The eatisting septic syatem for this hame is a septic tmilc and a dry well. This
system is failing. Thece are future pians of adding an addition at the reat of the house,
with another bedroom. The new system is being sized for the «isting 3-bcdrooms, hut
enough space remains in the test area to add up to 100 feet of drain field for the new
addition.
The soil throughout the baclryard is fine saud, but mottling does occur at 4 feet
and below. We will be ahle to install l-foet decp trenches that ate fed by gravity. 1fic
left over fine loamy sand from the yard will rieed to be added, abnut 1 foot deep> over the
trenches. An additional3-4 inches of loam topeoil or siiniiar soil witl need to be added
on top of this sand to preveat erosion. Immediatsly after the drain field is installed, the
area should be soddeci or seeded so that there is protection from erosion in the spring.
Trenches are designed to be at least 10 feet from any lot line and at least 20 feet
from any bui3ding. The house,now-uses a rauniaipalwata snpplY and the old well is
greater than 50 feet fram any part of this ,system. ,
The locarion of the new,septic tanks, is impoitaut so that thty maintain a 10', set
back from the new addition to t'he honsa whcn it is biri1G Ff the installer is unabla to get
cast coacrere tanks into this area; lightweight tanka could be usod. Low profilt
chambered drain field could be used, instead of the mck system.
This design is prepazei in accordance to Daknta County Ordinance #113 and
should be presented to the city of Fagan as early as possiblo fvr inspection. All stakes
shall be ]efl m place until thia systan is installed and all soil samples shall be loft ia place
until the system is 3nstalled

I am calling this letter to your attention since there is a
disagreement with Mr. Houck who lives at 4045 Lexington Ave S.
regarding the assessments on his property. I expect that he will
desire to appeal the matter to the City Council. He is in the
process of selling the property.
Mr. Houck appeared before the City Council at the time Project
395 was approved expressing concerns about the project and was
assured (his position) that he would receive a senior citizen
deferrment since he was 65 years old and that he had nothing to
worry about relative to these assessments. Upon review of the
property records staff noted that the property is Green Acres. I
then responded that the assessments for both projects were
deferred based on the Green Acres status and a senior citizen
deferrment was not necessary.
With the pending sale, Mr. Houck requested a search of the asses-
sments which revealed that a principal amount of $39,956.99 and
an interest amount of $6,223.18 woud be required to pay the
assessments in total. This interest is calculated from the time
the assessments were certified through the year of collection.
It is Mr. Houck's contention that a senior citizen deferrment
would have meant that no interest would be charged. It is my
understanding that there are no interest fee deferrments granted
by the City. Previous parcels removed from the deferred status
have paid interest. Occasionally, assessments are postponed by
agreement to be levied later at a higher rate. These postpone-
ments do not carry an interest charge.
Unless there is something here that I am not aware of, I do not
think he has a legitimate argument, however, since the potential
is there, I call it to your attention.

The next hearing convened by the Mayor concerned the proposed vacation of
the ponding easement covering the Holmes Addition property. Mr. Colbert
c?xplained the proposal and noted that a ponding easement had been aequired in
iq•;2 over part of the land and he recommended that the Council approve the
v ,Ir.ation covering the two lots in Holmes Addition. There were no objections.
Wachter moved, Egan seconded the motion to close the hearing and approve the
vacation of the ponding easem ent. All members voted yes.
LE%IAGTON AVENDE - ASSESSMENT HEARIING
The next hearing convened by the Mayor related to the assessment roll for
`Lexington Avenue trunk watermain improvements. Mr. Colbert reviewed the
?assessment roll with the Council and a letter was submitted on behalf of
Lillian MeCarthy, one of the owners affected, objecting to the assessments
relating to her property. After diseussion, Egan moved, Wachter seconded the
motion to elose the hearing and to approve the assessment roll with the
'exception of the Lillian MeCarthy property, which hearing on the MeCarthy
'?.property assessments is continued until the March 19, 1985 regular meeting.

