This was in response to my request of June 7 requesting this information to verify the extent of encroachment of the City trailway on your property. Upon receipt of that information, a personal field observation was performed to verify the extent of this encroachment. This particular trailway was installed privately by the developer of the Greensboro Addition as required by a condition of his final plat approval under the requirements of the development contract agreement. Once this trailway improvement was completed, it was turned over to the City to be incorporated in our City Parks Trailway System. Unfortunately, this trailway was not constructed in accordance with the contract agreements or detailed plans for this subdivision. Obviously, its errant location was not discovered during construction or during the warranty period where the City could require the developer to relocate it. Subsequently, it will be the City's responsibility to correct this problem. As I indicated previously, the trailway is under the jurisdiction of the Parks & Recreation Department as a part of their Master Trailway Plan. Therefore, I have forwarded this issue and your concerns to the attention of Mr. Ken Vraa, Director of Parks & Recreation, who will schedule the appropriate corrective work. I was informed that the city owned trail located north of my property is on my land. A new lot corner marker was placed on the trail at the location of my lot corner. I anticipate that the City of Eagan will be removing all of the trail and underlayment that is presently on my property. The city owns approximately 15 feet of land that was to be used for the trail. Additionally, I anticipate that the City will correct any damage to my property casued by the removal of the trail from my land. When the trail was being installed I contacted the Parks Department and Cheryl was very helpful in requesting that someone check to see that it was within the strip. Interestingly enough this trail was installed without the use of any markers, unlike the path that is being installed near Northview Park Rd. After the path was completed I again contacted the Parks Dept. which then referred me to Craig Knutson, who indicated that he had it checked out and was informed that it was well within the 15 foot strip owned by the City. Additionally, the City's path attracts people to trespass across my yard; given the inconvenience and cost that the imporper installation of the path has already cost me I would anticipate that the City would be willing to install a fence along the trail to the street, thereby preventing the use of my land as an auxiliary City trail. Finally, when the trail has been properly placed within the 15 foot strip owned by the City, I anticipate that the City will see that the corner marker of my lot is properly relocated by a licensed surveyor at the City's expense, as the most recent lot corner had to be located at my expense, in the asphalt placed by the City on my property. I anticipate that the City of Eagan will be removing all of the trail and underlayment that is presently on my property. The City owns approximately 15 feet of land that was to be used for the trail. Additionally, I anticipate that the City will correct any damage to my property casued by the removal of the trail from my land. When the trail was being installed I contacted the Parks Department and Cheryl was very helpful in requesting that someone check to see that it was within the strip. Interestingly enough this trail was installed without the use of any markers, unlike the path that is being installed near Northview Park Rd. After the path was completed I again contacted the Parks Dept. which then referred me to Craig Knutson, who indicated that he had it checked out and was informed that it was well within the 15 foot strip owned by the City. Additionally, the City's path attracts people to trespass across my yard; given the inconvenience and cost that the imporper installation of the path has already cost me I would anticipate that the City would be willing to install a fence along the trail to the street, thereby preventing the use of my land as an auxiliary City trail. Finally, when the trail has been properly placed within the 15 foot strip owned by the city, I anticipate that the City will see that the corner marker of my lot is properly relocated by a licensed surveyor at the City's expense, as the most recent lot corner had to be located at my expense, in the asphalt placed by the City on my property.
