Recerrtly, an issue arose regarding the potential additionai fees associated with
connecting to the sanitary sewer and water system and the City's release of the water
meter for Lot 1. This issue related to the inadequacy of the trunk area fees previously
levied by the City of Eagan for the four lots and outlot of the Wiliiams & LaRue 2nd
Addition that was a replat of Lots 3 and 4 of Williams & LaRue 1st Addition.
The trunk area sanitary sewer and water fees were previously levied under the original
parcels and were subsequently allocated equally on a per lot basis to the five newly
created lots of the 2nd Addition. However, when these trunk area fees were originally
levied, they were on a per lot basis for the two lots of the 1 st Addition. Afthough the two
newly created lots with the 2nd Addition should have paid a similar per lot trunk area
assessment for both sanitary sewer and water at the time of the final platting, it was
inadvertently overlooked by the Ciry. Due to the fact that you, as developer of the 2nd
Addition, agreed to pay any additional fees associated with the replatting, the City's
inability to properly inform you of these additional fees at that time should not now be held
as a liability against these lots as building permits are being issued.
Therefore, Lots 1, 2, 3 and 4 of the Williams & LaRue 2nd Addition, are being recognized
as having fully fulfilled alf related and required trunk area assessments associated with
connecting to the sanitary sewer and water system. This clarification is being made to
ensure that there is no such further confusion with future building permit issuances on
either Lot 2 or Lot 4.

PERMITS REQUIRED:
I. Landowner/Building Owner permits - to obtain an owner's permit:
A. Read City Codeo Chapter 4p Section 4.10
B. Fill out owner's permit applieation
C. Provide documentation that any existing septic system or well has
been filled and/or capped in aecordanee with Mn. Dept. of Health WPC
40 and the Minnesota Water Well Abandonment Guidelines within 90 days
of move. (Requires a plumbing permit).
D. If structure is being diseonnected from City sewer and water service,
a permit to Kork in the rigbt-of-way is required (contact Engr.
Dept.)
E. If building is to be located in the City of Eagan:
1) an application must be submitted to Eagan's Community Development
Department for City Counc3l approval of the owner's permit. A
filing fee is required and all application submittals must be
provided 14 days prior to a City Council meeting. (Meetings are
held the first and third Tuesday of each month.)
2) obtain building permit, plumbing permit, AVAC permit, eleetrical
permit and sewer/water permit as for new construetion.
F. City Code, Chapter 4, outlines required fees.
II. Mover's permit - to obtain a mover's permit:
A. Read City Code, Chapter 4, Section 4.10.
B. Fill out mover's permit application.
C. Provide a written guarantee to repair any and all damage to
City/County/State roadways, utilities and/or right-of-way that may result
from this move.

I am in receipt of your letter of October 25 wherein you questioned
the development proposals and disposition alternatives for the
above-referenced lots. Presently, these lots are owned by Dakota
County as well as Outlot A of the 2nd Addition. However, the City
of Eagan participated in their acquisition costs. Subsequently,
any disposition and/or development of these lots would require the
joint participation of both agencies. .
When the properties were originally acquired as a part of the
Lexington Avenue (County Road 43) improvement, a conceptual
development proposal was prepared to show how these lots could be
further subdivided and serviced with public streets. Enclosed is
a copy of that concept layout. As such, there should be no further
impact or right-of-way dedication requirements from your lots.
This property is not proposed to be developed as park land. It is
anticipated that it will be replatted and subdivided as a single-
family residential development to maximize the return of the
acquisition costs incurred by the City and the County. Any
subdivision of this property will require a standard subdivision
platting process which would require that all properties within
350' be notified when this process is initiated.
At the present time, we are not sure whether the City and County
will subd'ivide the property, install the necessary public
improvements and sell the lots individually, or whether they will
be sold in their present configuration to a future developer to
proceed with the subdivision process privately.

On several contacts with prospective buyers of my lots the buyers
have inquiried atiout your properties:
"Will it be a park ?" "What is happening behind you?"
"How will they get to them?"
"Can they condemn -your: iots =to-:get to
I could not answer these questions and therefore, I'm requesting
a response from both of you so this m;synot further jeopardize
my efforts to sell my lots. I understand that these may be
auctioned off to the public. If so, I would be interested in
knowing;

Where would it take place?
Will or could I be notified of said sale?
As you can see,these uncegtainties do present problems for me in

Due to the fact that this is publicly owned land at the present
time, its disposition would be through a public sale which would be
handled by an agency of Dakota County. I am not familiar with
their surplus property disposal process, so I would encourage you
to continue your communications with the appropriate County agency.
I hope that this information helps to address some of the questions
you had as to the proposed disposition of those properties. If you
