3810 LEXINGTON AVE
LEGAL: LOT 1 BLOCK 1 ALL SAINTS
The Protective Inspections Division will be performing a final inspection at 3810
Lexington Avenue on Friday, October 8, 2004.
If you are requesting that the Certificate of Occupancy be held, please fil] out the proper
hold request form. Failure to return the hold request form will be considered your approval. The
person, or department, requesting the hold is responsible for notifying and resolving any
problems with the affected parties.

SUBJECT: All 5aints Lutheran Church review
Phase I
Existing parking stalls are non-confoiming, can remain until Phase II is constructed and the parking
lot is reconfigured. The new birch trees may be installed as a container size. The new parking lot
island does not have to be landscaped as long as it is eliminated with the addition of Phase R. If
Phase II does not happen then the planting island should be landscaped.
Phase II
The parking lot in Phase II has some discrepancies with today's code requirements. 60 degree
parking requires a 16 foot drive aisle and ll.5'x19.Y parldng stalls, the plan indicate 9.5'x19'. The
drive aisle to the south is 21 feet and is required to be 24 feet wide. In order to get the correct drive
aisle width and parking stall width and length for the 60 degree parking area, staff suggests shifting
the parking lot to the west slightly. As drawn on the plans staff suggest a more subtle curve in the
parking lot near the drop off area, this will also allow the sidewalk to continue south.
Enclosed are the marked up plans if you have any questions let me lalow, 651-675-5696.

Subject: All Saints Church - meeting minutes
Craig,
Thanks £or the meeting today. Just to recap:
1. The Owner plans to omit ALL sprinkler piping, pursuant to the
resolution of the fire barrier / door issue. A lay-in ACT system will
allow future addition of sprinklers more easily than the originally
speci£ied wood ceiling system. Per our previous conversations, code
does note require sprinklers in either the existing building or the
addition assuming we construct a fire barrier or fire wall to separate
the two.
2. Our toilet count will be reduced for budget reasons. We will
maintain at least the minimum required fixture count (3 for men, 5 for
women), including the existing fixtures to remain.
3. The electrical and lighting system is being redesigned. We will
submit energy code calcs when they are available.
4. I have proposed that the entire north wall of the primary building
addition (69'-4" along column line D) would be designated and
constructed as a fire barrier, thus giving us 17'-4" for opening width
under the 25% rule, including our doors and duct penetrations which
would be protected with 90 minute opening protective assemblies. If the
wall at line D is constructed as a fire wall (3 hour), 3 hour opening
protective assemblies will be used, and the entire construction would be
built to comply with fire wall requirements. You agreed to investigate
this option further and let me know the city's decision. 5. I forgot
to get a copy of your applicable code list. Please fax me a copy so I
can include all the information you are looking for.
6. I will talk with Sheila Cartney regarding my other questions on site
development, planning, etc.
Thanks,

Subject: fire barrier
Renee,
Craig Novaczyk called me today and gave the verbal go-ahead for making
the north wall of the toilet rooms a 2-hour fire barrier. This allows
us to use 1-1/2 hour doors for the door openings as designed, and
confirms that we do not need any fire suppression systems on this
project. The nice thing is that with that rating, we can go back to the
wood doors w/ a 411x25" narrow lite kit (door elevation D2) in lieu of
the 3 hour painted flush hollow metal doors that were specified in the
addendum. We will also need 1-1/2 hour fire dampers for any duct
penetrations through the fire barrier and fire caulkinq at all other
penetrations. Please make these changes and adjust the budget
accordingly. I will submit an official request to the city for a
written approval of this interpretation.
For future consideration, Craig was doubtful we.would be allowed to make
the jump to a full "fire wall" at this condition, due to detailing and
structural requirements that this would demand. The upgrade to a 3 hour
fire wall would not effect the design of this project in any significant
way, and would have literally created two separate buildings, thus
eliminating the need to add sprinklers to the existing space when the
sanctuary addition happens. Unfortunately, with the city's current
interpretation of a 2 hour fire barrier, both the entire building,
existing and new, will need a sprinkler system with the next addition
due to code requirements based on building area and construction type.

