After reviewing your letter and talking with the Building
Inspection Department, I have the following response:
1. A complete fire alarm system is not required for the whole
building ;at this time. However, the City will certainly not
object if a complete fire alarm system is installed.
2. Room 102 and Hallway 126 need smoke alarms as stated in the
Uniform Building Code, Section 3319 (c), Distance to Exits.
Smoke detectors are to be installed according to
manufacturer's requirements.

l. Roger Sjo6eck indicated he will be supplying a P.A. system
layout so that rough-ins can be located within one (1) week.
2. Associated Mechanical indicated that site utilities could
start on April 5, 1990, and it owuld take 3 to 4 days to
complete.
3. Aoger pointed out that Addendum 1 included an additional
exterior faucet that was not hooked into the soft water.
4. Larry is going to have a building compaction test dene-.
5. Steininger would recompact areas excluding areas where
duct urork and plumbing had been buried..
6. Paramount indicated they could start interior footings,
fhe engineer has preliminary okayed the thickened wall
slab for these footings. We need verification from
Roger Sjobeck.
7. Paramount Masonry indicated that they would liketo pour
the floor slab before the wall construction.
8. Transformer location would be the southwest corner of the
building within two feet (2')-
9. Roger Sjobeck indicated that he would like to see the electrical
service located in the utility easements. Ron Schendel with
? Ries Electric is going to check with Dakota Electric to see if
` this location would work.

10. City of Eagan has indicated on Lhe permit plans that thcy need

the church would install these signs.
12. Roger Sjobeck was going to review the hardware schedule per the
City of Eagan's red line hardware schedule.
13. City of Eagan has recommended lighting protection for the cross.
Ron Schendel of Ries Electric will supply a price for this.
14. City of Eagan has indicated that the ceiling in room 101 will
need a one hour rated ceiling, which will involve two (2)
additional layers of 5/8" gypsum Uoard.
15. City of Eagan has indicated that overflow scuppers must be
sized three (3) times the size of the roof drains.
16. City of Eagan has indicated that no roof hatch would be
required if the existing PRV unit can be relocated inside
the duct.
17. City of Eagan indicated that the joist space does not need cross
ventilation.
18. City of Eagan has indicated that additional three (3) exit
signs will be required. Ron from iRies Electric will put to-
gether a price for this.
19. Ron from Ries Electric will complete the fire alarm form and
return i[ to the City of Eagan.
20. Larry Werner indicated that he needed a copy of all shop drawings
that have been approved to date.
21. Roger Sjobeck indicated that the City needs a water connection
for a coffee maker in room 120. I will need a price from
Associated Mechanical on this.
22. Roger Sjobeck indicated to look into an alternate window for
pricing.
23. Roger Sjobeck indicated [hat the church will need an additional
phone jack in room 120. I will need a price from Ries Electric
far this.
24. Roger SJobeck indicated that the church will Ue purchasing a
date stone, size approximately 16 x 8 x 4 in a copper box.
The church is planning a ceremony to set the copper box on
April 29, 1990. Paramount Masonry will need to install the
date stone after the ceremony.
25. Design colors were specified on the Teracut Viny1 fLooring. The
church may wish [o use the standard Teracut colors. Donlee
Interiors will need to indicate any cost difference for standard
colors in lieu of design colors.

1. {Ne agree with the requirement for handicapped parking signs. They
will be provided.
2. We agree with the change from Oceupaney Group A-3 to A-2,1. How-
ever, we do not agree with the additional classifications of "B-2" for
the offices and "E" for the classrooms.
UBC Sec. 503a, Exception 2.a states that Administrative and Cleri-
eal offices need not be separated from the use for which they are ac-
cessory when under 25% of the floor area.
UBC Chapter 8, does not define the characteristics of the Sunday
School Program for the chureh. The usage is less intense than any of
the definitions listed.
We believe the entire building should be classified as A-2.1.

