Dear Mrs. Simpson:
In response to your telephone request of June 29, I have proceeded
with the installation of the sanitary sewer service between
Lots 1 and 2 of Block 1, Lexington Parkview Addition, from the
sanitary sewer lateral being installed within Northview Park
Road under the above-referenced project and City contract.
In accordance with your request, I have prepared the appropriate
"Waiver of .Hearing/Special Assessment Authorization"_ which must
be executed by you and your husband as Contract For Deed holders
and all other parties who are the.fee owners of the property
being serviced and subsequently assessed.
In anticipation of your execution of this agreement per your
request, we will proceed with the installation of the sanitary
sewer service unless so requested to the contrary in writing •
before July 7, 1987. The fully executed agreement must be returned
to my attention as soon'`as possible.. This agreement will be
held until the time of the final assessment hearing for Broject
485 at which time the estimated costs contained within this
agreement will be revised based on actual costs of installation. ?

The Mayor has requested that I summarize the proposed costs associated with
ineorporating the abbve reference parcel in its entirety into the proposed Lexing-
ton Parkview Addition as 4 single family lots with three lots fronting on the
new internal residential street for the Lexington Parkview Addition
and the fourth (larger) lot ineorporating the existing single family residenee on
this parcel. The assumption of this information is based on the fact that if any
portion of this unplatted parcel is to be subdivided and developed, the entire
parcel must be replatted in aecordance with the legal opinion rendered by the
City Attoraey's Office enelosed herein for your information.
ASSESSMENTS .
This pareel has previously been assessed at the single family rates for trunk
' area water (Pro,jeot 395), trunk area sanitary sewer (Projeet 361) and lateral
benefit from trunk water main (Project 395).
This parcel has a pending assessmen£ for trunk area storm sewer under Projeet
#479. This pending assessment amount is computed based on the "large lot"
credit whereby only the first 16,500 square feet of each aere would be assessed
due to the parcel being less than 5.0 aeres in size and homesteaded.
If this property were to be ineluded in its entirety as a part of the Lexington
Parkview Addition, the following assessment obligations (ineludes pendings)
would be a requiremeflt of final plat approval. These figures would be based-on
the net assessable area taking into consideration the additional riglit of way
dedieation required for Lexington Avenue for a 60' half rigYit of way resulting
in a net assessable area of 133,400 square feet (3.06 acres).

Because the proposed streets and utilities being installed wfthin the Lexington

an equitable finaneial contribution.
PARK DEDICATION
It is my understanding that the Lexington Parkview Addition has previously
fulfilled its park land dedication requirements as a part of the Lexington South
Planned Unit Development agreement. Because the existing homesteaded pareel Was
not included in this planned unit development agreement.,.it is anticipated that
a cash park dedication in the amount af $471.00 per lot for the three proposed newly
created lots would be required. However, this shouTd be verified with Ken Vraa,
the Direetor of Parks and Recreation. -
PLATTING
Subjeet to concurrenee from tHe City Attorney's Office, it is assumed that the
incorporation of this pareel as a,part'oF the Lexington Parkview,Addition plat
can be accomplished under the previous publie hearing process. Subsequentlyt -
the application fee for final plat approval will be increased based on the
inereased number of lots in aceordance-with the attached fee schedule. - ---

If the proposed newly ereated lot incorporating the existing homestead were to
be subdivided at some future date at the property owner's discretion and

VARIANCE
If the property owners desire to contest the City's requirement of incorporating
the existing pareel in its entirety, it would require the application and
processing of a variance to the existing city ordinanees prohibiting the
exelusion of the homesteaded portion as an exeeption to the plat or allowing
it to be platted as an outlot. The.application fee for this varianee process.is
_$50.00 per the attaehed fee schedule.
RIGHT OF WAY DEDICATION
All necessary right of way for the three newly created lots fronting on the
internal streets will be dedicated as a part of the Lexington Parkview Addition.
A temporary slope and construction easement will be necessary to aceommodate the
proper grades of this new street. It is the developer's responsibility to insure
that the required slope easements have been negotiated and aequired.
Because this plat abuts County Road 43 right of way, the County Plat Commission
will require the dedication of a 60' half right of way and a 20' construction/
slope easement to aecommodate-the future upgrading of Lexington Avenue
tentatively scheduled to oecur in 1989.
All these procedures, conditions, and requirements are typical of the City's
development requirements. If this property were not ineluded with the Lexington
Parkview Addition and platted at a later date, the assessment rates associated
' with Item 4k's 2 and 3 refereneed above would be in accordance with the rates in effect
at the time of that subsequent final plat approval. Based on historical records
regarding these type of assessments, it is anticipated that they would be
increased from those rates stated in this letter. -

decision as to whether you wish to proceed as a part of the Lexington Parkview
Development Process or wait until a later date. If you have any questions