Attached, please find the 2000 IBC code study for the project.
I will revise the drawings to add Partition Type A1, which will be identical to Partition Type A,
except it will carry the "UL U-419, 1-hour rated partition" designation.
Wall Type "D" will be described as a 2-hour Fire [3arrier.
Thc two pair of doors (103A / 103f3) will be changed to 3 hour hollow metal doors, thus complying
with exception 43 under IBC 706.6, which allows the openings to exceed 25% of the length of the
rated wall provided the openings' protective assemblies have at least the same rating as the wall
system.
Separate line and meter will be provided for thc lawn irrigation system.
Lawn irriuation metcr and backflotiv preventer will be located at the water service entry to the
building.
P(ease inform us when the plumbing and mechanical plans have been reviewed and forward any
comments.
I am issuuig an addelidum to the construction documents this week wllich will include the above issues.

Please provide a more complete code analysis consisting of:
A. applicable codes
B. occupant load calculations
C. height and azea calculations per Chapter 5 of the Code
D. plumbing fixture calculations per Table 2902.1 of the Code
E. sprinkler provisions per Chapter 9 of the Code
F. fue-resistive provisions per Chapter 7; of the Code
G. exit width calculations per Chapter 10 of the Code
2. Amend the wall type section to include a one-hour rated listed and tested wall assembly for the
incidental storage room 104. (fue barrier).
3. Wall type D should be designated as a fire barrier.
4. Reference Section 706.6 for opening protection for fue barrier walls. It appears that the maximum
aggregate opening width allowed for fire barriers (25% of the length of the wall) has been exceeded.
A complying fire banier with complying opening protection will be required for the wall sepazating
your building into two same occupancy fire areas. I believe the puipose of this barrier is to avoid
adding a sprinkler system to your building at this time.
5. A separate line and meter aze required for lawn imgation.
6. Lawn irrigation meter and backflow preventer need to be located where the water service comes into
the building.
7. Plumbing and mechanical plans are reviewed sepazately from the building plans. Any concerns
regarding these plans will be addressed at a later date.

We performed a geotechnica3 exploration for this project in January
2004 (GMB Praject No. 10792). pur borings encountered topsoil or
bituminous pavement, underlain by fill consisting of brown and gray
silty sand, clayey sand, and silty clay to depths of 2 to 4 feet
below grade. Below the fill in borings 1, 2, and 3, we encountered
a possible buried topsoil layer consisting of dark brown ta black
silty clay and sandy clay extending to depths ranging from 6 to 6.7
feet below gradg?. Selow the fill and/or buried topsoil, we found
interbedded strata of naturally-occurririg sand, silti, and clay to
the boring termination depths.
We recommended that the site preparation include remaval of topsoil
and pavements; subcutting of existing fill, buried topsoil, and any
other soft/looee/unsuitable so'11s; densification of the exposed
subgrade with a heavy compactor; and placement of the new compacted
fill to form the building pad. We recommended that the buiJ.ding be
proporti.oned for a maximum allowable design bearing pressure of
2,500 pounds per square foot.
Earthwork Testiri
On June 3, 2004 we observed test pits excavated alang the western
half of the new addztion to depths vf approximately 1 to 2 feet
below bottom of footin . We observed fill and/or buried topsoii LQ
a depth of approximately 6 feet underlain by naturally-occurri.n9
sand with si1t. we recommended the fill arld/or buried topsoil be
removed from the building pad including appropriate oversizing.

