was distributed on Tuesday, January 21, 1986, at the last regular
City Council meeting. Th2 issues that are raised in your letter
are being addressed by the City's Engineering Department and
insurance carrier.
Your contact person at the City of Eagan is Tom Colbert, Director
of Public 49orks, who will be coordinating this matter with the
contractor's insurance carrier and you as the property owner.
Unfortunately, these type of claims always take time when the
City is relying on third parties such as the contractor, the
contractor's insurance carrier and the City's own insurance

ATTACHMENT A--PROBLEM SUMMARY
The problems detailed in this paper have ultimately been
caused by two projects: 395 (Water Main and Booster 5tation)
and 411 (Storm Sewer). We have been initially impacted by these
projects by being inconvenienced during construction, subjected
to tree damage along Lexington property boundary, and subjected
to water and silt damage that poured down our driveway in last
Spring's (1985) thaw due to a blocked storm sewer drain. We
have been affected again with the recent water main leak. Not only
have all the following issues originated with these two projects,
but we have been assessed approximately $23,000.00 to help pay
for them and have seen no benefit what-so-ever: This has required
us to sell off our acreage and forced us to consider moving.
We have been in Eagan for 16 years, have built a home here, and
ha.ve totally enjoyed living in the City of Eagan--up to this point.
We feel we have been subjected to substantial damage due to
negligence on the part of the City of Eagan and Lametti and Sons
Construction Company in failing to shut off the water and quickly
repair despite notification from us. We feel we have been
victimized and this total incident has been an infringement on
our privacy. We feel that we should not have to spend the time
or energy to rectify this situation in addition to any financial
loss we have had or will incur. Our position to reach a satisfactory
conclusion is detailed in Attachment C.

ATTACHN!ENT B--IlETAILED ACTIVITIES
Week of 12/9/85 •
Eric noticed snow melting in one area of the yard,
12/13/8$-Friday
Early in the morning we discovered a water leak from the ground.
Water was running down our property toward the garagQtaround and
down under our parked camper, across the garden area and down
through the rest of our property. Debbie called the City of Eagan
immediately and reported the problem. They sent a Water Department
agent out to investigate. He looked at the problem, talked to
Debbie at the house, and said the problem couldn't be fixed on
that day. There was no action to shut off the water in the 20"
trunk and the water continued to run.
12/14/85--Saturday
We discovered later on (12/18/85--Wed.) that the Water Department
reported the problem to the installation contractor, Lametti and
Sons. Mike Olsen, employed by Lametti and Sons, came to our
address to investigate the problem. He did not come to the house
nor did we talk with him. He did move snow around to direct the
water drainage path on our property. Water continued to pour
from the break by Lexington down our land by the garage and under
our camper which was stored for the winter. We talked with our
neighbor, Butch Siedschlaag,(the only person that would have been
affected nad the water been shut off) on Sat. evening and he stated
that the contractor was going to expose the pipes and fix the
problem at 10:00 Monday morning.
12/15/85--Sunday
Water continued to run at the rate of approximately a bathtub

nozzle discharge with the shut-off lmobs wide open. We noticed a
large backhoe was brought in place south of our property,
12/16/85-Monday
No aetion or activity. We were told later on Wednesday by Mike Olsen
that they could not get the backhoe started. We were also told
by one of the workers (Lamar) that Lametti and Sons has a company
policy that they don't operate the backhoe heavy eVuipment if it is
below zero and that it takes one year off the eIuipment life for
every 10 degrees below zero.
12/17/$5--Tuesday
The water continued to run--no action by anyone.
12/18/85--Wednesday
Our garbage was picked up and they noticed the problem. They
flagged down an Eagan policeman who came to our house at around
2:00 P.M. He knocked on the door and notified Debbie that the ground
under our camper had caved in and the camper was sliding down our
hill:: Debbie was told to call the Water Department to get the
water shut off. While she was talking to Paul Hower on the
telephone,the police radioed the same message to city hall.
Debbie called Eric at work at 2:30P.M. and he came home. On the
way home north of our home approximately 4 mile on Lexington,
Eric noticed the water department turning off the water and it was
starting to shut off when he arrived. Eric met the policeman and
Dennis Postler (Independent Consulting Engineer). Trees were
falling and the camper was moving while we talked. The water
stopped and the camper was into the ditch resting on it's axle.
Many trees were uprooted. The ditch was about 8-9 feet across

