I am in receipt of your letter of October 25 wherein you questioned
the development proposals and disposition alternatives for the
above-referenced lots. Presently, these lots are owned by Dakota
County as well as Outlot A of the 2nd Addition. However, the City
of Eagan participated in their acquisition costs. Subsequently,
any disposition and/or development of these lots would require the
joint participation of both agencies..
When the properties were originally acquired as a part of the
Lexington Avenue (County Road 43) improvement, a conceptual
development proposal was prepared to show how these lots could be
further subdivided and serviced with public streets. Enclosed is
a copy of that concept layout. As such, there should be no further
impact or right-of-way dedication requirements from your lots.
This property is not proposed to be developed as park land. It is
anticipated that it will be replatted and subdivided as a single-
family residential development to maximize the return of the
acquisition costs incurred by the City and the County. Any
subdivision of this property will require a standard subdivision
platting process .which would require that all properties within
350' be notified when this process is initiated.
At the present time, we are not sure whether the City and County
will subdivide the property, install the necessary public
improvements and sell the lots individually, or whether they will
be sold in their present configuration to a future developer to
proceed with the subdivision process privately.

Due to the fact that this is publicly owned land at the present
time, its disposition would be through a public sale which would be
handled by an agency of Dakota County. I am not familiar with
their surplus property disposal process, so I would encourage you
to continue your communications with the appropriate County agency.

you had as to the proposed disposition of those properties. If you

On several contacts with prospective buyers of my lots the buyers

RE: Driveway Entrance to Lot 3, Block 1, Williams & LaRue Addition
Dear Mr. LaRue:
We are writing this letter to confirm the telephone discussions we
had in December of 1990. You had contacted us to say that, as part
of the Lexington Avenue upgrading, one of two driveway entrances
to Williams & LaRue 2nd Addition on the north side of Wescott Road
was removed and not replaced. Dakota County Hiqhway Department
feels there was only one driveway entrance to this plat and it was
not removed. The City of Eagan has no record of whether or not
there were two driveways. However, the project inspector of the
Wescott Road upgrading done earlier feels there may have been two
entrances.
The City will give Mr. LaRue, or the owner of said Lot 3, Block 1,
Williams & LaRue 2nd Addition the benefit of the doubt and will
have a drop curb driveway entrance installed to Lot 3. Because the
contract for the Lexington Avenue County Road 43 project has been
finaled out and paid, the City has yet to determine specifically
how this work will be done.
This letter is to confirm that the City of Eagan agrees to install
a driveway entrance in the concrete curb to said Lot 3 in 1991.
This driveway will consist only of the drop curb section as no
concrete aprons were ever constructed.
We hope this letter satisfactorily addresses your needs. Contact

I am in receipt of your letter of October 25 wherein you questioned
the development proposals and disposition alternatives for the
above-referenced lots. Presently, these lots are owned by Dakota
County as well as Outlot A of the 2nd Addition. However, the City
of Eagan participated in their acquisition costs. Subsequently,
any disposition and/or development of these lots would require the
joint participation of both agencies.. .
When the properties were originally acquired as a part of the
Lexington Avenue (County Road 43) improvement, a conceptual
development proposal was prepared to show how these lots could be
further subdivided and serviced with public streets: Enclosed is
a copy of that concept layout. As such, there should be no further
impact or right-of-way dedication requirements from your lots.
This property is not proposed to be developed as park land. It is
anticipated that it will be replatted and subdivided as a single-
family residential development to maximize the return of the
acquisition.costs incurred by the City and the County. Any
subdivision of this property will require a standard subdivision
platting process .which would require that all properties within
350' be notified when this process is initiated. At the present time, we are not sure whether the City and County
will subdivide the property, install the necessary public
improvements and sell the lots individually, or whether they will
be sold in their present configuration to a future developer to
proceed with the subdivision process privately.

Due to the fact that this is publicly owned land at the present
time, its disposition would be through a public sale which would be
handled by an agency of Dakota County. I am not familiar with
their surplus property disposal process, so I would encourage you
to continue your communications with the appropriate County agency.
I hope that this information helps to address some of the questions
you had as to the proposed disposition of those properties. If you
have any further questions, please feel free to contact me and I

Attached for your information are severai preliminary site layouts for the placemerrt of a
- proposed Fire Station on City property located at the northwest quadrant of Lexington
Avenue and Wescott Road. Engineering staff met with representatives trom the Fre
Departmerit to determine the proper building footprint and parking lot corifiguration which
would be oonducive to the Fire Departmerrt's operation.
- No anaysis was done with respect to how much site grading would be tequired to grade
the site to accommodate a future Fire Station site. The sketches merely show that the
site is large enough to accommodate a future Fire Station site taking irrto account
minimum setback requirements from the adjacent properties, the maximum 2k96 driveway
slope from Lexington Avenue to the Fire Station building pad elevation and maintain 3:1
slope criteria from the proposed building and parking lot locations to the easterly adjacent
pond.
The sketches are very preliminary in nature and copies have been given to Craig Jensen
of the Fire Department. If you have any questions or need additional information, please

PERMITS REQUIRED:
I. Landowner/Building Owner permits - to obtain an owner's permit:
A. Read City Code, Chapter 49 Section 4.10
B. Fill out ouner's permit application
C. Provide documentation that any existing septii; system or well has
been filled and/or capped in eecordance with Mn. Dept. of Health WPC
40 and the Minnesota Water Well Abandonment Guidelities within 90 days
of move. (Requires a plumbing permit).
D. If strueture is being disconnected Prom City sewer and water service,
a permit to work in the right-of-way is required (contact Engr.
Dept.)
E. If building is to be 2oeated in tihe City of Eagan:
1) an application must be submitted to Eagan's Community Development
Department for City Council approval of the owner's permit. A
filing fee is required arid all application submittals must be '
provided 14 days prior to a City Council meeting. (Meetings are
held the first and third Tuesday of each month.)
2) obtain building permit, plumbing permitp HVAC permit, electrical
permit and sewer/vater permit as for new eonstruetion.
