SUBJECT: MCCARTHY HOUSE
I would like to offer the following as a recap to our meeting at the McCar[hy house.
Regazdless of the anticipated use of this savcture, the grading azound the house should be modified to provide a
positive drainage away from the foundaHon. Moisture was observed in the basement and I believe that this preventative
measure can reduce, or eliminate, any water-related problems.
Another suggestion that I have is to add spindles or block off the side of the stairway that is open to the basement.
If the house is to be occupied as a single family residence, no changes would be required by the Building Code.
Modifications would be required for the disabled if this house is to be used for anything other than an R-3 occupancy
"single family dwelling".
The most obvious items requiring compliance aze:
1. All doorways on the upper level must have a clear opening not less than 32".
2. Front approaches to the push sides of swinging doors shall have maneuvering space that extends 12" beyond
the latch side.
3. A ramp and landing would have to be constructed at the main entrance. The ramp slope must not exceed a
slope of 1:20.
4. At least one restroom must be designed with clear floor space of not less than 48" in front of the water closet
and 42" from the center line of the water closet on the side not adjacent to the wall. Cleaz floor space must be
provided in front of the lavatory not tess than 48". I can provide you with the requiremenu for grab bazs and
the clearances for the ]rnee and toe space.

was held on July 20th. At Closinq, an Agreement between ihe City of
Eagan and L111ian McCarthy, and a Warranty need to the City of
Eagan were siqned, copies of which are enclosed, and a check was
tendered to Lilliaa McCa=thy in the amount of $135,925.75 pursuant
to the.enclosed Seller's Closinq 5tatement.
Also, pursuant to my conversation with Kea Daw].o, I have requested
that the Citp issue checks to cover the follawing items which aze

In response to your memo regarding the Lillian McCarthy property,
it is the planning department's opinion, as previously discussed
a couple of months ago, that the Waiver of Plat process is
necessary to split the existing approximately four acre parcel.
State Statute #462 establishes the platting of property procedures.
The City has the authority to waive the platting process for unique
circumstances, however the waiver process in the City Code requires
a public hearing held before the Advisory Planning Commission and
approval by the City Council prior to the splitting of any
property.
2 have prepared the legal notices that were sent to the newspaper
and in-house planning staff has coordinated the notification by
mail to the 26 affected property owners within 350' allowing both
the Waiver of Plat and Rezoning to be heard at the September 25
Advisory Planning Commission meeting. I have tentatively scheduled
it for the October 2 City Council meeting, assuming action is taken
by the Planning Commission.
Please provide me with a registered survey of the property,
including the existing home location and a legal description of the
property no later than Tuesday, September 18, so we can proceed on
this accelerated time schedule.
It would be best to plat the property as soon as possible in order
to eliminate any future lot line discrepancies with residents who
live adjacent to the City property. The application forms and
files have already been set up and I will coordinate the signing
of the applications and necessary resolutions with Gene.
If you would like further information regarding either process,
please advise.

RE: LILLIAN MCCARTHY - LAND PURCHASE: PROPERTY SPLIT
Jim, we have had previous conversations regarding how to handle the Lillian McCarthy
property, and in particular how to handle her life estate. There seems to be some
misunderstanding and confusion within the organization on how to deal with this issue, so
lets start over from the beginning.
The City has purchased the entire Lillian McCarthy parcel on Lexington Avenue, which
consists of about four .(4) acres. As part of the City agreement with Lillian, the City
(Council) has approved a provision providing her with a life estate. This allows her to
remain in her (former) home. With this life estate, she is responsible for the care and
upkeep of the property, home and taxes.
However, the County needs from the City, a property description and authorization to
"split" the life estate parcel from the original. The acquisition will portion her the share
of taxes attributed to her.
It appears the City has two (2) options to identify the life estate to the County:
(1) The City could plat the property. Obviously, this is an expensive position
and does not make sense at this time. The platting is a process that should
be undertaken when the entire park parcel, which includes all of Patrick
Eagan Park, is developed.
(2) The second option is for a letter from the City authorizing the County to
split this portion (the life estate portion) from the original four (4) acres.
This seems to be the most logical approach.
The issue is, need this go through a pubiic hearing process (waiver of plat) in order for
the City to issue an authorization letter to the County, since the City will still own both
ap rcels. The purpose of the authorization ]etter - as I understand it - was something the
City required to rp otect individuals and the City from indiscriminately splitting land, and
to ensure that the City is notified of the intention of this split. Inasmuch as the City has
already been "notified" and has approved (at ]east indirectly) the purchase and creation

of the life estate, and since both parcels will remain with the City, could not the letter be
authorized at this time? Furthermore, since both parcels will continue to remain with the
City, and the possibility of resale does not exist, a letter should be acceptable at this time.
Please advise me as to how we should proceed, so that I may communicate this to other
departments and ensure that an authorization letter gets to the County.
Jim, am I also correct in assuming that, at the appropriate time, Community Development
will process a zoning change to reflect that this property has become a public facility/park.
In the past the Community Development has simply processed those applications at their
discretion or as time permitted.
Please let me know the process and rationale for the Lillian McCarthy property/parcel.
With an early response we can resolve this issue with the County, and hopefully before
the October date when taxes are determined.

