It was brought to my attention that a 6" difference in rise between two areas of one leasable office is not to code. At 2:30 p.m. on that same date, I met with Mrs. Ketcham on her property to discuss the following three issues: 1. Utility Location Flags By the time I met with Mrs. Ketcham, she had learned that these are merely Gopher State One-Call markers that the various utility companies (gas, telephone, cable, electric, etc.) use to indicate the location of underground facilities. In regards to the Ketcham property, the flags that we reviewed were by the telephone company indicating no buried utilities existed. I have been unable to determine who requested the utility locates, but Mrs. Ketcham seemed comfortable just knowing their purpose. 2. Telephone Pole Location The referenced telephone pole is a private electric and telephone service support pole for their residence. It is located at the crest of the hill from Lexington Avenue (close to their residence) to ensure proper ground clearance within their yard. While there is no setback requirement for these private service poles, it did not appear unusually close to their residence. Mrs. Ketcham was more concerned about the length of time it took to restore the turf grass (approximately 9 months) which has been completed within the past week by the utility company. 3. Retaining Wall Construction The Oaks of Promenade has constructed a retaining wall along the south property line that varies in height from 3-7' and is located approximately 10- 12' south of Mrs. Ketcham's south property line. After reviewing the approved site plans and field inspecting the construction and location of this wall, it appears to have been done properly. Mrs. Ketcham's concern related more to how the area was going to be restored. I explained that it would have to be established with vegetation to mitigate erosion problems but it would probably not be a maintained area and would grow wild similar to much of their common property line. Mrs. Ketcham explained more frustration about the entire project (tree loss, construction noise, proximity of development, etc.) than about the three issues identified in this memo. She felt comfortable when I offered my phone number and willingness to work with her if she should have any future concems. I hope this has satisfactorily addressed the issues and Councilmember Masin's voice mail message. The overall Promenade development is zoned "Planned Development" which means that a number of uses in an overall development plan are identified for the entire parcel. It is my understanding that Dakota County will consider erecting such signs provided the homeowner or homeowners are willing to pay the cost of its preparation. Such a sign would probably cost in the neighborhood of $50. The normal driving task and Minnesota Law requires that motorists properly adjust their driving to the vehicle in front. Following too closely or "tailgating" is unlawful. The type of warning sign you referred to is a variation of the standard sign "BLIND INTERSECTI0N" intended for use approaching public streets hidden from view by much worse hills or crests than approach your driveway. While I understand your uneasiness in driving in the ever increasing heavy traffic, the design of the road is similar to many others and does not call for the sign you suggest. The City of Eagan has a Master Trailway Plan adopted for the City of Eagan. Various segments of these trailways are constructed and installed with the development of the adjacent property or construction/upgrading of the adjacent roadway. The majority of the trailway network follows our major collector streets which is comprised of primarily County roads in our community. With the extensive upgrading of the County roads throughout our community during the past several years, these trailway systems have been installed. However, L•c-.xington Avenue (County Road 43) was upgraded prior to the City or County adopting a trailway plan. That is why Lexington Avenue north of Yankee Doodle Road does not have any trailways installed. All future County road improvements incorporate trailways on both sides. The installation of future trailways is under the jurisdiction of the Parks Department which will start to receive financing for these uncompleted trailway segments through an increase in the park dedication fee for all future developing property. Subsequently, these uncompleted trailway links must be prioritized and installed as funding becomes available with future development. It is true the City of Eagan has established the Eagan Chronicle as the legal newspaper. However, agenda items are published in both the Dakota County Tribune and the Eagan Chronicle as they have been in the past. The published agenda normally appears in an issue of the Eagan Chronicle and Dakota County Tribune the week in advance of a regular City Council meeting and also is repeated in the edition of the Eagan Chronicle that comes out just prior to the regular City Co.uncil meeting.