1. 6Ve agree with sloping the floor in Room 125 instead of 124,
2. We do not believe that an E Occupaney exists in the building, and
therefore do not agree with the requirement of smoke detectors.

equipped with lock or latch. iYe did have an agreement with you from an
earlier meeting that Doors D103A, D103B and D103C would not be latched.
We assume that is still agreeable.
2. We do not agree with the requirement for poors D106, D108B, D113
and D116 to be 1 hour label, because we do not agree with the Group E
occupancy classification.
We previously agreed to make Doors D120A and D120B 1 hour rated.
This related to allowing Room 126 to be considered part of 102 and 103.
We also have made D112 and D125 1 hour rated because they are for mech-
anical eooms.

tion equipment.
3. We request a clarification on the requirement for the scupper to
be 3 times the size of the roof drains. 4Ve assume that the roof drain
is measured by the area of the inside of the drain pipe.

I have enclosed the Eagan Covenant Church's check in the amount of $2,410.75 to
expedite the release of the permit for the youth bam's foundation. The church has agreed
to designate the top level of the structure as "storage" to allow it to be assessed at 1 SAC
unit pending appeal to the Metropolitan Council. Please use this ]etter as documentation
of that commitment. It is understood that additional SAC unit charges may be assessed
for the second level when we present plans for the finishing and use of that space.
Please be advised that while we have paid this amount to expedite release of the building
permit, we still plan to explore all options to legitimately minimize the fees related to this
project due to the tight budget for funding which we are working under. We will also be
submitting a request to Tom Hedges for the city of Eagan to consider waiving and
refunding the portion of the fees under the city's control.

basis that were used were the area basis and the number of SAC units as determined by
the MWCC. The currerit policy effective January 1, 1992 is to collect the WAC using the

Existing public facility properties, which are expanded, will be reviewed individually and
recommended efther to have the WAC collected using the area method or basing the

Dear Mr. Mackay:
We have completed our review of the construction documents submitted in pursuit of
obtaining a buiiding permit for the above-referenced project. The comments listed below
are limited in scope to selected areas of special concern and are not intended to
comprise a complete and exhaustive report. It is our hope that this report will be of
benefit to you in achieving a project that complies with the various state and local codes,
laws, and ordinances.
The structural engineer of record must complete the enclosed Special Inspection
and Testing Schedule form. Please return the form to our office after obtaining all
of the proper acknowledgement signatures. Each special inspector, fabricator, and
testing agent must submit a Final Inspection/Test Report or Certificate of
Compliance, as appiicable, to our division before a Certificate of Occupancy will
be issued for the building--Uniform Building Code (UBC), sections 302(c) and
306(c) and (g).
2. Please note that the Uniform Building Code Standards referenced in the building
code (a list occurs in chapter 60) are a part of the code. Other standards
providing equivalent performance may be used only when such alternates are
approved by the building official under the provisions of Section 105 of the building
code--UBC, section 6001.
3. Provide verification that the proposed lighting power budget complies with the
Model Energy Code (MEC), section 505 as amended by Minnesota Rules, part
7670.0800, subpart 2. Please note that this amendment requires, with certain
modifications, the budget to be calculated in accordance with 1993 criteria as
specifled in the Code of Federal Regulations, title 10, part 435.103.

the buildings; other things can wait. Not all of the buildings w71 be saved. The recommendation is a
guideline. Not everything in the report needs to be done.
Mayor Egan stated he feels the ciry received an honest evaluatlon as to the relatfve condRlon of the
buiidings. There was a lot of excitement at the open house for this project He suggested the city do the
necessary improvemems for now and stretch out the other improvements as long as possitile.
Councilmember Masin indiCated she feels this is one of the few things that can be preserved in Eagen. She
feels the farm should he preserved and the Friends of the Farm organization should be formed. Mayor Egan
stated he feels there are a lot of ways to alleviate the flnancial concems. Suggest(ons from the Council
included getting the work done at the lowest price possfble, having a slower time frame for the
improvements, and doing only the improvemerrts that are necessary to preserve the buildings.
Hunter moved, Masin seconded a motlon to accept the work of the Holz Fartn Task Force and
recognize members of the task force for their donation of enthusfasm, expertise, time and energy that werrt
iMO creating this report. Aye: 4 Nay: 0(WacMer abstained due to the fact that he is a member of the
task force.) Some discussion followed conceming the funding. Councilmember Hunter suggested
eliminating the $300,000 for access. Councilmember Awada concurred.