AGREEMENT
The parties to this agreement are the CITY OF EAGAN, Dakota County,
Minnesota, a Minnesota municipal corporation ("City") and LILLIAN McCARTHY, a
widow and not remarried ("McCarthy").
McCarthy owns the following real property in the City of Eagan, Dakota
County, Minnesota:
The easterly 400 feet of the southerly 16 acres of the
east half of the northeast quarter (E 1/2 NE 1/4),
Section 22, Township 27, Range 23, except the southerly
66 feet thereof.
The City of Eagan has sought to acquire the property through negotiation
and ultimately through the threat of condemnation.
McCarthy is represented by Shawn M. Moynihan, Attorney at Law, Hastings,
Minnesota, and the City ofi Eagan is represented by its City Attorney, James F.
Sheldon.
The parties being fully informed on the facts and having a full, fair and
adequate opportunity to inspect the property agree as follows:
1. McCarthy shall execute and transfer to the City the Warranty Deed
attached as Exhibit A. Both parties acknowledge that McCarthy retains a life
estate in a portion of the property legally described as:
The east 400 feet of the south 16 acres of the east half
of the northeast quarter (E 1/2 NE 1/4), Section 22,
Township 27, Range 23 except the south 66 feet thereof
and except the north 265 feet thereof.
2. The City agrees as follows:
a. To issue a"split letter" authurizing the property to be
divided into two separate tax parcels at the County Auditor's, Assessor's, and
Treasurer's offices.
b. To mainiain access from the life estate parcel to Lexington
Avenue at the City's sole cost and expense, including but not limited to snow
removal and grading.
c. To pay to McCarthy the following amounts: $22,500.00 per acre
for the land for a total land amount of $86,625.00;
$55,000.00 for the house and other buildings on the property;
$6,333.00 for trees;
$1,100.00 for interest.
d. To pay all special assessments plus accrued interest for the
storm trunk line (Special Assessment No. 140931).
e. To pay all special assessments against the property as a
result of Dakota County's Lexington Avenue Improvement Project (5pecial
Assessment No. 1OP531).
f. Any future special assessments against the entire parcel of
property will be the responsibility of the City.
3. McCarthy agrees as follows:
a. To pay real estate taxes for the property in which she retains
a life estate.
b. To pay special assessments only on the remaining assessments
for the water trunk line (Special Assessment No. 101089); the water lateral
assessment (Special Assessment No. 101090); and the service connection fee
(Special Assessment No. 101091). The payment of these assessments will be in
the form of a deduction from the amount paid to her by the City.
c. To be solely responsible for the buildings and maintenance
thereon on the life estate property and for the care, insurance and upkeep of
the life estate property to a standard to which she desires. further she agrees
to hold the City of Eagan, its agents, servants and employees harmless from any
actions, causes of action, claims or damages with respect to her use and
occupancy of the life estate property or buildings located thereon. In the
event that any building on the life estate property is damaged or destroyed,
from any cause, McCarthy may repair or rebuild the structure at her expense.
If McCarthy decides not to repair or rebuild any building on the life estate
property, no additional monies shall be due the City as a result of the loss of
or damage to any building or buildings.
d. She accepts payment as set forth in this agreement and related
documents and acknowledges that payment is received (i) under threat of
condemnation, (ii) as full, fair and complete payment for all easements,
damages, and claims together with full, fair and complete payment for the
property.
e. McCarthy agrees that this life estate shall terminate on the
sooner of (1) her death or (2) when she leaves the life estate property for more
than six consecutive months.
4. Both parties agree that this agreement, the land transfer, and the
payment of dollars are complete and final settlement of all claims with respect
to the acquisition and use of this property by and between the parties. Further
the parties and their respective attorneys agree to execute any and all
necessary documents to transfer the premises, the dollars, and carry out the
intent of this agreement. Furthermore, both parties agree that McCarthy will
be able to have a member of her family and spouse or a non-family member live
on the life estate property while she resides there.

Dear Mrs. McCarthy:
Recentky, your daughter, Elaine Pietsch, contacted me conveying
your concerns regarding the replacement of the field entrance
driveway from Lexington Avenue approximately 200' south of
Northview Park Road and approximately 200' north of your present
driveway access on the south.
This apparent abandoned field driveway access was removed with the
installation of the storm sewer installed along the west side of
Lexington Avenue in 1988 under Project 527, Contract 88-16. It was
not replaced to its previous condition because of its apparent
abandoned nature and your present access being provided from the
south from the Patrick Eagan Park access road.
Similarily, it is not proposed to reinstall a driveway access as
a part of the upgrading of Lexington Avenue due to safety concerns
and the availability of adequate access from the existing Patrick
Eagan Park entrance road.

Dear Dave:
On April 25, you forwarded two copies of the enclosed agreement prepared by
Bernie Dusich (attorney for Lillian MeCarthy) as a result of Council action of
April 1 caneelling the proposed assessment in response to their threat of
court appeal.
Gene VanOverbeke forwarded the agreement for my review, approval and
execution, if appropriate. After reading the agreement, I question.the
necessity for an agreement that has no rights or restrictions allocated to the
City of Eagan. Due to the fact that I was not in attendance at the April 1
meeting to have verified the intention of the Council to "caneel" vs. "defer",
I will have to rely on your firm's interpretation of their final aetion.
Your researeh has indicated that it was the Couneil's intention to "caneel"
this assessment. In such case, the execution of this agreement on behalf of
the City of Eagan is no longer necessary.
If it is determined that it was the City's intention to defer this assessment
to some later date, I feel an agreement should be prepared allowing the City
to levy this assessment, without contest, at the time of sale/development of
the property or death of Lillian MeCarthy.
I will assume that this assessment is to be cancelled and
action is required by the City of Eagan other than to remove
from the final adopted assessment role for Projeet 411 to be
County for colleetion.
If this issue requires further diseussion, please contact me.