and about as deep. The garage foundation was cracked. We called our
insurance agent, Mel Hansen. Paul Hower showed up. Paul said
it was going to be totally repaired by the contractor, Lametti.
We were to file a claim in the Spring with the city and they
would get reembursement from the contractor's insurance. We should
talk with Ed Kirsh about filling the ditch or getting compensated for
the storm sewer run-off. Our ditch was getting bigger and deeper
since the storm sewer was hooked to the conduit. Mike Olsen and 2 othtr
men came out at around 5:00. One of the men looked at the garage
inside to see the cracked foundation. He said there was major
damage. Mike Olsen left to talk with the city. We called the
consulting engineer Dennis Postler later to find out the status.
He said Mike was making arrangements to put up the Siedschlaag
family in a motel. They were the only ones affected by the
city shutting off the water. We are still on our own well system.
Dennis called and asked if it would be all right to fix the break
in the morning (Thurs.) instead of that night (Wed.). We agreed
if they would fence off the cave-in from the children. They did.
12/19/$5--Thursday
We called Mayor Bea BlomTuist that evening. She said she would
come out Friday.
12/20/85--Friday
We were to meet the Mayor and Tom Hedges at 3:30. Tom called
Debbie earlier and said their schedule would not permit the meeting
to occur at that time. Two insurance agents, Martin Lee and
an associate reviewed the damage at 5:30.

Tom Hedges and Dale Peterson came out to inspect the damage.

1/4/86--Saturday
At 9:30 A.M. Corky and Mike from Shortie's Towing came out with
a tow truck w'recker and a flat bed. The ended up hooking 3
cables to the trailer to pull it out. They had a difficult time
getting up the hill and out of the driveway. Damage was at least
as follows:
-Rear bumper and bike carrier bent up.
-The plywood floor was separated from the frame by about an inch
on the left side above the wheel.
-The left wheel would not turn.
-The axle was about 2inch higher in the middle than in the sides. It
was bent up.
-The rear 1. to 2 of the fraMe members were bent in various way.
-The lower left corner was pushed in.
-The front had dents and was caved in on the right side.
-Both front right and left lights were broken.
-The top vent was broken and was opened to the air.
-Our tarp cover was pinched between the ground and the trailer
and was ripped up.
-Our grass was torn up by spinning truck tires.
-The right side looked like it was dented.
Damage that needed investigation:
-Water damage on the inside.
-Fitting of the top as it closes. Did it get warped?
-Gas line, secure, tight and does the furnace/stove work properly?
Will the camper ever ride or pull the same?
-Did the third wheel crank-up tube get bent?

house at about 1:30 P.M. They investigated the damage. John
£arsen and Bob Obe?meyer from Barr Engineering came out to inspect
the damage.

ATTACHMENT C--ISSUES AND PROPOSED SOLUTIONS
This attachment contains our issues that are of concern to date.
With each one are our proposed solutions that would bring the issue
to a satisfactory conclusion.
Issue No.l--Loss of our Camper
Our camper was a total loss as estimated by Hilltop Trailer Sales
on 1/9/86. We feel the camper is worth much more than what
Lametti's insurance will pay. Also we do not feel we should have
to bear the burden of securing another trailer. In addition,
any used replacement trailer will always have it's own
unit e set of problems.
One trip to Hilltop Trailer Sales has been made and it is anticipated
that 3 more will be necessary before the issue is closed. A
tarp covering the camper was also torn up in retrieving the camper
from the ditch.
SOLUTION: We should recieve a new trailer of comparable size.
Lametti's insurance should pay for this, or as the city is as
negligent as Lametti in not turning off the water in the first
place when it was reported, the cities' insurance should make up the
difference to buy a new trailer. Reimbursement should also include
trips made to Hilltop Trailer Sales in Colombia Heights necessary
to resolve the issue at the current gvt. mileage rate. In addition
the tarp should be replaced or a comparable dollar value be

