The first week of January, you received correspondence from the
City addressing questions you had reqarding drainage and the
function oF the City's storm sewer in the above-referenced Trenton
Trail access. The January letter referenced future correspondence
which would address maintenance responsibilities for the identified
area. Representatives from the City's Park & Recreation Department
have inspected t11e Trenton Trail right-of-way area and have the
following plans for maintenance in 1991:
The City's Fark & Recreation Department will be establishing
a soft surfaced turf trail into the park in the spring of
1991. This will be an 8' wide mowed trail following the
approximate centerline of the swale bottom from the corner of
Trenton Trail into Trapp Farm Park. Mowing of the trail will
be performed approximately once every 5-7 working days
consistent with maintenance of the park. The approximate
trail alignment is highlighted in green on the attached map.
The area between the mowed trail and edge of right-of-way will
continue to be "maintained" in the existing erosion control
ground cover. There are currently no plans for development
of recreational facilities in the right-of-way area. The
recommended nonmaintained ground cover areas within the
Trenton Trail right-of-way are shown in pink on the attached
map.
In addition to mowing the trail surface, the City will also
mow the street right-of-way area directly adjacent to Trenton
Trail. This area is shown in blue on the attached map.

As we had previously discussed, "it is the primary responsibility
of any owner or occupant of property abutting on any street to
establish suitable turf grass, from the line of such property
nearest to such street to the centerline of such street within a
period of one full growing season from the completion of final
grading or date of occupancy, whichever is sooner". I have
attached a copy of the ordinance which identifies the property
owner's responsibility in this manner.
With respect to future improvements within the Trenton Trail right-
of-way area, the Park & Recreation Department is planning to erect
a park identification sign at the trail head location in the summer
of 1991. Other improvements such as landscaping, the placement of
benches or the paving of the trail will largely be driven by the
availability of capital improvement funds and the extent to which
the trail is used by the area residents. Existing topography and
issues for public safety will also dictate the feasibility of
developing a paved trailway system into Trapp Farm Park at this
location.

comments or cancerns with respect to the function of the City's

fails to assume the responsibility of these
requirements, the City may proceed to order the work
done in accordance with Subdivisions 5 and 6 of this
Chapter.
5. Overhanging branches of all deciduous trees, planted
within street rights of way shall, at the time of
maturity, be at least 13 1/2 feet above street surfaces
and at least 8 feet above the ground for all other
public places. This requirement includes trees that are
planted on private property, but overhang within public
areas or rights of way.
6. The City may establish a master plan for street tree
planting. The plan shall identify those streets which
have been designated by the City Council for the
planting of said boulevard trees. In accordance with
the master plan, responsibility for the planting and
maintenance of boulevard trees shall be the
responsibility of the City of Eagan, except for new
sub-divisions where the developer shall be responsible
for planting boulevard trees. The planting and
maintenance of trees within residential street rights
of way, not included in the City's master street tree
planting plan, shall be the responsibility of the
abuttinq property owners. In such cases, the property
owner shall first obtain, from the City Forester, a
written permit to plant, in accordance with Subd.
l.A.C. of this Chapter.
E. The City shall establish and enforce uniform standards
for the pruning, spraying, fertilization, irrigation or
other maintenance of trees planted or located within the
public right of way. Such standards shall be kept on file in
the office of the City Forester.
F. It is unlawful for any person to deface, destroy, or
tamper with, any trees or landscaping on public property,
including trees within street rights of way.
G. A tree within a public right of way shall not be used for
signs, permanent lighting, television antennas, or other
inappropriate uses.
H. Removal of trees and shrubs from public property, shall
be by City permit only.
Subd. 2. Duty of Property Owners to Establish Turfgrass
within Street Rights of Way. It is the primary responsibility of
any owner or occupant of property abutting on any street to
establish suitable turfgrass, from the line of such property
nearest to such street to the centerline of such street within a
period of one full growinq season from the completion of final
grading or date of occupancy, whichever is sooner.
Subd. 3. buty of Property Owners to Maintain Turfgrass
within Street Rights-of-Way. Every owner of property abuttinq on
any street shall be responsible for the maintenance of suitable
turfgrass from the line of such property nearest to such street
to the curbline of such street. If the grass or weeds in such a
place attain a height in excess of six inches, it shall be prima
facie evidence of a failure to comply with this subdivision.
Subd. 4. Duty of Property Owners to Maintain Trees Within
Street Rights of Way. Every owner of property abutting city
street rights of way shall in accordance with standards on file
in the office of the City Forester maintain, trim, fertilize and
irriqate all living trees or remove any dead or non-conforming
trees, from the line of such property nearest to such street to
the centerline of such street. It is the lawful duty of citizens
to follow such City standards, except in those cases where the
City has declared certain boulevards to be under the maintenance
jurisdiction of City departments.
Subd. 5. City May Order Work Done. If any such owner or
occupant fails to assume the responsibility of this Section, and
after notice given by the City has not within seven days been
complied with, ttie City may perform such work, keeping accurate
account oi the cost thereof for each lot, piece, or parcel
abutting upon such street.
Subd. 6. Assessment. When maintenance work is performed by
the City as prescribed herein, the City Forester shall forthwith
upon completion thereof, ascertain the cost of such maintenance
work. The City Clerk-Treasurer, may at the next meeting, present
such information to the Council and obtain its approval thereof.
When Council deems fitting, it may extend these maintenance costs
as herein stated as a special assessment against abutting land,
and such special assessments shall, at the time of certifying
taxes to the County Auditor, be certified for collection as other
special assessments are certified and collected.
Section 3. Eagan City Code Chapter 1 e?ititled "General Provisions and
Definitions Applfcable to the Entire C:ity Code Including 'Penalty for
Violation "' and Sections 6.99 and 7.99, entitled "Violation a
Misdemeanor" are hereby adopted in their entirety by reference as
though repeated verbatim.

