SUMMARY/CONCLUSION
A 404 sq. ft. addition to an existing 426 sq. ft. remote utility building, which houses telephone
switch and battery back-up equipment, is proposed. The applicant is requesting a 20-foot
Variance to the required 50-ft. front yard setback on a county right-of-way. In addition,
Variances of 11 feet and 17 feet to the required 30-foot side yard setback are requested, to allow
the addition to be constructed with the same side yard setbacks as the existinJ building.
The property is currently unplatted. Plattinc, is required for any construction to take place on the
site. In reviewing the site for platting, the County has requested an additional 15 feet of right-of-
way. The County has also found the current access drive to be in violation of County spacing
guidelines, and requested it to be relocated if at all possible. While alternate access to the site is
provided via an existing easement and access drive over adjacent City property, this easement
should not provide sole access to the Qwest property.
ACTION TO BE CONSIDERED
To approve Variances of 20-feet to the required 50-foot front yard setback on a county right-of-
way, and 11 feet and 17 feet to the required 30-foot side yard setback, all for property located at
4175 Lexington Avenue in the SW %4 of Section 23.
If approved, the following conditions should apply:
-we-property shall be platted prior to issuance of a building
building addition.
2. If within one year after approval, the variance shall not have been completed or utilized, it
shall become null and void unless a petition for extension has been granted by the
council. Such extension shall be requested in writing at least 30 days before expiration
and shall state facts showing a good faith attempt to complete or utilize the use permitted
in the variance.
? The applicant shall obtain a building permit prior to beginninc, construction.
4. The proposed addition shall be constructed using materials to match the existing
w structure.

the two parcels of real estate which are the subject of
this matter. I will be glad to provide this information
to you. For that purpose, please find a survey drawing
enclosed with this letter. The two Northwestern Bell
parcels are highlighted in yellow. The most recently
purchased parcel is legally described in Exhibit "A"
which is attached hereto. The other parcel of land is

As per our conversation of this morning, this is regarding the
Northwestern Bell property in Eagan, P.I.D. #10-2300-035-54,
along Lexington Avenue near Diffley Road.
According to our City records, which are supplied by Dakota
County, the 40' x 50' parcel was added to the existing parcel of
land (known by P.I.D. #10-2300-033-54), along its western
boundary. This then formed one, new, contiguous parcel with the
new P.I.D. #10-2300-035-54 and was recorded on or before August
11, 1987, at the Dakota County Recorders Office. This should now
suffice for one legal description and for real property taxation.
I hope this clarifies the matter.

which borders on Lexington Avenue. I indicated to you
that it is our desire to join the two parcels and to
create one parcel for purposes of legal description and
real property taxation. I indicated that the joinder of
two lots is of some importance to Northwestern Bell.
You responded by saying that you would have to discuss
the matter with other city officials.
I have not heard from you for more than one week. I
trust you will contact me at your earliest convenience
to discuss this matter further. It is my hope that we
will be able to accomplish this objective with relative-
ly little effort and paperwork. I look forward to

rights hereunder to as near the condition which existed immediately
before such rights were exercised as is reasonably possible.
Further, Grantee agrees that should the most southerly extension of
this utility line become unnecessary due to the development of the
property owned by Grantor, Grantee will vacate that portion of the
above described easement south of the southerly line and westerly
extension of the southerly line of Parcel 031-54.
The Grantee shall have the right to do whatever is necessary for
the enjoyment of the rights herein granted, including the right of
clearing the right-of-way of ingress and egress to and from said
tract of land and over and across said easement only for the purpose
of laying, maintaining, operating and repairing said utility lines.
