APPLICATION SUMMARY: An application has been submitted requesting a two-year
Special Use Permit to allow the Harvest Fellowship Church to continue meeting in a
building located at 3584 Kennebec Drive on Light Industrial zoned property.
BACKGROUND: Harvest Fellowship (originally Eagan Christian Center) was initially
granted a two-year Special Use Permit in August 1986 to hold church services in the
office/warehouse facility located on the corner of Shawnee Road and Kennebec Drive. Two-
year renewals have been approved by the City Council in August 1988 and May 1990.
COMMENTS: According to the applicant, the congregation has invested a lot of money
remodeling and the facilities are more than adequate to meet present needs with much room
to earpand. The applicant also points out that the church has been responsible for property
taxes on approximately 12,000 sq. ft. of the Shawnee Business Center's facilities which would
not be the case if they were on tax exempt church-owned progerty.
If approved, this Special Use Permit shall be subject to:
1. This temporary permit shall expire two years from the date of City Council
approval.
2. Church functions shall be limited to Weunesday evenings and weekends.
3. All applicable City Code requirements.

Dear Jay,
As discussed at our meeting on August 15, 1988, the following
items will be required with the remodeling heing proposed within
your tenant space:
1. Smoke detectors should be placed outside the doors of the two
classrooms on the second floor.
2. Exit signs should be placed at the two interior stairways and
at the exterior stairway at the end of the corridor on the
second floor.
3. Return the ends of the hand=ails.
4. Provide smoke detectors in the nursery, the two classrooms,
and outside the janitor's closet.
5. Relocate the front door and exit sign. The door should swing
out. AV,
6. Provide a twenty-minute-rated, self-closing door on the
janitor's closet and apply 5/8" type-"x" gypsum board on all
exposed framing in the closet.
7. Provide a smoke detector on the mezzanine level.
These items were specifically discussed at our meeting; other
code issues that may arise during construction will be addressed
as they are encountered. The requirements discussed in this
letter supercede those of a letter you were sent dated August 4,
1988.

I have reviewed the plans submitted for code compliance.
Existing conditions limit the proposed use of the tenant space.
This review is based upon the following assumed conditions and
resultant code restrictions:
1. The actual construction of the existing building most nearly
resembles Type II-N.
2. The building does not contain a fire sprinkler system.
3. Group A Divisions 1-2-2.1 occupancy uses are not allowed in
a building with less than one-hour fire-resistive
construction.
4. The assembly room in a Group A Division 3 occupancy is
limited to 299 persons.
5. Group A Division 3 occupancies located above the first story
shall be of not less than one-hour fire-resistive
construction.
6. The proposed uses of the tenant space are classified as
follows:
a. ECC auditorium area and open mezzanine floor, lobby and
vestibule areas, first floor classrooms--Group A
Division 3.
b. First floor nursery areas--Group E Division 3.
c. Second floor classrooms and offices--Group B Division
2.
7. Current exit width of ground floor levels is approximate2y
six (6) lineal feet.

The comments listed below refer to documents that make up the
Minnesota State Building Code and applicable codes and ordinances
of the City of Eagan. Certain code deficiencies may not have
been included in this report, but this shall not be construed as
an approval of such code deficiencies.
1. A maximum of 180 persons shall be allowed in the auditorium
including the area above and below the mezzanine floor. The
maximum may be increased to 299 persons if an additional
exit door to the exterior is provided.--UBC 3302(a), 3303(b)
2. Post auditdrium capacity.--UBC 3302(c)
3. Exit door between corridor/lobby area and vestibule shall
swing in the direction of exit travel.--UBC 3304
4.a. Maintain one-hour fire-resistive construction of
corridor/lobby and vestibule.--UBC 3305(g)
4.b. Self-closing and gasketed 20-minute fire doors are required
on all doors opening into the second floor corridor, the
corridor/lobby and vestibule.--UBC 3305(h)1
4.c. Windows to corridor/lobby must be protected by fixed 1/4-
inch wired glass in steel frame.--UBC 3305(h)2
5. Useable space under enclosed stairs shall be protected on
the enclosed side as required for one-hour fire-resistive
construction.--UBC 3306(m)
6. Install smoke detector in toddler nursery; alarm must be
audible in infant nursery rooms.--UBC 3319(d)
7. Wall and partitions shall be of noncombustible materials.--
UBC 1901
8. Classrooms for kindergarten, first or second grade pupils
should not be located above the first story.--cf. UBC

9. Storage and janitor closets in or adjacent to the nursery
areas shall be of one-hour fire-resistive construction.--UBC

10. Panic hardware is required on auditorium doors and door

Eagan Christian Center has applied for a building permit to
expand and remodel their leasehold space at 3600 Kennebec Drive,
and 2 have reviewed their drawings submitted with respect to --
these internal improvements only. The information we have
received suggests that other tenant spaces within the same
buildinq may contain B-1, H-3, and H-4 occupancies--thus possibly
requiring fire-resistant occupancy separations. I am enclosing a
copy of my review comments for your information. Hopefully, your
inspection of the property will determine compatible uses or
adequate separation walls. If not, please keep me informed of
any appropriate action being taken.

Dear Mr. Zinn:
We are in receipt of a building permit application for interior
improvements at the aforementioned property. A preliminary
examination of the drawings submitted indicates a proposed
conversion of an existing warehouse space into an assembly
(worship area) occupancy. As larger numbers of people occupy a
space, the potential hazards due to an emergency condition tend
to increase. To help mitigate these conditions, the Code
requirements become more complex and restrictive, hopefully to
cause a more safe and healthful building.
To insure that these requirements are being addressed, all
assembly occupancies are required by the State of Minnesota
Agency Rules to be designed by a registered architect who is
licensed to practice architecture in the State of Minnesota. The
architect must certify and sign two complete sets of plans and
specifications to be submitted prior to the issuance of a
building permit. Please include with the drawings a key plan
showing the entire building, indicating the portions to be
remodeled. Additional information included with the construction
drawings (showing the occupant load as defined by UBC 3302, the
UBC Occupancy Group showing how compliance with UBC Sections 502,
503, and 504 will be achieved, and the type of construction
designed, etc.) will help expedite the plan review process.