It has been approximately six weeks since our November 29, 1990,
meeting with Councilmember Pawlenty concerning the area adjacent
to your rear property line. At that meeting you had expressed two
basic concerns. The first concern is the depth of water and the
frequency of which water collects in the area adjacent to your rear
property line during rain storms. The second concern is the City's
plan for this area with regard to restoration, level of
maintenance, and possible trailway construction.
You stated in our meeting and in written correspondence to
Councilmember Wachter that water depths of 41-5' collect at the
storm water drain in this area during rain storms. Field survey
measurements of the area show that when water depths of less than
2k' at the storm water drain are reached, the water will start to
overflow into the park area to the south. Also, it is highly
unlikely that the storm water drain's open grate cover will "blow
off and suck people into it" duriiig rain storm events in which
water temporarily ponds in this area. Temporary ponding of storm
water in areas which are designed to collect storm water runoff
into the City's storm sewer system is a common occurrence City-wide
during extreme rain storm events.

SUBJECT: TRENTON TRAIL ACCESS TO SCHWANZ LARE PARK
The last week of November, I met with Tim Pawlenty and David and
Kari Boyce, 4350 Livingston Drive, regarding the condition of the
easements/road right-of=way along their backyard area. See the
attached September 17, 1990, letter to Councilman Wachter. You may
recall this area being graded as a part of the Daniel Drive project
to provide an emergency overland drainage way for the overburdened
storm sewer at the intersection of Daniel Drive and Trenton Trail.
The Boyce's . are concerned about the condition of the grass area
behind their house and who is responsible for maintaining this
area. Section 7.08, Subdivisiori 1, of the City Code, identifies
maintenance responsibility for this area to be those of the
adjacent property owners. The area restoration quality under the
public improvement project was performed strictly from an erosion
and sediinent control perspective and not intended to be a cultured
sod area. These items were discussed with the Boyce's. I informed
them that I would organize concerns from the City's perspective and
respond to them outlining the City's position on this matter.
Please review from a parks maintenance perspective and advise. At
this point, it seems appropriate that all of the adjacent property
owners in this area be nqtified of the City's position on this
matter. Thank you for your anticipated cooperation.

We are new residents to Eagan living at 4350 Livingston
Drive. To the rear of our lot, there is a very large ease-

we were informed that there would be a bike path located in
this easement by the end of August. The summer has now past
and all we have is a weed and buq infested area. Following
up on this matter, we contacted the land development company
for the area. Tri-land informed us that $43,000 has been
forwarded to the City of Eagan for the purpose of construct-
ing the path. Our next call was to the city planning depart-
ment, the purpose of which was twofold. First, we wanted to
know the progress on the bike path. Secondly, we were con-
cerned about the serious flooding problem which has been re-
curring all summer with the heavy rains. We were informed
that the plans for the path are not for this year or neces-
sarily next. The solution to the flooding problem is less
than adequate in our estimation. To correct the problem, af-
ter a neighbor's house was seriously damaged by flooding, the
city built up the sides of the easement so the water build up
would flow into the park with the heavy rain. Please note
that when this happens the water would be four to five feet
deep in the path area. Also, it was explained that the drain
cap in the easement could "blow off" and suck people into it
in that situation. This concerns us, there many children in
the neighborhood that could easily get caught in a current
created by this river-like easement.
We are very concerned about both of these issues, as are our
neighbors with whom we have spoken. There are several of us
that were informed that this project would be completed by
this time. In speaking with the Park & Recreation Department
and Engineering, we understand that these issues need to be
addressed by the City Council for changes to be enacted.