WHEREAS, the above action is an appeal from a special assess-
ment levied by the City of Eagan against land owned by the Appel-
lant in the City of Eagan; and
WHEREAS, the parties desire to settle their differences
concerning such special assessment upon the terms provided in this
agreement;
NOW, THERFORE, the parties mutually agree as follows:
1. That Lillian M. McCarthy is the sole owner of land in
Dakota County, Minnesota, described as follows:
The East 400 feet of the South 16 acres of the East 2
of the Northeast 4 of Section 22, Township 27, Range
23, except the South 66 feet, Dakota County, Minnesota,
being 3.85 acres, more or less.
2. That Respondent City of Eagan has levied a special
assessment against Appellant's above-described property in the
amount of Two Thousand Nine Hundred and Seventy (2,970.00) Doll.ars
for an area trunk storm sewer improvement under Project No. 411.
3. That the above-described assessment levied by Respond-
ent, which is the subject of this appeal, is hereby cancelled, and
the Dakota County Treasurer and the Dakota County Auditor are
hereby directed to remove said assessment from their records.
4. Any penalty and interest by reason of nonpayment of any
installments of the special assessment from which this appeal is
taken may be and hereby are forgiven.
5. The City shall be entitled to levy a special assessment
for area trunk storm sewer improvements to the above-described
property upon the death of the owner, Lillian M. McCarthy, the
sale of the above-described property, or development of the
above-described property at the then existing rates being levied
by Respondent; provided, that said rates do not exceed the then
"special benefits" to said property.
6. That Appellant, for herself, her heirs, executors,
administrators, successors and assigns, agrees to notify the City
of the happening of any event which would allow the City to levy
said assessment pursuant to paragraph 5 above.
7. This agreement shall run with the land and bind the
heirs, executors, successors, administrators and assigns of the
owner.
8. It is expressly understood that the owner, for herself,
heirs, executors, administrators, successors and assigns, reserves
any and all rights that exist under law with regard to the levying
of any future assessments or connection charges on the above-
described property, including the right to object to or to appeal
from any such future assessments or connection charges that may be
levied in the future, including area trunk storm sewer assess-
ments.
9. The undersigned includes all of the persons, firms or
corporations that hold an interest in the land described above,
including the fee title owners, contract for deed vendees or
vendors or holders of any other interest under contract for deed,
option, or otherwise.
Subject to the foregoing, the appeal is hereby dismissed
with prejudice and without further costs to any party.

The final assessment hearing for Project 395 was held on August
6, 1985, for the installation of trunk water main and individual
service to the above-referenced parcel. During the adoption of
that final assessment roll, the Council approved a rate of
interest to be calculated against any outstanding balances due.
Present State Statute and County policy require that any
assessments certified to the County for collection on the
property tax statement must include all interest for the year in
which the assessment was adopted prorated from the date of
Council adoption to the end of that calendar year (4.5% interest)
plus the next full year's calculated interest at the adopted rate
(11.0% intezest).
Therefore, the first year's annual installment will reflect not
only the first full calendar year's interest at the adopted rate,
but will also incorporate a portion of the previous year's
interest resulting in 15.5% interest. All subsequent annual
installments of the 15 year special assessment spread will be
calculated at the adopted rate of 11.0°s interst.
Hopefully, this helps to explain why the first year's annual
installment interest rate appears higher than what they were
ant-icipating. Please let me know if any additional clarification
is necessary.

H. Final Assessment Hearing for Project 3951 (Lillian McCarthy -
Trunk Water Main)-On January 15, 1985, the final Assessment
Hearing was held relating to the benefits received from the
installation of the trunk water main.along the west side of
Lexington Avenue from Wescott Road to Diffley Road. At that
time, a written objection was submitted by Lillian McCarthy in
the final Assessment Hearing for that property has subsequently
continued to allow Staff to try and resolve the issues and
concerns supporting her objection. The following is information

Subsequent to this objection, the City authorized the appraisal
of the property to determine the benefit. The City's appraiser ?
indicated that the maximum benefit associated to this parcel
through the installation of this trunk water main is $6,000. Due !c S y
to the fact the City is limited in the amount of the special
assessment by this appraisal, it is recommended that the special
assessment be reduced to the $6,000 valuation of benefit as
determined by the City's appraiser. Forwarded to the Council
under separate cover is a copy of the appraiser's report showing
how the dete mination of this benefit was arrived it. Enclosed
on pages and is a letter from Mrs. McCarthy's attorney
indicating that the are not'interested in pursuing the senior
citizen deferment and requesting the City to cancel the
assessment until such time that the property develops.
ACTION TO BE CONSIDERED ON THIS ITEM: To close the Public
Hearing and approve/modify the amount of special assessment to
the Lillian McCarthy parcel under Project 3951.

Dear Paul:
I am writing in regard to our position regarding the special
assessment against property owned by Lillian McCarthy on Lexington
Avenue. The total amount of the assessment is $9,519.51. This sum
is broken down into an area assessment of $3,483.20; lateral
benefits for water from the trunk in the amount of $5,008.08; and
a service charge of $1,028.23.
I have inspected the property and reviewed it with an
appraiser for a preliminary opinion. In our opinion, the laterals-
from the trunk are of no benefit to her property at the present
because she has not connected to this service and secondly, even
if her property is developed, a road would have to be run into the
property from Lexington with laterals accompanying such roads,
such that she would have to be assessed again and it is only at
this later point that there would be any true benefit to the
property.
Additionally, the assessment for area improvement is a
general benefit and not a special benefit and as such is not
assessable.
You have recommended that we consider a senior citizen
deferment; however, as we see it, that is merely a postponement of
the existing assessment to a].ater date and we feel that the
existing assessment is extremely excessive and unjustified.
As you are aware, the McCarthys farmed this area for years
and Mrs. McCarthy and her husband, Joe, sold the existing land for
the Patrick Eagan Park in 1970 to the City, retaining their

existing four acres as their homestead upon which they built. Mrs.
McCarthy has a strong tie to the property and does not have any
plans to develop the property in the reasonably forseeable future,
and would prefer to firiish her life living on the property.
Further, you indicated that the City may be interested in
purchasing the property and if that is the case, it would
certainly appear to be premature to levy a special assessment
against the property for which she would be responsible. As a
result, I am proposing that the asses'sment levied against her
property be cancelled until such time as there is actual
development on the property, or until such time as the city
decides to purchase tYie property.
If at all possible, I would appreciate hearing from you with
regard to our proposal prior to the scheduled council meeting of
Tuesday, August 6th, 1985.

