Dear Mr. Hendrickson: It was recently brought to the attention of this office that various conditions approved as a part of the site plan for conditional use permit granted to Tessman Seed & Chemical Company on September 2, 1975 are no longer in compliance. The site plan indicates that an outside storage was approved to the east of the original building with the dimension of 120' x 120'. This outside storage area was designated by a cyclone fence. A recent investigation by the City's planning and inspection department shows that the outside storage is not confined to that area; however, property to the west of the outside storage area as designated is being used for storage purposes. Parking for thirteen (13) vehicles was approved as a part of the site plan. However, it appears that those parking stops are closer than seven and a half feet to the adjoining property line and the parking spaces have been used for storage. As a result, the parking spaces, are no longer serviceable for the intended off street parking. It appears that a portion of the asphalt drive is also being used for outside storage which has reduced the ability to accommodate off street parking for tractor trailers when delivery occurs on your property. There have been a number of com- plaints about the tractor trailers parked on Kennebec Drive, creating a potential public safety problem with the inability for proper access through the streets. Enclosed is a copy of the site plan that was reviewed and approved by the City of Eagan when the conditional use permit was granted. The City would like a response as to how you are planning to correct these problems by May 15, 1981. A report is to be given to the City Council at the Tues- day, May 19, 1981 meeting.