The next publie hearing convened by the Mayor concerned Project #396
relating to Westbury lst and 2nd Addition street and utility improvements.
":Notices were mailed to all affected property owners and Mr. Colbert stated
that there were revisions from the estimates because a number of duplex and
single family lots had been revised. He also recommended, after review with
.?the City Attorney, that the Pat MeCarthy property assessment be eliminated
? from Project #396, noting that objections had been received from Mr. MeCarthy
and based upon lack of alleged benefits. Smith moved, Thomas seconded the
? motion to close the hearing and to approve the assessment roll with the
telimination of the Pat MeCarthy property, Parcel No. 01104. All voted yes.
LEXINGTON SQUARB - FINAL ASSESSMENT AEARING
The hearing regarding Project #401 concerning Lexington Square sanitary
and storm sewer trunk assessments was then convened by Mayor Blomquist. Tom
Colbert explained the assessment roll and indicated there were 130 pareels to
be assessed over 15 years at 11% interest. There were no objections and

assessment roll and authorize it to be forwarded to the County Auditor for

The final assessment hearing regaraing Project #410 relating to trunk '
storm sewer outlet assessments along Lone Oak Road came to the Council.
Marvin Post appearea on behalf of Mary Post and -requested information
regarding senior citizen exemption for Mary Post. There were no objections. Wachter moved, Egan seconaed the motion to close the hearing and to approve
the assessment roll ana authorize certification to Dakota County for
collection of assessments to be apread over 15 years at 11% annual interest.

BIRCH PARK ADDITION - PATRICR EAGAN PARR - PgOJECT #411
FINAL ASSESSMENT HEARING
The public hearing for Project #411 covering trunk storm sewer outlet in
the Birch Park Addition-Patrick Eagan Park area was next convened by Mayor
Blomquist. Tom Colbert detailea the assessments and a number of affected
property owners were present in the auaience. Specific appearances related
to the following property owners: '
1. Patrick McCarthy, Deerwood Drive, objections filed.
2. Lillian McCarthy, Lexington Avenue, objections filed.
3. Donald Vogtman who stated there was no benefit from the storm sewer
improvement, objections filed.
4. Darrel Saska on behalf of Victor and Sharon Staff covering Lot 5,
Block 1, Skovdale 2nd Aduition and filed objections. Mr. Baska was present
and stated the water level had increased ciramatically and that 1/2 to 1 acre
of property had been inundated, fle recommended the Council defer the
assessments and requested resolution of the legal action also being brought
against the City.
5. Robert Honsa. Mr. $onsa was present and explained that he owned 1 1/2
acres on Deerwood Drive and 2.6 acres to the north. He requested that time be
granted to him to combine the two parcels, and filed objections.
6. Sienna Corporation. Rod Hardy appeared and had certain questions
concerning assessments. -
7. Miriam Nali appeared and objected to the proposed Agreement submitted
by the staff regarding the assessments over the Nall property and it was noted
that the Agreement can be enterea Into within 30 days of the approval of the
roll, or in the event that the Agreement is not entered into, the full
assessment will then be levied against the property.
8. Tom Bergin property, Deerwood Drive, assessmenta being deleted.
9. Ronald Boyle property, Deerwood Drive, filed objections. ,

requeats..for the:1986:general fund buaget. Seventeen divisions comprise the
general fund budget, with approximately 10 different departments. The total
. requests were for $7,617.110.00 and the budget was modified to $6,609,470.00.
' The buaget at the present time is being considered at $6,200,000.00 with the
1985 budget.of $5,121,640.00. The extremely rapid growth within the City was
noted by Mr: Hedges and there were no comments from members of the audience.
Councilman Wachter moved, Councilman Egan seconded the motion to close the
hearing regarding the budget. All voted in favor.

Councilman Egan moved, Wachter seconded the motion to adjourn the City