2. That Respondent City of Eagan has levied a special
assessment against Appellant's above-described property in the
amount of Two Thousand Nine Hundred and Seventy (2,970.00) Dollars
for an area trunk storm sewer improvement under Project No. 411.
3. That the above-described assessment levied by Respond-
ent, which is the subject of this appeal, is hereby cancelled, and
t.he Dakota County Treasurer and the Dakota County Auditor are
Chereby directed to remave said assessment from their records.

4. Any penalty and interest by reason of nonpayment of any
installments of the special assessment from which this appeal is
taken may be and hereby are forgiven.
5. The City shall be entitled to levy a special assessment
for area trunk storm sewer improvements to the above-described
property upon the death of the owner, Lillian M. McCarthy, the
sale of the abave-described property, or development of the
above-described property at the then existing rates being levied
by Respondent; provided, that said rates do not exceed the then
"special benefits" to said property.
6. That Appellant, for herself, her heirs, executors,
administrators, successors and assigns, agrees to notify the City
of the happening of any event which would allow the City to levy
said assessment pursuant to paragraph 5 above.
7. This agreement shall run with the land and bind the
heirs, executors, successors, administrators and assigns of the
owner.
S. It is expressly understood that the owner, for herself,
heirs, executors, administrators, successors and assigns, reserves
any and all rights that exist under law with regard to the levying
of any future assessments or connection charges on the above-
described property, including the right to object to or to appeal
from any such future assessments or connection charges that may be
levied in the future, including area trunk storm sewer assess-
ments.
9. The undersigned includes all of the persons, firms or
corporations that hold an interest in the Iand described above,
including the fee title owners, contract for deed vendees or
vendors or holders of any other interest under contract for deed,
opt-ion, or otherwise.
Subject to the foregoing, the appeal is hereby dismissed
with prejudice and without further costs to any party.

The owners of these parcels made payments to the City with interest. The
County was not sent copies of the receipts as these parcels did have Senior
Citizen status.

At the September 17, 1985 Final Assessment Hearing, a written
objection was submitted by the attorney representing Lilian
Mc Carthy for the trunk area storm sewer assessments proposed
under the above-referenced oroject. A,copy of that objection
is enclosed on page(s) J'/ . Maps showing the location of this
oarcel in relationship to the project are enclosed on page(s) ?Z.

the proposed final assessment roll showing how the amount was
calculated. As can be seen, although the property incorporates

NOTICE IS HEREBY GIVEN on behalf of Lillian M. McCarthy
of objections to the area storm sewer assessment proposed to
- be levied against her property in the amount of $2,970.00, pursu-

The City is hereby notified that Mrs. McCarthy objects to
said assessment on the following basis:
1. That the City lacks jurisdiction to levy said assess-

The City of Eagan is a second tier suburb in the Twin City
Metropolitan Area of Minneapolis/St. Paul. Eagan is located
approximately 10 miles south of the downtown area of the Twin
Cities. Unlike many second tier suburbs, Eagan employs a very
substantial number of its citizens within the corporate limits of
the CIty. In total, Eagan was estimated to employ 14,000 persons
in 1980.
The current population of Eagan is estimated to be 20,720
contrasted with the 1960 Census population of 3,382 and the 1970
Census population figure of 10,398. Until the early 1960's,
Eagan was an agricultural eommunity, but in the past two decades,
tremendous transitions have occurred wherein the City has been
experiencing a rapid growth rate adding approximately 1,000/year.
In terms of physical size, Eagan is a relatively large
community. Corporate limits of the City encompass approximately
34 square miles, or approximately 21,000 acres.
The City of Eagan has designated approximately 3,200 acres
for industrial development, of which an estimated 650 acres has
already been developed. It is recognized that the City has
considerable potential ior industrial development because these
properties are located near major freeways, rail service is
available, public utility service is available and there is a
considerable area of industrial development in Eagan at the present
timewhich tends to attract more industrial development. Three
prominent industrial parks account for about 85% of the industrial
development in the City. These parks are Lhe Cedar Industrial
Park located of Highway 13, the Sibley Terminal Industrial Park
located west of Highway 13, and the Eagandale Industrial Par•k
located in the north central area of the community, generally in
the vicinity of Lexington Avenue and Lone Oak Road. Practically
all industrial development in the City has occurred on platted
property with public improvements. Eagan also has required high
performance standards, particularly during the last 10 years, wherein
landscaping, bituminous surfacing and similar site improvements
have been required. A very large percentage of the industrial
devleopment within the City consists of office and warehouse
facilities.
Commercial development in Eagan has occurred almost exclu-
sively in five general areas of tlze City. At this point, commercial
development is comprised of major retail services at the southeast
quadrant of the intersection of Cedar Avenue and Highway 13
(Cedarvale Development), and a commercial area developed at the
intersection of Yankee Doodle and Pilot Knob .°,oads (Yankee Square
shopping area). The other three commercial areas that exist in the

City can generally be described as the commercial developments
along highway 55, commercial development along Highway 13 and
commercial development along Cedar Avenue.
Residential development in the City of Eagan has also
been reaching new levels each year. Eagan's population is
expected to increase from 20,720 in 1980 to between 30,000 and
40,000 in 1990, depending on the economy. There is a high
concentration of residential development along Pilot Knob Road
between County Roads 30 and 32, and to the east of Cedar Avenue
and north of County Road 30. Although residential development
has tapered off in many areas of the Twin Cities, the Eagan area
is expected to remain strong through the 1980's.
The City of Eagan is well served by churches of all
denominations, public and parochial schools, parks, shopping,
freeways and transportation.
Your appraiser has found Eagan to be a well balanced
community, socially and economically and has found nothing
detrimental that would restrict residentiali industrial or
commercial growth.
Neighborhood Profile
The immediate area in which the subject property is located
consists of approximately 50% undeveloped land and 501/o developed
land. The southwest corner of Wescott Road and Lexington Avenue
is in the process of being developed with new single family
dwellings. The homes are being built by Joe Miller Homes, Inc.
and are being marketed by Edina Realty, Inc. The St. Erancis
Wood Addition is located on the south side of Duckwood Drive
approximately 1/4 mile to the west of Lexington Avenue. This is
a development of custom built single family dwellings ranging in
value from $95,000 to $175,000 and up.
The southwest corner of Duckwood Drive and Lexington
Avenue is an undeveloped 40 acre parcel which is zoned Multiple
Family and is currently for sale by John J. Klein. This parcel
is wooded and rolling.
Windcrest, a development of townhomes, single family
dwellings and twinhomes, is located on the south side of the south
side of Wescott Road, just to the west of the subject property.
Just across Wescott Road from Windcrest is a development bf single
familv homes.

