Dear Mr. and Mrs. Schuette
Presently, you are in the process of excavating or constructing upon the above referenced
property, within the City of Eagan without the required permit issued by the City. Your
constructiou activities have included grading and/or disturbance of the site.
An inspection of your site was conducted by City staff on April 22, 2008. At that time the
following items were found to be out of compliance with City Code due to the activities occurring
on your site:
1. Submit grading permit application and grading plan to City of Eagan
2. Install/maintain perimeter control
3. Installlmaintain inlet protection on all required catch basins
4. Install/maintain temporary cover on all exposed soils
You may see the relevant ordinance language from the Eagan City Code by visiting the following
Web site, www.municode.com/resources/gateway.asp?pid=13070&sid=23, and reviewing
Chapter 4, Section 432.
The above items must be addressed within 72 hours of receipt of this notice in order to bring your
site into compliance. City staff will conduct a follow-up inspection at the end oF the 72 hour
grace period, or at 5:00 am, Monday, April 28, 2008. The site inspection will include the
downstream storm sewer. If the site is found to be out of compliance at that time, the City
reserves the right to issue a citation for all remaining ordinance violations. Any impact to the
storm sewer system or down stream water bodies will be reported to the Minnesota Pollution
Control Agency for potential follow-up action.
If the property is not in wmpliance with City Code as of the above date, a misdemeanor citation
may be issued to you requiring an appearance in court. A misdemeanor is punishable by up to 90
days in jail and/or $1000.00 in fines. Please contact me with any questions at 651-675-5646.

we have made will not work with the current venting system used at
our home. We have chosen not to pay for a makeup air system
recommended by both McDonald Construction and the City of Eagan.
We understand that McDonald construction is to disconnect the 600
c.f.m. option so only the 200 and 400 c.f,m. blower will be
operational. We understand that if in the future we decide to
reinstall this option, neither McDonald Construction nor the City of
Eagan will be held responsible for any back drafting caused by using