. 2--Land Washout and Loss of Ground Cover Under the Path
e Water
The land caved in and washed down into the main ditch south of
our house that is being used for storm sewer drainage off Lexington.
The area washed is approximately 8-10 feet wide, 8 feet deep,
and 60 feet long with it being larger at the main ditch, The

washout included a garden area.
SOLUTION: The land should be restored to original condition with
terracing or retaining walls to prevent erosion in the Spring.
Black dirt should be brought in to restore the garden area.
Issue No. 3--Loss of Trees
Approximately 30 trees were consumed by the washout. They were
a mixture of birch/oak/pine ranging from 10 to 20 feet in size.
SOLUTION: The trees should be replaced or a comparable dollar
value be granted.
Issue No. 4--Yard Dama e
Between the water running, the unearthing of the water main,
and the wrecker pulling out the trailer the sod was destroyed
in the yard.
SOLUTION: The area should be resodded.
Issue No.S: Garage Foundation Crack
The east garage wall foundation cracked as a result of this
incident. It was caused by either the ground collapsing south
of the garage weakening the footings, or water moving underground
under the footings, freezing, and lifting the footing. The garage
foundation will never be as it was originally.
SOLUTION: An estimate of the repair be made and repair authorized
or if the repair is not recommended a comparable dollar value be
granted.
Issue No. 6--Future Tree and Ground Cover Loss
When the washout occurred all the soil went into the main ditch
filling it approximately 10 feet. This has covered the bark of
approximately 10 birch trees ranging in size from 10-30feet in height
with some as large as 8 inches in diameter. Also groundcover
was lost all along the main ditch toward McCarthy Lake,

This will contribute to the erosion and instability of the north
bank supporting the house structure.
SOLUTION: Either the solution in Issue No. 8 be implemented or
if the loss occurs the trees be replaced or a comparable dollar
value be granted.
Issue No. 7--Increased Amount of Water Drainage in the Main Ditch.
When the storm sewer on Lexington was installed it was connected
to the conduit pipe that directs water into our main ditch. The
amount of water coming into the ditch has increased dramatically since
the storm sewer was installed. This has caused our main ditch
to become deeper and wider eroding the north bank supporting
the house structure. We have already lost one 30 year old oak tree
because of this erosion.
SOZUTION: Either the solution in issue 8 be implemented, or a
dollar value be granted for the tree loss and for the right to have
main storm sewer drainage on private land.
Issue No. 8--Potential North Bank of Main Ditch Collapse
The septic system of the house is located on this bank. It
saturates the ground similar to the water leak by the garage.
As the main ditch further erodes getting closer to the house,
and as the septic system is saturating the ground,there is a
good chance that the North bank of the main ditch will collapse
endangering the house.
SOLUTION: The conduit feeding the main ditch should be extended and ?.
the ditch filled in. mhis will stabilize the ground south of
the house.
Zssue No. 9: Future Ground Collapse Due to Cavities Created Underground
As the pressurized water fan for more tha.n a week it is a possibility
that the water traveled not only above ground but also below
creating different cavities. Ground collapse could occur in

the future because of this causing future damage to the grounds,
driveway, and even the ga.rage itself.
SOLUTION: This issue should remain open.
Issue No. 10: Miscellaneous Items
To record the incident we shot 3 rolls of film and made copies of
pictures.
SOLUTION: Reimburse the cost of film and developing.
Issue No. 11: Disruption In Our Lives
This incident has caused a tremendous amount of distuption including
loss of work, sleep, increased stress, anxiety, tension, concern,
and much time and frustration spent making phone calls and dealing
with different insurance and city representatives. We feel
very much victiiized. Not only do we feel upset about what
happened, but what might have happened as our children spent
time playing around the camper, curious about the water, the

Dear Rich:
This letter is in response to your instructions of April 4 that we prepare a
cost estimate for the work necessary to construct a storm sewer on the
Spring's property.
This issue is more complicated than it may appear. From your letter I presume
that we are to do a simple estimate without detailed study of the situation.
This has been done and the results of the estimate are provided in the follow-
ing paragraphs of this letter. However, we believe that there are viable and
possibly more cost effective alternatives to a pipe through the Spring's pro-
perty which should be evaluated before proceeding.
To briefly summarize our thoughts, we believe that the future improvements of
Lexington Avenue will include the construction of storm sewer to pick up a low
point somewhere in the vicinity of the Patrick Eagan Park entrance or somewhat
southerly. This would mean that storm water could be diverted from the ravine
on the Spring's property and instead be discharged into the trunk storm sewer
that is planned to drain ponds JP-34 and JP-29 into 7P-9 (copy of map is
attached for reference). This should require no more than 950 feet of pipe
which is somewhat less than would be necesary to install pipe down the
Spring's ravine all the way to JP-9. This scheme has the advantage of pro-
viding additional benefit to the drainage of Lexington,Avenue and has poten-
tial to serve as the route for the pipe that is planned to drain JP-29. As
such there could be cost savings realized by having one dual purpose pipe
route rather than having two smaller size pipe routes.