ESTIMATE OF HIGHEST AND BEST USE - BEFORE
It is my opinion, after analyzing the existing zoning
ordinance, adjacent development characteristics, land use patterns,
traffic flows, environment, competitive space and site charac-
teristics, that the highest and best use of the subject property
is as improved with excess land for development as a single
family residential site.
I have considered alternative uses which would be legally
permissible, economically feasible and physically possible, and
have to conelude that the most effective utilization of this site
is its present usage with additional site for single family
residential development.
ESTIMATE OF HIGHEST AND BEST USE - AFTER
It is my opinion, after analyzing the existing zoning
ordinanace, adjacent development characteristics, land use patterns,
traffic flows, environment, compeitive space and site character-

EAGAN PROr^ILE
The City of Eagan is a second tier suburb in the Twin City
Metropolitan Area of Minneapolis/St. Paul. Eagan is located
approximately 10 miles south of the downtown area of the Twin
Cities. Unlike many second tier suburbs, Eagan employs a very
substantial number of its citizens within the corporate limits of
the CIty. In total, Eagan was estimated to employ 14,000 persons
in 1980.
The current population of Eagan is estimated to be 20,720
contrasted with the 1960 Census population of 3,382 and the 1970
Census population figure of 10,398. Until the early 1960's,
Eagan was an agricultural eommunity, but in the past two decades,
tremendous transitions have occurred wherein the City has been
experiencing a rapid growth rate adding approximately 1,000/year.
In terms of physical size, Eagan is a relatively large
community. Corporate limits of the City encompass approximately
34 square miles, or approximately 21,000 acres.
The City of Eagan has designated approximately 3,200 acres
for industrial development, of which an estimated 650 acres has
already been developed. It is recognized that the City has
considerable potential ior industrial development because these
properties are located near major freeways, rail service is
available, public utility service is available and there is a
considerable area of industrial development in Eagan at the present
timewhich tends to attract more industrial development. Three
prominent industrial parks account for about 85% of the industrial
development in the City. These parks are Lhe Cedar Industrial
Park located of Highway 13, the Sibley Terminal Industrial Park
located west of Highway 13, and the Eagandale Industrial Par•k
located in the north central area of the community, generally in
the vicinity of Lexington Avenue and Lone Oak Road. Practically
all industrial development in the City has occurred on platted
property with public improvements. Eagan also has required high
performance standards, particularly during the last 10 years, wherein
landscaping, bituminous surfacing and similar site improvements
have been required. A very large percentage of the industrial
devleopment within the City consists of office and warehouse
facilities.
Commercial development in Eagan has occurred almost exclu-
sively in five general areas of tlze City. At this point, commercial
development is comprised of major retail services at the southeast
quadrant of the intersection of Cedar Avenue and Highway 13
(Cedarvale Development), and a commercial area developed at the
intersection of Yankee Doodle and Pilot Knob .°,oads (Yankee Square
shopping area). The other three commercial areas that exist in the

City can generally be described as the commercial developments
along highway 55, commercial development along Highway 13 and
commercial development along Cedar Avenue.
Residential development in the City of Eagan has also
been reaching new levels each year. Eagan's population is
expected to increase from 20,720 in 1980 to between 30,000 and
40,000 in 1990, depending on the economy. There is a high
concentration of residential development along Pilot Knob Road
between County Roads 30 and 32, and to the east of Cedar Avenue
and north of County Road 30. Although residential development
has tapered off in many areas of the Twin Cities, the Eagan area
is expected to remain strong through the 1980's.
The City of Eagan is well served by churches of all
denominations, public and parochial schools, parks, shopping,
freeways and transportation.
Your appraiser has found Eagan to be a well balanced
community, socially and economically and has found nothing
detrimental that would restrict residentiali industrial or
commercial growth.
Neighborhood Profile
The immediate area in which the subject property is located
consists of approximately 50% undeveloped land and 501/o developed
land. The southwest corner of Wescott Road and Lexington Avenue
is in the process of being developed with new single family
dwellings. The homes are being built by Joe Miller Homes, Inc.
and are being marketed by Edina Realty, Inc. The St. Erancis
Wood Addition is located on the south side of Duckwood Drive
approximately 1/4 mile to the west of Lexington Avenue. This is
a development of custom built single family dwellings ranging in
value from $95,000 to $175,000 and up.
The southwest corner of Duckwood Drive and Lexington
Avenue is an undeveloped 40 acre parcel which is zoned Multiple
Family and is currently for sale by John J. Klein. This parcel
is wooded and rolling.
Windcrest, a development of townhomes, single family
dwellings and twinhomes, is located on the south side of the south
side of Wescott Road, just to the west of the subject property.
Just across Wescott Road from Windcrest is a development bf single
familv homes.

