This issue related to the inadequacy of the trunk area fees previously levied by the City of Eagan for the four lots and outlot of the Wiliiams & LaRue 2nd Addition that was a replat of Lots 3 and 4 of Williams & LaRue 1st Addition. The trunk area sanitary sewer and water fees were previously levied under the original parcels and were subsequently allocated equally on a per lot basis to the five newly created lots of the 2nd Addition. However, when these trunk area fees were originally levied, they were on a per lot basis for the two lots of the 1 st Addition. Afthough the two newly created lots with the 2nd Addition should have paid a similar per lot trunk area assessment for both sanitary sewer and water at the time of the final platting, it was inadvertently overlooked by the Ciry. Due to the fact that you, as developer of the 2nd Addition, agreed to pay any additional fees associated with the replatting, the City's inability to properly inform you of these additional fees at that time should not now be held as a liability against these lots as building permits are being issued. Therefore, Lots 1, 2, 3 and 4 of the Williams & LaRue 2nd Addition, are being recognized as having fully fulfilled alf related and required trunk area assessments associated with connecting to the sanitary sewer and water system. This clarification is being made to ensure that there is no such further confusion with future building permit issuances on either Lot 2 or Lot 4.
