from the two office windows of our new facilities at-3500_-_Eederal-Drive.
We agreed to put in a metal frame with sliding wire glass and lock. We will
also post a sign next to the windows instructing our staff that these windows will be shut and locked during non business hours and will be shut
in case of any fire emergency. Our policy is to leave the windows closed
except during specific periods of the day.

husband and wie,
JANE Z. ASTLEFORD#hose address is 1200 West Aighway 13, Burnsville,
Minnesota 55337/; F. JERRE SMITH and DOROTHY SMITH Aose address is'
3100 Second Street, McAllen,,Texas 78501; and DAVID SEIDEL and
DEBORAH SEIDEL/whose addre slis,5313 Ayrshire Boulevard, Edina,
Minnesota.
wHEREAS, the Owners have applied to the City of Eagan for
approval of the plat or subdivision know as RASMUSSEN COLLEGE CAMPUS
located within the City; and
WHEREAS, the Owners have requested that the sanitary sewer
service not be extended from Lot 1, Block 1, RASMUSSEN COLLEGE CAMPUS
to the property line of Outlot A; and
WHEREAS, the Owners agree that when sanitary sewer service is
required for the developnent of Outlot A, the Owners will be required
at their own cost to jack a casing under Federal Drive in order to
service Outlot A; and
WHEREAS, the Owners agree that this shall be the exclusive
methon of installing the sanitary sewer service under Federal Drive.
NOW, THEREFORE, the Owners agree as follows:
1. The Owners, their heirs and assigns, shall be solely
responsible for the cost of the casing under Federal Drive, which
shall be the sole method used in the installation of the sewer system
under Federal Drive.
2. Recordina. This agreement shall be recorded with the Dakota
County Recorder so as to provide notice to f uture owners of Outlot A,
RASMUSSEN COLLEGE CAMPUS.
3. Binding Agreement. The parties mutually recognize and agree
that all terms and conditions of this recordable agreement shall run
with the land herein described and shall be binding upon the heirs,
successors, adninistrators and assigns of the owners and developers
referenced in this Contract.