We would appreciate your action on behalf of the above situa-
tions. We are looking forward to your response. We also un-
derstand that you will need a great deal more information in
order to make these changes. If we can help in any way,
please let us know.

SUBJECT: TRENTON TRAIL ACCESS TO TRAPP FARM COMMUNITY PARK
Mike, this memorandum is in response to your recent request for information regarding
future plans for maintenance within the Trenton Trail right-of-way leading into Trapp Farm
Community Park. I appreciate the opportunity to respond to concerns of the David and
Carey Boyce family (and Council Member Tim Pawlenty) as ouilined in your memorandum
and in their letter to the City dated September 17, 1990 (see attached).
On January 2nd, Ken Vraa, Steve Sullivan, and I met at Trapp Farm Park to review and
discuss operationa] and development plans for the Trenton Trail right-of-way area. Based
on our review, and previous assumptions for management of this area, I would ]ike to share
with you the following ]ist of plans for maintenance in 1991:
1. The Parks and Recreation Department will be establishing a soft surface turf trail
into the park in spring, 1991. This will be an eight foot wide mowed trail following
the approximate center line of the swale bottom, from the corner of Trenton Trai]
into Trapp Farm Park. The purpose of the trail wili be to provide a safe and
accessible route for pedestrian access to the park from the Lexington Point r
Development. Mowing of the trail will be performed approximately once every 5 to
7 working days consistent with maintenance of the park. The approximate trail
alignment is highlighted in green on the attached map.
2. The area between the mowed trail and edge of right-of-way will continue to be
"maintained" in the existing erosion control ground cover. That is, it is not the
intention of our department to perform any rough or fine grade mowing in the
remainder of the right-of-way. This decision is based on several factors:
There are currently no plans for the development of recreational facilities in
the right-of-way area. Existing slopes and narrowness of the right-of-way do
not adequately allow for open play or other recreational activities.
As pointed out in your memorandum, eacisting vegetative cover on the side
slopes was not intended for cultured sod and would provide for optimal
erosion control if left in its natural condition.
The area of Trapp Farm Park adjoining the Trenton Trail right-of-way is also
in a non-maintained condition. From a functional/aesthetic point of view it
would be desirable to have consistent turf maintenance practices across both
areas.

Wildlife values could be enhanced by leaving the side slopes in a non-
maintained condition.
• The Parks and Recreation Department does not have additional manpower
and equipment to take on additionai mowing responsibilities, withaut
negatively impacting the current program.
The recommended non-maintained, ground cover areas, within the Trenton Trail
right-of-way are shown in pink on the attached map.
3. In addition to mowing of the trail surface, the City will also mow the street right-of-
way area directly adjacent to Trenton Trail. This area is depicted in blue on the
map.
4. Pursuant to Section 7.08, Subdivision 1, of the City Code all property owners abutting
street right-of-way are required to maintain turf grass between the edge of their
property and curbline of the adjoining street. In the case of Trenton Trail those
homeowners living at 4326, 4330, 4334, and 4338 Livingston Drive should be advised
of this responsibility. This area is highlighted in orange on the map. While the same
case could be made for those homes which abut to the trail/right-of-way area, for
reasons described in number 2 above, we feel that it would be best to leave the
groundcover in it's current state. This may run somewhat contradictory to the City
Code, but is considered an exceptiona] case because no improved street exists within
this right-of-way, i,e. it functions primarily from a standpoint of pedestrian access and
stormwater control.
With respect to future improvements within the right-of-way, the Park and Recreation
Department is planning to erect a park identification sign at the trailhead location this
summer. Other improvements sueh as landscaping, the placement of benches, or paving of
the trail will largely be driven by the availability of capital improvement funds and the extent
to which the trail is used by area residents. Existing topography and issues for public safety
will also dictate the feasibility of developing a paved trail into Trapp Farm Park. This issue
will require future study before any action is recommended to the Park and Recreation
Commission and/or City Council.
I trust that this memorandum has provided you with the information you need in order to
respond to the Boyces and Council Member Pawlenty. I also understand that you have been
acting as the point of contact for the City on this issue and will be advising the other
adjoining residents as to the City's plans. If I am incorrect in this assumption and if you