? Community Development Director Reichert gave a staff report. Councilmember HuMer indicated
that when considering these extensions, the Council looks to see whether there is something new. He feels
that moving the barn onto their property is new and he doesn't have a problem with this. Other

CONSIDERATION OF PARK REFERENDUM ON AUGUST 6, 1996
Administrator Hedges noted that official action would have to be taken by the Council 45 days prior
to the refererxium. It is the intent to bring a formal resolution back to the Council on thfs on June 4th. Lee
Markell, Chair of the APRNRC, indicated the commission looks forvvard to workfng wRh the task force on
open space and actNe park space issues.
Tony Caponf reviewed the history of the Caponi Art Park and the problems wfth financing for the
park. He doesn't feel this shouid be part of the referendum. The Caponi Art Park is not a concept--it exists
and he dcesn't feel there is a questlon as to whether the park is needed in the ciry. 7hat was decided long
ago. He likes the idea of a task force, but feels the Caponi Art Park should be excluded from the work of
the task force. He feels he and the Council need to work together to make this work. He Indicated that he
made a proposal, and he would like to discuss this further with the Council and get a response.
Councilmember Hunter indicated that the Council has read the proposal, bu[ haven't discussed it together.
He feels that needs to be done. The proposal wasn't what he expected, and he feels it needs to be
discussed further. He has serious concems about the proposal.
After some discussion, Hunter moved, Awada seconded a motion to set a special worlcshop for
March 21, 7996 at 5:00 p.m. to discuss the proposal for the Caponi Art Park. Aye: 5 Nay: 0
Awada moved, Masin seconded a motion to direct the Advisory Parks, Recreation & Natural
Resources Commission to form a task force to study the park bond referendum issue to make a
determination as to the amount and wording for a referendum to be held on August 6, 1996. Mirial Johnson,
4781 Amberleaf Trail, stressed the importance of this project to the community. She feels the Caponi Art

The Eagan Evangelical Covenant Church Addition received final plat approval on October 17,
1989. According to condition #8 of the development contract entered into by the City of Eagan
and the Eagan Evangelical Covenant Church, all temporary pazking lot improvements must be
brought into conformance with current City Code requirements no later than seven years from
the date of final plat approvai. As a reminder, the ',;?uminous curbing along the outer edge of
the pazking surface is temporary and will have to converted to concrete curb and gutter by
October 17, 1996.

MEMO
I have reviewed the October 1, 1996 letter from Eagan Evangelical Covenant Church
requesting that building permit fees be waived on the youth barn they are constructing. To
my knowledge, I do not recall the City ever reducing or waiving fees that are due on
construction projects.
We have agreed to allow Eagan Evangelical Covenant Church to pay fees for each phase
of construction so they are not paying fees until they actually have a need for a portion of
a building.

practice of filling with water from atorm aewer runoff, a1d for utility line

The Grantee shall have [he right to do whatever is necessary for the
enjoyment of the rights herein granted, including the rifht of clearing the
easement azaa to allow for the uae of the land as stated',herein, :and for
ingress and egress to and from said trac[ of land and over aad.acrosa said
easement only for the purpose of conatructing and maintaining, operating and
repairing said drainage facilities and utility lines.
And the said Grantor, for itself, its heirs, executors, adminiatrators and
assigns does hereby release the said CITY OF EAGAN, its aucceseors and
assigns, from all claims for any and all damages resulting to said land by
reason of the location of eaid drainage easement and utility lines.
By acceptance of these easements, the Grantee agreea that it ahall restore
the proyerty located outside the anticipated perimeter of moving war=r to as
near the existing grade as is reasonably possible and further Lbrees to
replace existing cul[iva[ed ahrubs or sod and to aeed all other areas not
covered with moving water.