GME ProjeCt No. 10792-A
We pexformed an organic content test on the excavated on-site soil
to determine if this soil could be reused as building pad fill. The
organic content test result was approximately 1.6%. Based on this
test result, the on-site fill was not reused as structural fill.
The on-site fill was mixed with imported sand fill and placed and
compacted as exterior wall backfill.
We perzodically observad the excavation base soil fox the builc3ing
areas after removal of topsoil, bituminous pavement, existing fill,
and buried topsoil. The base svil consisted of sand with silt and
gravel.
we performed nuclear density tests on fill placed during site
grading, and utility and tounda, tion wall backfill. The fill
consisted of sand, trace silt, as described on Proctor Graph Na. 1.
The test results indicated that the compacted dry densities met a
minimum of 95% of the maximum Modified Proctor dry density (ASTM: n
1557) for the times, locativns and elevations tested.
we observed the foundatioxa base soil prior to footing constxuction.
The base soil consisted of sand trace silt. It is our opinion that
the soil was suitable to support the design soil bearing pressure of
2,500 pounds per square £oot fos footing areas at the times,
J.ocations and elevations obseXVed.
Concrete Testi?
we performed slump, temperature, and air entrainment (where
required) tests of the fresh concrete placed for footings and sla.bs.
We alsa cast sets of test cylinders (four per set) for laboratory
compressive strength testing. After initial site curing, the
cylznders were returned to our laboratory tor moist curing and
testing. The test resulC.s are presented on our weekly Concrete
Strength Reports. Cylinder sets 1 through 4 have met the required
comprersive strength at 28 days.
Masan Testin SI
We•performed periodic SI on in sztu masonry construction. We placed
visually observed that the masonrv walls were cQm ?t cte ?? nQbserved
"true" without vertieal and horizontal misaligm
that the mortar head and bed joinr.s were tull, compressed, and
struck off. We also observed that the interior face head and bed
joints were properly taoled. we observed that placement of vertical
and joint reinfoxcement (Dur-o-wal) was in accordance with project
plans and specificatians.

Subject: All Saints Lutheran Church - Fire Protection
Craig / Dale,
This is to confirm our phone conversations reqarding fire sprinkler
systems for the All Saints Lutheran Church project:
As we are creating a 2 hour fire barrier between existing and new, we
are not required to go back and install sprinklers in our existing
building. The occupancy of our new addition is 186 people, well below
the threshold of 300 which would require sprinklers. Therefore, we are
not required to install sprinklers on any portion of this project. The
other benefit of the 2 hour separation is no fire alarm system would be
required either.
However, there are plans for a Sanctuary addition to the south of our
addition which would not be separated from this current addition by any
rated system. We would then be required to go back into this current
addition and install sprinklers. I think the best solution would be to
install the piping and heads (concealed "pop-down" variety) and provide
a logical connection that can be fed by the sprinklers in the sanctuary
phase at such time as it is built. This saves us the cost of a dramatic
water service upgrade, fire risers, pumps, etc. Obviously, there would
be no strobe, siamese connection, etc on the outside of the buildinq for
our current project.
Thank you for all of your advice on these matters.

The City of Eagan does not allow installation of a well in areas
where public utilities (water) are available. If a well is desired
in an area having utilities available, a Special Permit must be
applied for at City Hall for submission to the City Council. In
addition to the Special Permit, Dakota County requires a permit for
installation of a private well.

RE: ALL SAINTS LUTHERAN CHURCH
The Community Development Department has reviewed the development file for All Saints
Lutheran Church and contacted Pastor Larry Smith concerning the complaint regarding
landscaping for All Saints Lutheran Church. Pastor Smith indicated that over the last couple
of years, there have been some issues raised by the surrounding resident. Also, the
development of the landscaping on the church property was modified in the plan in
accordance with agreements between the residents and the church. Presently the landscape
plan calls for a 6' berm along the southerly property on which there is constructed a 3' berm
and no landscaping was proposed with the original plan. Pastor Smith also indicated that
the budget is very tight, but would see what they could do to complete their landscaping plan
and would contact the neighbor to try and resolve his concerns and issues. The City has
offered to coordinate any meetings that may be needed to bring about a resolution and we
are presently waiting for Pastor Smith to contact us regarding meeting requests.
Staff will keep you abreast if anything additional is needed regarding this complaint.