The purpose of my discussion of this is not so much to say that we should
immediately install pipe in Lexington (although I- think this should be con-
sidered), but to support our opinion that the drainage of storm water through
the Spring's ravine may be a temporary problem and as such only requires a
temporary solution which would cost less than a permanent installation. For
example, a 12" PVC pipe laid to shallow grade without our standard concern for
straight lines and consistent grade would adequately drain the water that
presently flows through the ravine. When the County improves Lexington this
PVC pipe could be abandoned and water could drain through the pipe in
Lexington as I proposed in the previous paragraph.
This temporary solution has the advantage of least cost because there would be
shallow excavations and PVC at this size is cheaper from a material price and
handling cost standpoint. Lt would require less tree removal to.install and
this procedure lends itself to terminating the pipe at Spring's property line
rather than constructing the line all the way to JP-9 as will eventually be
necessary.
The permanent _solution to the problem, should the City decide to install pipe
through the Spring's ravine, would require the construction of a 15" RCP to
standard construction standards.
Following is a aummary of our cost estimates which were based upon the pre-
viously described criteria.

would have to spend to install a pipe down Spring's ravine would be better
spent on the alternative of constructing a pipe in Lexington Avenue as pre-
viously described. I have not studied this alternative in detail because I
feel it is outside the scope of your instructions. However, if you or Tom
agree that this alternative has potential merit you could order such a study.
I'm thinking that at this time it could be easily added to the study of the
trunk storm sewer project for Hilltop and Evergreen Park Additions (Project
473).
After you have had a chance to study this information let's discuss how we
should,proceed. We should get Ken Vraa and Steve Sullivan involved in this at
this time.

incurred by Mr. and Mrs. Eric Spring, I have scheduled a meeting
to be held at 9:00 a.m. on Friday, March 21, at Eagan City Hall,
requesting all parties noticed on the attached mailing list to be
in attendance.
I think it would be beneficial to get all parties together so we
can discuss the appropriate action necessary by the various in-
dividuals to ensure a timely resolution to the claim.
If for some reason you are unable to attend, please ensure that an
appropriate representative of your respective organization can be

In response to your request, enclosed please find a copy of
the specifications and documents assosciated with our formal
contract with Lametti & Sons,_?Inc., for the installation *of
the water main across the front of the Spring property on Lexington
Avenue, which subsequently incurred a leak resulting in their
damage claim.
The warranty provisions are delineated under Sections 7.7 and
7.13 of the "Conditions of the Contract" (green section). You
will note that paragraph #23 of the "Special Provisions" (gold
section) extends the warranty to two years after "substantial
completion". While substantial completion is not defined in
the contract documents, it could be argued that it is from the
date when the line could be placed in operation. Through our
inspection and test records, the date of substantial completion
is identified as September 20, 1984.
If you need specific information pertaining to notification
to the City and the time frames of our reaction and related
courses of action, I would like to involve Mr. Joe Connolly,
Superintendent of Utilities, and Mr. Jerry Bourdon, Consulting
Project Engineer, who were directly involved in coordinating
the repair work to be performed by Lametti & Sons, Inc.
If any additional information or clarification is necessary,
please contact me for a prompt response. The City is quite
anxious to initiate whatever action is necessary to resolve
this claim in the best interest of all parties concerned. Your
anticipated cooperation and assistance will be greatly appreciated.

Recently, the City received the attached claim from the owners of
the above-referenced property referencing damages incurred result-
ing from a watermain leak that occurred during the middle of
December. This claim is unique in the fact that the problem was
covered under the warranty provisions of our contract agreement
with Lametti & Sons under City Contract 84-9. Although our
contractor was responsible for the repair work, his delay resulted
in the additional damage that has resulted in this claim.
I would appreciate it if you would inform me as to how best to
process this claim through both the City's insurance carrier,
while taking into consideration the contractural warranty liabili-
ties of Lametti & Sons, Inc.
I have been contacted by the Insurance Representative for Lametti
& Sons who would like to schedule a joint meeting to try and
resolve the claim.
I would appreciate your response and direction as soon as possible
so that we can respond in a positive manner to this property owner.

determine the condition or the performance of the referenced disposal
system.
The interior plumbing did meet existing codes when the dwelling was constructed.