According to a report dated February 22, 1984, by
Bonestroo, Roesene, Anderlik and Associates, Inc., the trunk
water main will include an 18' diameter trunk main from Weseott
Road to Nor-thview Park Road. A 20' diameter trunk main is included
from Northview Park Road to Diffley Road. It is proposed that

SITE DESCRIPTION
The subject site is a 3.85 acre pareel which is most:ly
level with street grade, open and contains some mature trees.
The site was originally a 16 acre site, but approximately eight
acres were sold to the City of Eagan for park land. There is a
66 foot str•ip along the southerly lot line of the subject site
for access to this park land_ The site fronts on South Lexington
Avenue, a blacktopped road. The site is served by electricity.
The reader's attention is directed to the plat map located
on the adjoining page as an aid in visualizing the size, shape
and loeation of the site.
In the before situation, the site is served by blacktopped
road and electricity. In the after situation, the site will be
served by blacktopped road, electricity and trunk/lateral water
main.
DESCRIPTION OF IMPROVENIENTS
The subject site is improved with a detached frame rambler
with two car attached garage. There is an older garage/shed at
the back of the property. The home eontains a total of 1,176
sq.ft. The exterior of the home has an ASM roof, eombination
windows and a concrete block foundation: There are no porches
or decks. The basement of the home is full, has a concrete floor
and is partially finished. Included in the basement finishing
is a half bath. The first floor of the home contains a total
of 17176 sq.ft. and consists of six rooms and one and one/half
baths.
The 24' x 28' detaehed frame garage has a concrete floor,
service door, wood overhead door, and is served by electrieity.
The overall condition of the home and garage is good.
The shed at the back of the site is 14' x 24' with an
8' x 10' addition. The shed is in below average eondition and
has minimal value.
It should be noted that the appraiser has completed only
an exterior inspection of the subject property_ Records from
the Dakot,la County's Assessor's Office were reeiewed to determine
the interior condition, room counts, and mechanical equipment.

METHODOF VALUATION
The preferred way to determine benefits, if any accruing
to a proepty, is by the "before and after" method. Under this
method, which is usually the simplest approach, the value of the
property is estimated in both before and after the installativn
of the trunk water main, the difference between the two being
the benefits accruing to the proeprty. The measure of benefits
is dictated by State law to be the comparative market value of
the property before and after the trunk water main improvement
project.
The apgraiser has analyzed sales of improved properties
in both the before and after situations_ These sales included
properties served by all and/or some utilities and properties
not served by all utilities_ These sales were adjusted ta
reflect physical eharacteristics such as size, shape, date built,
topography, and drainage; zoning and other publie controls such
as setbaek requirements and use restrictions; access; utilities;
finaneing; condition; extras; and, availability. The values
were then determined for the subject property in the both
"before and after" situations. The total parcel size is 3.85
acres. The home is a detached frame rambler containing a total
of 1,176 sq. ft_ The home was constructed in 1973 and is in good
overall condition.

THE COST APPROACH TO VALUE
Thi? portion of the appraisal process analyzes the value of
tPie property through the contribution of the physical members: the
land; the building; and other improvementL to the property. Among
the basic real estate principles reflected in this approach is the
prineiple of substitution which staLes in part that no rational
per4on will pay more for a prop2rty than the amount at which he can
obtain asubstitute of equal desirability and utility through pur-
chase of a3ite and constriction of' a building without undue delay.
The first step in the Cost Approach is to estimate land value.
Ttie land is appraised as though vacant. This analysis recognizes
CYlaL in some caaes the existing improvements do not develop the site
Lo its highest and best use.
The second step involves the estimate of the cost to const-
i,uct the basic improvements in today'ti market. The appraiser recog-
nizes two forms of cost - reporduction cost and replacemerit cost.
Reproduction cost reflects the cost of creating a replica of the
improvememts on the basis of currenL prices, using the same or c1oQe-
ly similar materials. Replacement cost reflects the cost of creating
improvements having the same or equivalent utility on the basiti of
current prices ueing current standards of material and design. In
most case-Q, the measure of cost is the reproduction cost, however,
in some cases identical materials are not available or construction
methods have changed which makes the reporduction cost difPicult to
estimate. In those cases, replacement cost i4 utilized. Unless
otherwiQe specified, this appraisal reflects reproduction cost.
In order to reflect the value of the improvements in their
present condition, accured depreciation, if any, must be deducted.
Drpreciation reflects a loss in value caused by deterioration and/
or obsoletcenee. In many properties, items are present which do not
lend themselves Lo cost less depreciation analysis. In existing
properties such items may include mature trees, shrubbery, land-
scaping, etc. In these cases, the contribution of these iY.ems is
based upon market analysis and reflected as aeparate items in the
C03t Approach.
The remaining step in the Cost Approach is the add:ition of
the land value to the depreciated cost of the improvements and the
contribution of non-cost related items to arrive at an indicator
of value for the subject property.
Reproduction cost is related to an objective value concept.
However, it is improtant to note that cost does not necessarily
create value; value can only be created when certain economic demands
have been satisfied.

LAND VALUE ESTIMATE - BEFORE
1. County Road 30, approximately 112 mile East of Lexington Ave.:
Being the GZ of the Wz of the SE4 and the S 30 rods of' the
E 40 rods of the SW-, of the NEr1+ of Section 23. This was a47.5
acre parcel which sold in March of 1981 for $261,500.00. or $5,500/
acre. The sell°r was Slater and the buyer was Independent School
District #,96, Zoning was agricultural. The site was gently
rolling with some wooded areas. No utilities were available.
This was to be part of the future high school site for the
Rosemount School District_
2. County Road 30, approximately 112 mile East of Lexington Ave.:
Being the WZ of the W2 of the SW?, and part of the Wlf of
the WZ of the NE4 of Section 23. Sold in March of 1981 for
$255,750.00 or $5,500/acre. This was a 46.5 acre site which was
zoned Agricultural and was gently rolling with some wooded areas.
The buyer was Independent School District #196 and the seller was
Edwin Herrmann. No utilities were available. The site was part
of an assemblege for the Rosemount High School site.
3. East side of Pilot Knob Road, north of Deerwood Drive;
Being part of the SE4 of the NE4 of Section 22, Township
17, Range 23. This was an irregular shaped 8.46 acre parcel which
had approximately 367 feet of frontage on Pilot Knob Road. The
buyer was Eagan Grove Company. The parcel was below the grade of
Pilot Knob Road, gently rolling and it had some wooded areas.
Water was available along Pilot Knob Road while sanitary sewer
was in the area. There is no storm sewer.
4. East end of Deerwood Drive, 112 mile east of Pilot Knob Road:
Being the N 3601 of the W4 of the SE4, Section 22, Township
27, Range 23, except the E 330_2' thereof and subject to Deerwood
Drive. This is a 5 acre parcel which was purchased by Ron and
Kathieen Boil from Tom and Barbara Rooney in November of 1979 for
$35,000.00 or $7,000/acre. At the time of purchase, the zoning
was agricultural. The site was served by electricity and road
only.