1990. On the attached sheets are the amounts that are due on the
church's property and supporting documentation for the outstanding
assessments. I have addressed only those items that are currently
unpaid. Sheet 1 details the assessments that are currently
outstanding and reveals that there is an outstanding obligation of

its existing assessments.
Sheets 2 and 3 provide the supporting computations as to how the
outstanding assessments were computed. Sheet 4 is the computation

assessment can vary either up or down depending on a number of
variables. You will be notified two weeks prior to the assessment
hearing as to the date, amount and payment terms of the proposed
assessments.
Sheet 3 details the assessments that were levied.as a condition of

Dear Mr. Michael Foertsch:
?L?iaa
I am writing to request a listing of the assessments that have been
paid and the assessments that are yet to be paid on our property at
Lexington and Wescott, now called Lot 1, Block 1, All Saints Addition.
Prior to platting the description was:
The West 394.50 feet, as measured at rights angles, of the
North 436.50 feet, as measured at right angles, of the
Northwest Quarter (NW1/4) of Section 23, Township 27, Range
23, Dakota County, Minnesota.
Please include a clear description of the project for which we are
assessed as well as the project number.
The reason for this request is that we are having trouble reconciling
the costs for our development since prior to 1986, the Lutheran Church
in America was handling the property. Then in 1988 the Evangelical
Lutheran Church in America took it over. Now All Saints Church holds
the mortgage on the church. The changing of hands in handling things
as well as much confusion in the organization of a new congregation as
well as a new church has created a bookeeping nightmare.
If you need additional clarification as to my request, I can be
reached at the above address and phone.
Thank you for your consideration in this matter.
Sincerely, ?
Pastor Larry Smith

RE: ALL SAINTS LUTHERAN CHURCH
Mr. Merchak,
I am sending you this letter to confirm the revisions that you
have requested regarding the A11 Saints Church. We have added a
pair of 20 min, rated fire doors to corridor #118. These doors
will swing away from room #101 and be held open with magnetic
hold open devices. Smoke detectors and exit signs will be
incorporated as required.
Corridors 4k116, 4k118 and lobby #101 shall have two layers of 5/8"
gypsum board attached directly to the bottom cord of the roof
trusses vs. having the two layers of gypsum board separated by
2x4's as shown on the working drawings.
If you have any questions, please ca11 me.

This letter is written in response to your letter of May 18 regarding the opening
protection and fire-resistive construction requirements of the corridor and lobby
aresas of the All Saints Lutheran Church located at 3810 Lexington Avenue.
This is to confirm the requirement of a twenty-minute rated dooY assembly
separating Corridor 118 from Lobby 101. The doors must conform to Section
3305(h) of the Uniform Building Code (UBC). At least one door must swing in the
direction of egress from the lobby into the corridor as required by UBC 3303(a)
and 3304(b). The door latches must be provided with panic hardware in accordance
With UBC 3318(a). The doors should be placed at a location that will minimize
any "dead end" hazard (see UBC 3305(e)). The need for these doors, incidentally,
arises as an alternative to providing a rated wall assembly as required by UBC
3305(a) and USC 3305(g) between Sanctuary 105 and Lobby 101. This alternative
was offered in response to our code review letter of December 1, 1988 (which
pointed out the required separation ) by lack Holmes o£ your company.
Consequently, with the installation of the aforementioned rated door assembly,
Lobby 108 is separated from and no longer intervenes a required exit path of
Corridor 118; thus, the fire-resistive rating on the lobby ceiling as prescribed
by UBC 3305(a) and U9C 3305(g) no longer applies. However, the requirements of
UBC 3305(g) regarding the fire-resistive corridor construction remain in force
for Corridors 116 and 118. Therefore, in lieu of requiring a fire-resistive roof
system above, the corridor ceiling assembly must be installed as originally
proposed.
Sincerely.

