THIS AGREEMENT dated this day of -Jtr17, 1980, hp and between James D.
Albani and Judy A. Albani, husband and wife, called ALBANIS, and the Citp of Eagan,
called EAGAN;
WHEREAS, EAGAN wishes to install a sanitarp sewer line from the Art Rahn Addition
Lo cross the west side lot of the ALBANI.property, which sanitary sewer line shall
be located entirely within the existing five (5)) foot utilitp easement located
adjacent to the west line of the ALBANI property being Lot 17, Block 5, Cedar Grove ?

WHEREAS, to facilitate the construction of said sanitary sewer line, EAGAN
wishes to acquire a temporary construction easement upon the ALBANI. property;
NOW, THEREFORE, for in consideration of the mutual covenants herein contained
the parties agree as follows:
1. EAGAN and its contractors will install a sanitary sewer line over and
across the ALBANI property within the five foot permanent utility easement along the
west property line of the ALBANI property and the ALBANIS will grant a temporary
construction easement across the west 15 feet of said Lot 17, Block 5, subject to the
conditions of this Agreement.
2. EAGAN will save, hold harmless and indemnify the ALBANIS from any and all
injuries, damages, actions, causes of actions, claims, suiCs, judgtoents, costs, ,
expenses, attorney's fees.and liabilities, of whatsoever nature, arising in any manner
from the construction of said sanitary sewer line and/or the temporary construction
easement herein granted or arising from any work or thing whatsoever done in, on or
about the ALBANI property or arising from any accident, injury or damage, however
caused, to any person or property on account of the laying maintenance, repair,
failure to repair, renewal, use or existence of said sanitary sewer line, including
any defect, imperfection, breaking or leaking of same.
3. This Agreement shall be binding on and inure to the benefit of the parties
hereto, any and all subsequent purchasers, contract vendees, fee owners, assignees
and tenants of said Lot 7, Block 5, Cedar Grove No. 7, Dakota County, Minnes.ota, and
the heirs, administrators, personal representat3ves, executors, successors and
assigns of each and all of the foregoing.

4, EAGAN shall return the ALBANI property to a condition substantially similar
to the condition which existed prior to the granting of said easement.
5. EAGAN and contractor will permit the hole over pipe between the
ALBANI and Westling houses to be open no longer than one week from the start of
construction to completion of construction unless weather conditions do not permit
and EAGAN will provide safety barriers around the open holes at all times.
6. EAGAN shall replace all sod removed for construction within two weeks
from the start of construction by EAGAN's contractors.
7. All existing trees shall be removed if possible and replaced but in any
event EAGAN will replace all damaged trees with comparable trees.
