our community. With the
extensive upgrading of the County roads throughout our community
during the past several years, these trailway systems have been
installed. However, L•c-.xington Avenue (County Road 43) was upgraded
prior to the City or County adopting a trailway plan. That is why
Lexington Avenue north of Yankee Doodle Road does not have any
trailways installed. All future County road improvements
incorporate trailways on both sides.
The installation of future trailways is under the jurisdiction of
the Parks Department which will start to receive financing for
these uncompleted trailway segments through an increase in the park
dedication fee for all future developing property. Subsequently,
these uncompleted trailway links must be prioritized and installed
as funding becomes available with future development. By copy of
this letter, I am forwarding your response to the Director of Parks
and Recreation, Mr. Ken Vraa, so that he is aware of your desires
for completing this segment of the trailway system.

In addition, please be informed that it is currently the City's
policy that all trailways and sidewalks installed within the City
of Eagan are considered 113 season" and are not maintained during
the winter season for snow and/or ice control.
While this response doesn't provide you with a definite time frame
when you can expect this trailway to be installed, I hope that it
provides you with some knowledge of our trailway system that
currently exists and how the City intends to complete the system
as soon as the resources are available.

I received your comment regarding the publication of agenda items in the
official paper, the Eagan Chronicle. I will notify the Eagan Chronicle
that the papers were not delivered until Wednesday and am certainly hopeful
they can make arrangements to accommodate all deliveries on Sunday through
Tuesday of each week.
It is true the City of Eagan has established the Eagan Chronicle as the
legal newspaper. However, agenda items are published in both the Dakota
County Tribune and the Eagan Chronicle as they have been in the past.
The published agenda normally appears in an issue of the Eagan Chronicle
and Dakota County Tribune the week in advance of a regular City Council
meeting and also is repeated in the edition of the Eagan Chronicle that
comes out just prior to the regular City Co.uncil meeting.
Unfortunately, the Dakota County Tribune only reaches a small part of our
residents due to the paid subscription. The Eagan Chronicle is a free
distribution paper and is delivered t9 all house holds in the community which
the City Council feels provides a better sou rce o f notification for City events.
Thank you for your comments, and if you do have any problerhs with
delivery, please contact the Eagan Chronicle. if you do not receive satis-
faction from them, please notify my office.

Dear Mr. Mayleben,
I am in receipt of your letter dated February 8, 2013, describing a proposal to sell firearms
and process out of state sales to MN companies and individuals from the property located at
3345 Lexington Avenue South in Eagan, MN.
The subject parcel is zoned LB, Limited Business. Enclosed is a copy of the LB zoning
ordinance. Please read the ordinance carefully. The LB zoning district specifically states
as a permitted use: Offices of a general nature where the operations do not include retail
sales or warehousing from the site. The purpose of the LB zoning districts are areas that
are particularly exposed to residential neighborhoods and are thus suitable to those
businesses compatible with nearby residential use such as traditional offices and clinics.
The proposal as described in your letter appears to be consistent with the City ordinance
standards applicable for LB zoned property. Our determination that the proposal is
consistent with City ordinance is based on your description and confirmation that there
will be no retail sales or warehousing at the subject property.
As we discussed, I am copying the US Bureau of Alcohol, Tobacco, Firearms and
Explosives on this letter for their records related to your application for a federal firearms
license.

I have moved into commercial space at 3345 Lexington Ave. S. I'd like to
provide the city of Eagan a description of my current and new business.
Currently my main business is Digital Litigation Solutions, Inc. (DLS). We are a
litigation consulting firm that provides technical support to attorneys. We
specialize in the presentation of evidence during attorney presentations, court
hearings and during trial. DLS was formed in 2001 and was located in Eagan

I have created a new corporation in the state of Minnesota. This new company
name is DLS Companies, Inc. This company will be setup to distribute and sell
products to other organizations and individuals.
Notably, DLS Companies will be creating its first d.b.a. company called Gundl
Sports. It is the intent for this company to be approved by the Federal Bureau of
Alcohol, Tobacco and Firearms (ATF) to be a Federal Firearms Licensed (FFL)
dealer. This will allow Gundl's to sell firearms and to process out of state sales to
Minnesota companies and individuals pursuant to federal laws and guidelines.
Gundl Sports will be doing business at the above address as a "by appointment
only" company. In the near future we will begin the creation of our online store to
sell sporting goods and recreation supplies.
Please note that Gundl Sports will be compliant to the ATF regulations for
"Secure Gun Storage or Safe Devices. I've attached the signed ATF Form
5300.42 that I have provided the ATF for approval of our FFL.
