WHEREAS, Appellants, Larry C. McNurlin and Masilyn J. McNurlin are the owners of
real property located at 3036 McCarthy Ridge, City of Eagan, County of Dakota, State of
Minnesota with Property Identification Numbet 10-47700=071=00 (liereinafter the "McNurlin
Propert}?'); and
WHEREAS, Appellant, George Stevenson is the owner of real property located at 3030
Sibley Memorial Highway, City of Eagan, County of Dakota, State of Minnesota with Property
Identification Number 10-47700-022-00 (hereinafter the "Stevenson Propert}?'); and
WHEREAS, in connection with Eagan City Project No. 643R, the McNurlin Property and
Stevenson Property were assessed for street reconstruction in the principal amount of Two
Thousand Two Hundred Twenty-four and 88/100 ($2,224.88) Dollars; and
WHEREAS, Appellants brought an action in District Court appealing the assessments for
Project 643R known as In Re: The Assessment for City Pro1ect No. 643R adopted by the Citv
EaQan on 4/16/96, Dakota County District Court File No. 19-C1-96-7806; and
WHEREAS, the parties have resolved any dispute over assessments to the MeNurlin
Property and the Stevenson Property.
NOW, THEREFORE, the parties do hereby agree as follows:
Appellants and Respondent stipulate that the above-entitled matter has been fully
compromised and settled and therefore it is hereby stipulated and agreed between
the parties that the above-entitled matter may be and the same hereby is dismissed
with prejudice and without cost to either party and the Administrator of the
aforementioned Court is hereby authorized and directed to dismiss this said action
with prejudice and without costs of record.
2. The assessment levied against the McNurlin Property and the Stevenson Property
for Project 643R shall be reassessed as follows:

At the request of Sandra Masin, I had contacted you a while back regarding the future use
of the Lull Engineering Building located on Highway 13. At the time we spoke, there
was no knowledge of any future use of the property. I spoke with our Planning
Department this week and there is no user identified for the property to our knowledge.
I spoke with Sandy this past week and apparently you have been getting some requests
from neighbors within your homeowners association asking about permitted uses for the
Lull Engineering Building. For your review and use by your neighbors, I have enclosed a
copy of City Code Chapter 11 Pernvtted Uses and Conditional Uses Within 1. 1 Industrial
District. Also enclosed is a copy of the City of Eagan's zoning map for your use.
If I can be of any help for additional information, feel free to contact me at any time. If
we are made aware of a user for the Lull Engineering Building, we will certainly call you
as soon as that information is available to the City. It is quite possible that the building
could be sold and occupied without any notification to the City if the use is compatible
with the uses outlined in the 1. 1 District.

A, Purpose. The purpose of the I-1 limited industrial district is to provide for the establishment
of a variety of warehousmg, man ufactu ring and light indusrrial uses, inciuding large volume truck ','?:
oriented -ses. The regulations in this subdivision set forth the development requirements that are
tominimize any potential detrimental effects of a particular industrial use and ensure compatibiliry
with adjacent land uses.
B. Permitted uses. Within any limited industrraf (I-1) district, no structure or land shall be used
except for one or more of the following uses or uses deemed similar by the council:
1. Amusement devices, not to exceed three machines at one licensed location, and which :.
shall not be located within 200 feet of another licensed location. For this purpose the outside
wall of each licensed location shall be used in the measurement of the distance between
locations.
2. Animal hospital or clinic (with no outside kennel).
3. Armories or convention hall.
4. Assembly, processing, fabrication, packaging or manufacturing of a wide variety of- -
products that produce no exterior noise, glare, fumes, obnoxious products, byproducts or
wastes, or creates other objectionable impact on the environment.
5. Athletic complexes.
6. Automobile major repair when conducted complefely in an enclasedbuilding.
7. Churches.
8. Ice, cold storage plants, bottling works.
9. Machine and welding shops.
10. Mini-warehouse storage facilities.
11. Offices.
12. Radio, television and movie productions studios.
13. Research laboratories.

15. Tennis club, skating, theater, bowling alley or similar indoorcommercial recreation.

conditional use permit:
1. Amusement devices exceeding three machines af one licensed location or to be
located within 500 feet of any other licensed IocaUon.
2. Car or truck wash when conducted as a principal use.
3. Contractors' yards.
4. Dog kennels with outside pens and subject to Chapter 6 of the City Code.
5. Freestanding tower or wind energy conversion system, subject to the regulations
thereof in this Code.
6. Fuel storage tank(s) located above ground, subject to the outdoor storage regulations
in this chapter. -
7. Manufacture, storage or utilization of explosives.
8. Motor fuel sales serving industrial or trucking uses.

9. Off-site off-street parking and off-site outdoor storage, subject to the regulations thereof
in this chapter.

11. Outdoor storage conducted by an occupant of the principal building, subject to the
outdoor regulations in this chapter.
12. Sales, leasing, or service for trucks or passenger cars when conducted as a principal
use.
13. Sales yards for building materials, conducted by an occupant of the principal building,
subject to the outdoor storage regulations in this chapter.
14. Truck and freight terminals.
15. Truckstops.
16. Coffee kiosks subject to the following conditions:
(a) The activity shali be conducted within a free-standing huilding, no larger than
100 square feet in size.
(b) The use shall not result in the elimination of the minimum number of off-street
parking spaces required for all uses on the parcel.
(c) Vehicular stacking lanes shall comply with the following:
(1) A minimum length of 150 feet shall be provided for a single stacking lane
or 80 feet per lane when multiple lanes are provided.
(2) Stacking lanes shall be designed such that they do not interfere with
existing parking and vehicular circulation.
(3) Stacking lanes shall be cleariy identified through striping, landscaping,
and/or signage.
(d) No alcoholic beverages shall be sold.

(e) Evidence of issuance of a permit from the Minnesota Department of Health shall
be provided to the city.
(f) if the use of the building ceases for a period of six mon±hs, the conditional use
permit shall lapse and the property owner shall remove the building and clean up the
site.
(g) No on-site preparation of food shall be allowed.
D. Permitted accessory uses. Within any limited industrial (I-1) district, the following uses shaii
be permitted when conducted as accessory to the principal use on the property.
1. Building mounted antenna or satellite dish, subject to the regulations thereof in this
Code.
2. Car or truck wash consisting of a single wash bay, when serving only the principal use.
3. Sales, leasing, or service of trucks or passenger cars when serving only the principai
use.
4. Temporary outdoor event, subject to the regulations thereof inthis chapter.
Subd. 17. General industrial (1-2) district.
A. Purpose. The purpose of the limited industrial (I-2) general industrial district is to provide for
the establishment of heavier industrial uses that, because of the nature of the product or
character of operation, require separation from or special protections for non-industrfal uses.
B. Permitted uses. Within any limited industrial (I-2) district, no structure or land shall be used
except for one or more of the following uses or uses deemed similar by the councii:
Any use permitted as a conditional use in the limited industrial(I-1) district, except:
(a) Manufacture, storage or utilization of explosives;
(b) Off-site off-street parking and off-site outdoor storage subject to the regulations
thereof in this chapter.
2. Any use permitted in the limited industrial (I-1) district.