REi SPECIAL USE PERMIT
ALL SAINTS LIITHERAN CHIIRCH
The applicant, All Saints Lutheran Church, is requestinq a Special
Use Permit to allow multiple, non-potable, use of water from a
monitoring well. A permit is not being requested for the purpose
of installing a well. A monitorinq well will be installed
regardless of whether or not a Special Permit is granted to allow
water usage for the air conditioning system and landscaping
irrigation. Two monitoring wells have already been installed; I
have a site plan showing all three locations. Some background
information regarding the need for the monitoring wells may help
in better understanding this situation.
During the initial construction of the church, it was discovered
that the soil was contaminated. The source of the contamination
was thought to be a Williams Bros. Pipeline which runs through the
property. The contamination was cleaned up, and the Pollution
Control Agency recommended installation of three monitoring wells
on the site. These wells, to be installed by Williams Brothers,
would be used to monitor any future contamination and if that
occurred, the wells would be used as part of a clean up process.
As Williams Brothers and All Saints Lutheran Church worked together
on determining where the wells would be installed, it was agreed
that the church would install one of the wells if they could use
the water for the church's air conditioning system. This seemed
to be a mutually beneficial agreement. The idea of irrigation is
a means to dispose of the water that is run through the air
conditioning system.
Vanman Construction, general contractor, informed me that they
didn't consider this an unusual situation, therefore did not
realize the City did not allow this type of use. Apparently, they
have had similar situations in other cities and have not run into
any problems.
If it is the City's concern that this would set a precedent
regarding private wells on property that is serviced by City water,
it is my feeling a repeat of this situation would be rare. There
are very few properties requiring monitoring wells. There may be
other concerns that could best be addressed by the Public Works
Department.

Dear Mr. Runkle:
One behalf of All Saints Lutheran Church, Vanman Construction, Williams Pipe
Line Co. and Geothermal Heating & Air Conditioning, we request permission to
install a non-potable well at All Saints Lutheran Church 3810 Lexington Ave.
Eagan, Mn. The well will serve three functions as follows:
1. A monitoring well for Williams Pipe Line Company
2. Provide Air Conditioning for the church.
3. Provide lawn sprinkling with the same water used to Air Condition the church.
The above well will not require a Water Appropriation Permit from D.N.R. because
water consumption doesn't exceed 10,000 gallons/day and/or 1 million gallons
/year.

