ed in the letter enclosed on Page ?,_. Attached on Pages 3 through (o are
location maps of the respecti.ve parcels for each of the individuals and the atrount
of their land that lies beneath the oontrolled water elevation of Blackhawk Lake as
est.ablished at 792.30. The Lake configuration as shown an these locatian maps is
not accurate and is for conceptual configuration only as verified by the Dakota
Cotmty Auditor's Office. The staff overlaid the lot oonfiguratiari over a topograph-
ic map to determine the actual limi.ts of the contxnlled water elevation at 792.30.
Zhis topographic overlay is available on Page 7.
The collective objecticn by these property owners relates to the area belaa the con-
trolled water elevation being included in theis net assessable acreage. Recently,
Policy 82-3 was approved which. pravides for the eliinination of land below aaDntrol-
led water elevation frcRn area calculations. After recalculating the lot area and
providing the necessaxy credit for the land belaa the water area, on page , a
table was prepared delineating the respective credits as reqt.iested by the objecting
pmperty awners.

Because Policy 82-3 was being processed simultaneously with the preparation of this
assessment ro11, it was not properly applied to these parcels in question. Zhere-
fore, the staff ooncurs with the pmperty owners' objections and recrnrnends that

assessment hearing held on July 20, 1982 i.n accordance with the table on Page

Dear Mr. Colbert:
This letter is to appeal our assessment.for the storm sewer
improvement on B2ackhawk Lake. ?
We, the undersigned are all property owaers in Jon Croft Acres
(on Blackhawk Lake). We feel the algorithm for determining the
amount of assessment ( 3.4 cents per square foot on the first
16?,500 sq ft of each acre in a given parcel) was applied unfairly
to the property in Jon Croft Acres.
As a result of conversations with Mr Colbert today, it appears
that'the area for assessment in Jon Croft Acres included area
within the lake (under water), vhereas other lakeshore property was
not assessed for lake area.
The lake area is up to nearly 50% of the assessed area on some property
(see attached plot map).
We contend that our assessment is:
1) Not equitable (we only ask to be treated like other
property owners).
2) Unreasonable, (How can area under water benefit from
a storm sewer project).
Accordingly, we ask [hat our respectfve areas to be assessed be
recalculated to exclude that area which is under water.

Betty Hassett appeared on behalf of her request that the City Covncil
eonsider the redesignation of the Iand use for four lots ocrned by her in
Meadouland that have been, to date, approved for a four unit townhouse to be
used for a home for the handicapped. A number of questions were raised by
Mrs. Bassett and members of the City Council about the original intent of the
Unisource Ylanned Development for the use of that property and that more
reeent approval uas necessary regarding the Eagle's Nest Home for that loca-
tion. The chronology of events have been prepared by City Planner, Dale
Runkle, and was revieKed by the staff. Councilman Wachter suggested that
neighboring property oxners be notified if there is a change in use. Mrs.
Bassett saas present and asked what the underlying zoning =aas. It was noted
that it currently is R-1. S4e stated that she could get 8 units of subsidized
housing and may vse some uniLs for handieapped and some for non-handicapped
persons. Councilman Smith stated that if the use is for partially handicapped
and non-handicapped, there would be a Iess dense use than originally antici-
pated. Mrs. Bassett states that aetion had to be taken on the use oP the
property within the next two years or that she would lose the ownership of the
land. The issues appeared to be whether a 16 unit building with 8 handicapped
persons and 8 non-handicapped persons could be utilized in the location and if
not, what use could be made of the property. There was diacussion coneerning
a proposed amendaent to planned development. Smith moved, Egan seconded the
motion to direct the staff to work Hith the owner and the develoQer of the
Planned Development to provide an amendment to the Planned Development and to
present the proposal at the nexb City Couneil meeting. All voted in favor.

The City Council then reviewed the recommendations oP the 5pecial
Assessment Committee meeting which had met on August 30, 1982, includino the
Pollowing:

1. Anderson, Maesaka, Berg and Kyllo (John Croft Aares) Assessment. Zt
was requested by the foregoing persons that the assessment be ad,justed
covering that portion of their property within Blackhawk Lake. Staff recom-
mended approval as did the Special Assessment Committee. Upon motion by
Smith, seconded Waehter, it was resolved to reduce the trunk area storm
assessment for the four foregoing parcels in accordance with Che table
presented xith the packet to the City Council. All voted in favor.
2. Floyd Bryant, Deerwood Drive and Blackhawk Road. After discussion,
Smith moved Fo vacate the final trunk area storm sewer assessment ;or the
Bryant property under Project #297 and order a new publie hearing to be
scheduled for October 5, 1982 at 7:00 p.m. at City Hall. Wachter seconded the
motion, all voted yes.
