This past Fall, I reviewed with you the City's difficulty in
collecting an outstanding invoice from the Opus Corporation in the
amount of $1,425.78 for the cost incurred by the City of Eagan to
do a detailed water quality analysis of a development scenario
submitted by Opus for the 100 acres located in the northeast corner
of Lexington Avenue and Yankee Doodle Road.
As can be seen from the enclosed correspondences, the City of Eagan
has sent several notices to Opus requesting reimbursement. Recent
telephone conversations with Marc Anderson of Opus Corporation
indicated his understanding was that the City was to perform this
analysis for their property as a commitment from the public hearing
process when the plan was formally adopted by Council action.
Enclosed is a copy of the minutes from the April 3, 1990, Council
meeting with those portions pertaining to Opus' concerns
highlighted.
I do recall their request to have this analysis done to determine
what the financial impact would be on a development scenario;
however, I do not concur that the City agreed to do it at our
expense. I recall reviewing the issue with you as the consultant
was performing the work and you had concurred that Opus should bear
that expense.
I am unable to receive a commitment from Opus to reimburse the City
for our costs incurred. Subsequently, since I am unable to assist
the Finance Department in collecting this outstandinq balance, I
would appreciate your direction as to how the City should proceed
regarding this matter and, if it is determined that it is not to be
pursued, which account this expense should,be charged to.

Dear Marc:
On April 18, you requested the City to perform a water quality
impact analysis for two different development proposals identified
above. In response to this request, the City retained the services
of our consulting engineering firm, Bonestroo, Rosene, Anderlik &
Associates, Inc., who, at the present time, are the only qualified
individuals capable of doing a detailed water quality analysis in
determining what the land, ponding and/or cash dedication
requirements would be for a development proposal.
This information was then forwarded to your attention on May 4,
1990. It is my understanding that as a result of this analysis,
you will now be able to adequately address these water quality
needs when a land development application is submitted to the City.
We have recently received an invoice from our consulting
engineering firm for the costs associated with this workt' Enclosed
is a copy of that invoice for both parcels. While detailed costs
were not allocated to each development parcel individually, it
could easily be prorated on an area basis. While this is not
necessary for the City's accounting purposes, this recommendation
may be helpful for your market accounting purposes.

On April 18th, I received a letter from you requesting the City to
perform a water quality impact analysis for two different
development proposals as referenced above. This information was
then forwarded to the City's consulting engineer who provided the
enclosed analysis for your information.
In accordance with the proposed Water Quality Management Plan, if
the drainage areas, pond volumes and surface areas within the
development itself do not provide the nutrient removal to a degree
of efficiency as required by this analysis, a cash dedication may
be required to acquire and develop downstream treatment areas to
handle any deficiencies from these requirements as noted.
This information provides you with preliminary water quality
requirements that should be taken into consideration in planning
for the future development of these properties. Any modifications
or additional detailed information that becomes available will have
to be taken into consideration in performing a final review to
determine the requirements to be incorporated in a Development
Contract Agreement associated with any platting and/or replatting
under the City's Subdivision Ordinance.
If you have any technical questions regarding the information
contained in the consultant's report, please feel free to contact
him directly. If you have any questions pertaining to the policy
regarding the implementation of the Water Quality Management Plan
and its requirements on new developments, please feel free to
contact me.

preliminary site plans from the Opus Corporation dated April 18,
1990, requesting a preliminary analysis of water quality management
plan requirements for development proposals associated with the
above-referenced properties.
Based on the recently adopted Water Quality Management Plan, I
would appreciate it if you would perform a detailed analysis based
on the information made available to determine what water quality
requirements (ponding and/or cash) would be associated with this
development.
If certain assumptions have to be made due to the lack of detailed
information, please specifically list those assumptions. If you
need any additional information or clarification regarding this
request, please contact me at your convenience. As I indicated in
our previous phone conversation, it is important that this
information be provided by April 26. Thanks for your anticipated

In our meeting of April 2nd regarding the Water Quality Management Plan,
you indicated the City's willingness to run some site plan/master plan
information through the Walker Model to determine the impact this
proposed Plan will have on these sites. We thank you for your offer and
are enclosing two such site/master plans.
The first one is a portion of the unplatted land on the northeast corner
of Yankee Doodle Road and Lexington Avenue, surrounding Pond DP-11.
This area represents approximately 108 acres. We understand that if the
Management Plan is adopted that all plats must conform to it.
The second area is a portion of already platted land south of West
Service Road, east of Center Court and north of Lone Oak Road, and west
of the 35E ramo in B1ock 6 of Eagandale Center Industrial Park. Here we
are tryi.ng to determine the effect the Water Quality Management Plan has
on a replatted situation.
On each of these plans, I have included the impervious surface coverage,
the overall acreage and any existing pond areas if applicable. Please
determine from our submittal the amount of on site storage in acre feet,
as well as any downstream requirements as to additional ponding (or
additional dollars) downstream.