5. West side of Lexington Avenue, approximately 112 mile NE of
MeCarthv Lake
Being the N 365' of the S 993' of the 470' of the SE'r. of
the NE', of Section 22, Township 27, Rnage 23. Sold in December
of 1981 for $57,695.00 or $11,500/acre. This was a 5.017 acre
pareel whieh was rectangular in shape but was not served by any
utilities_ Water was in the general area. This was a cash sale
with the buyer being the Board of Trustees of United Methodist
Church and the seller being Lexington South, Ine.
6. Southwest corner of Lexington Avenue and Wescott Road:
Being the Nerly 51 acres of the E'z- of the NE4 of Seetion
22. Sold in December of 1983 for $642,000.00 or $12,588/acre.
The buyer was Gabbert developement and the seller was Lexington
South, Inc. This was a 51 aere parcel which was zoned R-1 and
P.U.D. The property was served by all utilities with the excep-
tion of sanitary sewer. The topography was gently rolling with
some steep slopes. The buyer assumed special assessments of
approxiamtely $30,000 for water main and laterals. Sanitary
sewer was expected to be available to serve the property in 1984.
The buyer will pay the special assessments for sanitary sewer.
The property is expected to contain a total of 129 single family
lots.
7. Southeast corner of Lexington Avenue and Wescott Road:
Being part of the NW4' of Section 23. Sold in Deeember of
1983 for $1,584,000.00 or $12,000/acre. This is a 132 acre pareel
which was zoned R-1 and P.U.D. The buyer was Northland Mortgage
Company and the seller was Lexington South, Inc. All utilities
were available with the exception of sanitary sewer which was to
be installed in 1984. The parcel was mostly flat and open. The
buyer is currently platting the property into approximately 330
single family lots. The buyer has agreed to pay all assessments
relating to the installation of sanitary sewer. Galaxy Road, at
its frontage, is not improved but is a gravel road with the
improvements being ehargedto the development.
Your appraiser has reviewed and visibly'inspeeted many
comparable land sales and offerings which are in the immediate
and general areas. Land sales in competitive areas were also
analyzed_ Adjustments for the sales reported herein were made
to reflect physical considerations, location attributes, zoning
considerations, access, topography, utilities and financing.
The previously reported sales, along with other sales that have
been analyzed indicate a value in the before situation to the

The reader's attention is directed to the plat map located

and loeation of the site.
In the before situation, the site is served by blacktopped
road and electricity. In the after situation, the site will be
served by blacktopped road, electricity and trunk/lateral water
main.
DESCRIPTION OF IMPROVENIENTS
The subject site is improved with a detached frame rambler
with two car attached garage. There is an older garage/shed at
the back of the property. The home eontains a total of 1,176
sq.ft. The exterior of the home has an ASM roof, eombination
windows and a concrete block foundation: There are no porches
or decks. The basement of the home is full, has a concrete floor
and is partially finished. Included in the basement finishing
is a half bath. The first floor of the home contains a total
of 17176 sq.ft. and consists of six rooms and one and one/half
baths.
The 24' x 28' detaehed frame garage has a concrete floor,

The overall condition of the home and garage is good.

METHODOF VALUATION
The preferred way to determine benefits, if any accruing
to a proepty, is by the "before and after" method. Under this
method, which is usually the simplest approach, the value of the
property is estimated in both before and after the installativn
of the trunk water main, the difference between the two being
the benefits accruing to the proeprty. The measure of benefits
is dictated by State law to be the comparative market value of
the property before and after the trunk water main improvement
project.
The apgraiser has analyzed sales of improved properties
in both the before and after situations_ These sales included
properties served by all and/or some utilities and properties
not served by all utilities_ These sales were adjusted ta
reflect physical eharacteristics such as size, shape, date built,
topography, and drainage; zoning and other publie controls such
as setbaek requirements and use restrictions; access; utilities;
finaneing; condition; extras; and, availability. The values
were then determined for the subject property in the both
"before and after" situations. The total parcel size is 3.85
acres. The home is a detached frame rambler containing a total
of 1,176 sq. ft_ The home was constructed in 1973 and is in good
overall condition.

