Bruestle: THOMaS HEDGES pT AOMINISiRFiOP ALYCE BOLKE CITY CLERK I am in receipt of your letter of October 28, 1980, wherein you request additional information regarding our denial of your previously submitted elaim regarding damage to your property resulting from the high elevation of Fish Iake. If you recall, there was a public hearing held on June 20, 197$ to diseuss the construetion of a controlled out- let for Fish Lake. At that meeting, there was an enormous amount of opposition to con- structing that controlled storm sewer outlet. Subsequently, the project was not approved at that time and staff was directed to meet with the Department of Natural Resources and the property owners to determine what would be a proper elevation should the future storm sewer outlet be installed. Through several follow-up meetings with the DNA and local residents, a eontrolled storm sewer outlet elevation was established based on the DNR normal ordinary high water elevation (NOITW) of 843.6. After this elevation had ultimately been established, the City then proceeded with a follow-up hearing for the installation of the controlled storm sewer outlet for Fish Lake which was held on August 7, 1979. This construction was finally completed in September of 1980, whieh has dropped the elevation of Fish Lake to its con- trolled elevation of 843.0. This is approximately a half foot below uvhat the DNR re- commends as the normal controlled elevation of the Lake. Based on this information, the City feels that it has adequately responded to the installation of storm sewer based on its coiaprehensive storm sewer plan and in conjunction with the Department of Natural Resources with proper comnunication with all affected pro- perty owners. Therefore, the City does not feel that it has acted negligently in pro- viding for this storm water outlet which is now funetioning. The water stands within 2 to 3 feet fmm my drive?ray. In fact, 3 Apple trees, 1 Plum tree and over 10 Juniper trees have died. Several of these trees are 15 to 20 years old. Also, a large section of grass has been damaged from water coverage. No longer can we use the yard for recreational games. The City o£ Eagan, created this problem by not having proper drainage in this section of land before issuing buiding permits. January 17, 1979 AREA CODE 612 TELEPHONE 454-4224 This letter is for the purpose of letting you know what has been happening concerning Ronald Bruestle and the proposed highway easement for widened Pilot Knob Road. Last July the Assessment Committee approved a recommendation allowing a re- duction in the assessment area for Ronald Bruestle by the amount of road easement which he was to dedicate to the City for the widening of Pilot Knob Road. The proposed easement was to increase the half right of way of Pilot Knob to 75 feet at the Bruestle property. Mr. Bruestle was credited with approximately $500 on his sewer bill with the understanding that he would be signing the road easement. Afterwards it appeared that NIr. Bruestle had some doubts about the easement and he has not signed it to this date. On December 14, 1978, I wrote Mr. Bruestle suggesting that if he did intend to sign the easement, then perhaps he should do so before the end of the year. He was informed that the easement was in the possession of Ann Goers and that he could contact her at the City Hall to sign. As of yet he still has not signed the easement, so my recommendation will be that the credit on his sewer assessments should be rescinded by the City. Since the credit was given to Mr. Bruestle with the understanding that he would be signing the easement, it should not require Council's approval to rescind the credit.