Subject: "On Site" Well for All 5aints Lutheran Church
-P - 7 _ S1
July 9th, 1989
The Mechanical Systems at All Saints Lutheran Church are complete, requiring
only the "On Site" well, supplying 49° F. water, to become operational. We
request approval of the enclosed Special Use Permit to complete the well in-
stallation. The following information may be helpful in evaluating the merits
of this "On Site" well.
During the mechanical design phase of this project, two choices were considered:
Base Bid: Twenty tons of Electric Air Conditioning using exterior condensing
units and a Lawn Sprinkling system using treated city water. City water can't
also be used for air conditioning because the water distribution system heats
the water to about 59° F., which is too warm for latent cooling (moisture removal).
Alternate Bid: Twenty tons of Well Water Air Conditioning using an "On Site"
well supplying 49° F. water. This water is then re-used for lawn sprinkling.
The Alternate Bid, described above, was accepted by All Saints Lutheran Church.
We would like to list a few of the advantages and disadvantages of this Alternate
Bid. Persons mostly concerned by this decision are All 5aints Lutheran Church,
State of Minnesota, Electric Utility, The City of Eagan and the Williams Pipe
Line.
All Saints Lutheran Church
Advantages for Alternate Bid over Base Bid:
1. Well Water Air Conditioning provides Air Conditioning for 1/20 th the energy
cost of Electric Air Conditioning.
2. The well water is re-used for free lawn sprinkling.
3. No exterior units are required, therefore eliminating visual and noise
pollution.
Disadvantage: Slight increase in the first cost for the Mechanical Systems.
page 2
State of Minnesota
The Department of Natural Resources - Division of Waters and The Department
of Health are responsible for appropriating all the well water in the state,
to insure both the water quality and quantity. The main objective is abundant
municipal water supply and efficient power generation. (See "Water Bill"
enclosure - Article 4- Section 2) These departments encourage the efficient
use of all well water. The Base Bid does not use water efficiently because
first priority water is used for lawn sprinkling only and additional water
is required to satisfy the additional electric requirements. The Alternate
Bid uses the water twice, eliminating the additional water requirements for
power generation. The new Water Bill passed by the State of Minnesota in May
of 1989 was amended to specifically allow Mechanical Systems, similar to those
at All Saints Lutheran Church, which use the water efficiently. (See "Water
Bill" enclosure - Article 4- Section 4- Lines 17 thru 20)
Electric Utility
The electric utility encourages the efficient use of electricity in two areas;
Demand and Energy Consumption. The high Air Conditioning Load in the summer
creates their peak demand which must be satisfied in power generation and dis-
tribution capacity. The Well Water Air Conditioning systems in the Alternate
Bid are twelve times more energy efficient than the Electric Air Conditioning
in the Base Bid.
City of Eagan
In the summer, many cities and towns can't supply adequate quantities of water
for both fire protection and lawn sprinkling at the same time and therefore
impose sprinkler bans. In most cases the problem lies not in the source of
the water (aquifer) but rather the capacity of the municipal well and size
of the storage tank and distribution system. Therefore, on site wells for
lawn sprinkling are being encouraged. As the City of Eagan continues to grow,
they may also experience these same water supply problems and will encourage
Mechanical Systems similar to All Saints Lutheran Church which benefit the
State of Minnesota (D.N.R. & The Department of Health) and the Electric Utility.
page 3
Williams Pipe Line
The "On Site" well in the alternate Bid is also a monitoring well. This well
would detect a surface contamination which could effect the glacial drift half
way between the surface and the aquifer supplying the City of Eagan. If surface
contamination were to occur, the continuous pumping of this monitoring well
would help prevent the spread. This procedure is currently being done at the
Ttain Cities Arsenal in New Brighton where lead was discovered at the surface.
We hope the enclosed information is helpful in evaluating the merits of our
special use permit for an "On Site" Well.

AE: BPECIAL IIBE PERMIT
ALL SAINTS LIITHERAN CHIIRCH
The applicant, Al1 Saints Lutheran Church, is requesting a Special
Use Permit to allow multiple, non-potable, use of water from a
monitoring well. A permit is not beinq requested for the purpose
of installing a well. A monitoring well will be installed
regardless of whether or not a Special Permit is granted to allow
water usage for the air conditioning system and landscaping
irrigation. Two monitoring wells have already been installed; I
have a site plan showing all three locations. Some background
information regarding the need for the monitoring wells may help
in better understanding this situation.
n
Department.

2. Amend the wall type section to include a one-hour rated listed and tested wall assembly for the
incidental storage room 104. (fire barrier).
3. Wall type D should be designated as a fire barrier
4. Reference Section 706.6 for opening protection for fire barrier walls. It appears that the maximum
aggregate opening width allowed for Fire barriers (25% of the length of the wall) has been exceeded.
A complying fire banier with complying opening protection will be required for the wall separating
your building into two same occupancy fire areas. I believe the putpose of this banier is to avoid
adding a sprinkler system to your building at this time.
5. A separate line and meter are required for lawn irrigation.
6. Lawn irrigation meter and backflow preventer need to be located where the water service comes into
the building.
7. Plumbing and mechanical plans are reviewed separately from the building plans. Any concems
regarding these plans will be addressed at a later date.

Jerry:
I just spoke with Chris Weggemann [(651) 270-0194], who is representing the subject church, and based on the
information he provided me, we can waive the small water quality dedication fee that I previously indicated
would apply to the church's building addition.
Please call me if you have any questions.