THE COST APPROACH TO VALUE
Thi? portion of the appraisal process analyzes the value of
tPie property through the contribution of the physical members: the
land; the building; and other improvementL to the property. Among
the basic real estate principles reflected in this approach is the
prineiple of substitution which staLes in part that no rational
per4on will pay more for a prop2rty than the amount at which he can
obtain asubstitute of equal desirability and utility through pur-
chase of a3ite and constriction of' a building without undue delay.
The first step in the Cost Approach is to estimate land value.
Ttie land is appraised as though vacant. This analysis recognizes
CYlaL in some caaes the existing improvements do not develop the site
Lo its highest and best use.
The second step involves the estimate of the cost to const-
i,uct the basic improvements in today'ti market. The appraiser recog-
nizes two forms of cost - reporduction cost and replacemerit cost.
Reproduction cost reflects the cost of creating a replica of the
improvememts on the basis of currenL prices, using the same or c1oQe-
ly similar materials. Replacement cost reflects the cost of creating
improvements having the same or equivalent utility on the basiti of
current prices ueing current standards of material and design. In
most case-Q, the measure of cost is the reproduction cost, however,
in some cases identical materials are not available or construction
methods have changed which makes the reporduction cost difPicult to
estimate. In those cases, replacement cost i4 utilized. Unless
otherwiQe specified, this appraisal reflects reproduction cost.
In order to reflect the value of the improvements in their
present condition, accured depreciation, if any, must be deducted.
Drpreciation reflects a loss in value caused by deterioration and/
or obsoletcenee. In many properties, items are present which do not
lend themselves Lo cost less depreciation analysis. In existing
properties such items may include mature trees, shrubbery, land-
scaping, etc. In these cases, the contribution of these iY.ems is
based upon market analysis and reflected as aeparate items in the
C03t Approach.
The remaining step in the Cost Approach is the add:ition of
the land value to the depreciated cost of the improvements and the
contribution of non-cost related items to arrive at an indicator
of value for the subject property.
Reproduction cost is related to an objective value concept.
However, it is improtant to note that cost does not necessarily
create value; value can only be created when certain economic demands
have been satisfied.

LAND VALUE ESTIMATE - BEFORE
1. County Road 30, approximately 112 mile East of Lexington Ave.:
Being the GZ of the Wz of the SE4 and the S 30 rods of' the
E 40 rods of the SW-, of the NEr1+ of Section 23. This was a47.5
acre parcel which sold in March of 1981 for $261,500.00. or $5,500/
acre. The sell°r was Slater and the buyer was Independent School
District #,96, Zoning was agricultural. The site was gently
rolling with some wooded areas. No utilities were available.
This was to be part of the future high school site for the
Rosemount School District_
2. County Road 30, approximately 112 mile East of Lexington Ave.:
Being the WZ of the W2 of the SW?, and part of the Wlf of
the WZ of the NE4 of Section 23. Sold in March of 1981 for
$255,750.00 or $5,500/acre. This was a 46.5 acre site which was
zoned Agricultural and was gently rolling with some wooded areas.
The buyer was Independent School District #196 and the seller was
Edwin Herrmann. No utilities were available. The site was part
of an assemblege for the Rosemount High School site.
3. East side of Pilot Knob Road, north of Deerwood Drive;
Being part of the SE4 of the NE4 of Section 22, Township
17, Range 23. This was an irregular shaped 8.46 acre parcel which
had approximately 367 feet of frontage on Pilot Knob Road. The
buyer was Eagan Grove Company. The parcel was below the grade of
Pilot Knob Road, gently rolling and it had some wooded areas.
Water was available along Pilot Knob Road while sanitary sewer
was in the area. There is no storm sewer.
4. East end of Deerwood Drive, 112 mile east of Pilot Knob Road:
Being the N 3601 of the W4 of the SE4, Section 22, Township
27, Range 23, except the E 330_2' thereof and subject to Deerwood
Drive. This is a 5 acre parcel which was purchased by Ron and
Kathieen Boil from Tom and Barbara Rooney in November of 1979 for
$35,000.00 or $7,000/acre. At the time of purchase, the zoning
was agricultural. The site was served by electricity and road
only.

5. West side of Lexington Avenue, approximately 112 mile NE of
MeCarthv Lake
Being the N 365' of the S 993' of the 470' of the SE'r. of
the NE', of Section 22, Township 27, Rnage 23. Sold in December
of 1981 for $57,695.00 or $11,500/acre. This was a 5.017 acre
pareel whieh was rectangular in shape but was not served by any
utilities_ Water was in the general area. This was a cash sale
with the buyer being the Board of Trustees of United Methodist
Church and the seller being Lexington South, Ine.
6. Southwest corner of Lexington Avenue and Wescott Road:
Being the Nerly 51 acres of the E'z- of the NE4 of Seetion
22. Sold in December of 1983 for $642,000.00 or $12,588/acre.
The buyer was Gabbert developement and the seller was Lexington
South, Inc. This was a 51 aere parcel which was zoned R-1 and
P.U.D. The property was served by all utilities with the excep-
tion of sanitary sewer. The topography was gently rolling with
some steep slopes. The buyer assumed special assessments of
approxiamtely $30,000 for water main and laterals. Sanitary
sewer was expected to be available to serve the property in 1984.
The buyer will pay the special assessments for sanitary sewer.
The property is expected to contain a total of 129 single family
lots.
7. Southeast corner of Lexington Avenue and Wescott Road:
Being part of the NW4' of Section 23. Sold in Deeember of
1983 for $1,584,000.00 or $12,000/acre. This is a 132 acre pareel
which was zoned R-1 and P.U.D. The buyer was Northland Mortgage
Company and the seller was Lexington South, Inc. All utilities
were available with the exception of sanitary sewer which was to
be installed in 1984. The parcel was mostly flat and open. The
buyer is currently platting the property into approximately 330
single family lots. The buyer has agreed to pay all assessments
relating to the installation of sanitary sewer. Galaxy Road, at
its frontage, is not improved but is a gravel road with the
improvements being ehargedto the development.
Your appraiser has reviewed and visibly'inspeeted many
comparable land sales and offerings which are in the immediate
and general areas. Land sales in competitive areas were also
analyzed_ Adjustments for the sales reported herein were made
to reflect physical considerations, location attributes, zoning
considerations, access, topography, utilities and financing.
The previously reported sales, along with other sales that have

The ridge needs to be at least a 2 X 8 so that the rafter plumb cuts are supported for the full length of the cut. The detail
did not address the birds mouth cuts on the rafters where they intersect with the exterior wall top plates. Also there
should be a bearing point below the ridge at the wall line of the existing wall line.
I will be out of the office for the next two days at a building code seminar. We can discuss the framing details of the roof
construction on Friday. Call me.
