During a site visit on November 27"', 2007, al] significant trees designated to be saved were observed on the lot and are in good health. No tree preservation plan was available for this devetopment. The facts as I understand them are as follows: • In 1976, the City proceeded, under Project 179, to notify the owners of 1470 Englert Road (the Bruestle property) of the City's intention to assess the Bruestle property for a water main trunk oversizing. • In 1976, the owners of the Bruestle property requested the City to defer the assessment on the property. • Subsequently, it was determined that the owners of the Bruestle propeRy wanted their parcel excluded from the assessment roll, instead of having the assessments deferred • In August of 1976, the owners of the Bruestle property were notified by the City that their property was excluded from the assessment roll for Project 179 Document Number 659743. • In 1984, the City recorded, against the Bruestle property, form a document entitled Certified Listing of Postponed Special Assessments, identifying the water area assessment as a postponed special assessment, which form refers to an action being taken pursuant to M.S. § 429.061, subd. 2. MSBA Gambucci May 8, 2001 Page 2 • Several years ago the existing residence on the Bruestle property was connected to the City water system, and as part of the water connection fee an amount was paid for water trunk equal to one unit/per lot • In September of 1999, the City of Eagan approved the premliminary subdivision (Waters Edge) of the Bruestle property to create 16 dwelling units. The Planning Report prepared in August of 1999 noted that: (1) there existed no special assessments against the Bruestle property; (2) that there were no pending assessmenYs proposed in connection with the platting; and (3) that pursuant to the City's existing fee schedule and for the connection and availability of the City's utility system, a total of $30,611.00 would be due and payable with the proposed subdivision and platting of the property. (See Exhibit I attached hereto). • In April of 2000, the City issued a letter identifying the estimated financial obligation for the Waters Edge plat, which letter identified the connection availability charges against the Bruestle property to be $31,257.00 (That is based upon the year 2000 rates.). (See Exhibit 2.) Chapter 429 of the Minnesota Statutes govems the City's assessment mechanism. Following a notice of hearing and a hearing and the adoption of a roll levying the assessments against the propeRy, the levy roll is forwarded to the County for collection. The statute allows for the deferment of the payment under an assessment; however, it requires that if special assessments have been deferred, that a certificate describing the property and the amount deferred be filed with the Dakota County Recorder. With respect to the Bruestle property, the trunk water assessment proposed in connection with Project 179 was never levied. Having never been levied, it could not be deferred. Deferment is solely a delay of a payment pursuant to a levied assessment. While the Bruestles originally wrote seeking a deferment, the action by the City Council was clearly to exclude the pazcel from the assessment roll certified to the County. Any present use of the term "deferral" in connection with the action taken by the City in 1976 is not supported by the facts or the law. While you have referred to Minn. Stat. §435.195, this provision only applies to assessments deferred under the senior citizen or retired and disabled person hardship ordinances. As stated, there was no deferral under Project 179, and thus, the statute is inapplicable. The next item to address is what impact, if any, is connected to the filing of document 659743, the certified listing of postponed special assessments. The document filed in 1984, without attribution of any dollar amount, simply notes that a postponed special assessment for water area assessment is associated with the Bruestle property. Minnesota statutes do not provide any provision with respect to how the City of Eagan handles "postponed special assessments". However, neither do the statutes provide any mechanism for the treatment of "pending special assessments". In either event, it is fair to condude that the City was interested in informtng all future owners of the Bruestle property that payment for the water trunk has not been made. The form serves only an informational purpose. Ostensibly, any purchaser of the Bruestle property would seek clarification from the City as to what was meant by the postponement. Gambucci May 8, 2001 Page 3 As I will discuss below, to the extent that the property is fuRher subdivided, the 1984 notice has no impact today. Several years ago, the existing residence on the Bruestle property was connected to the City water system. Pursuant to the City Code, at the time of hook up, the property owner was required to pay as part of the connection charge, a trunk water charge. Such charge was calculated on a per residential dwelling unit connection, equal to one dwelling at $810.00. Essentially, upon appiication for the water connection and payment of the required fees, the Bruestle property had fulfilled the trunk assessment for watermain, that being one dwelling per lot. To the extent that the property remains in its present existence, there is no additional watermain charge due or payable. You may consider the payment upon hook-up of the Bruestle dwelling as the payment of the postponed assessment referred to in Document NumUer 659743. It is solely the creation of the additional fifteen lots on the Bruestle property that requires the additional payment of connection charges to the City. These connection charges relate directly to the new dwelling units need for the City's water supply. Payment is required in order to comply with ehe City Code I would like to make clear that while your letter of May 1, 2001 asserts that the City of Eagan "showed postponed water trunk in the amount of $31 257 00 " 1 am unaware of how such information was purportedly conveyed by the City. As you will note from Exhibit I, the City preliminarily computed a total dollar figure of $30,611.00, associated with the creation of sixteen dwelling units in Waters Edge. Since the existing residence had already paid the connection water trunk charge, the numbers on Exhibit 1 represent the additional dwelling units being placed on the property. The total dollars shown in Exhibit 1 represent sanitary sewer lateral, water trunk and water lateral, and ofthe total, only $13,800.00 is associated with the water trunk This information is consistent with the document prepared by the City in April of 2000 (see Exhibit 2). The year 2000 connection charges for the Waters Edge total $31,257.00, of which only $14,100.00 is associated with water trunk. As you will note, the water trunk per unit dollar value had increased $20.00 per dwelling unit for the fifteen additional units associated with the plat. As you may be aware, the per unit rate for water trunk as well as other rates used to calculate the connection availability charges have increased for the year 2001. I do note that in the material you provided to me, there is an Exhibit marked "Q," which has several dates noted upon it, including that of June 23, 1999 and includes a statement that the postponed water trunk amount owing is $31,257.00. While the dollar figure happens to match the total dollar figure provided by the City in its April 5, 2000 letter, the City did not prepare the document marked as Exhibit Q, nor does it agree with the statement contained thereon. In the September of 1449 Planning Report, the City advised that the creation of the subdivision and plat for Waters Edge would result in the creation of fifteen connections to the City's water system. In 1999, the cost of making those connections would have been equal to $13,800.00 for water trunk. Attached as Exhibit 3 is a copy of the City's application to connecY a dwelling unit to the City's water system. As you will note under the heading "Water," each dwelling unit's connection to the City's system in the year 2000 would pay a trunk charge equal to $940.00 per connection. Gambucci May 8, 2001 Page 4 The sale of Bruestle property and the continued use of the property as a single family residence do not require additional connections and no monies are therefore due to the City. It is the imposition of the additional dwelling units in the plat of Waters Edge which require the payment of additional water trunk charges for the connections. For your additional information, you will note that on Exhibit 3, the lateral charQes in the year 2000 for sanitary sewer and water is consistent with the information provided to you in Exhibits 1 and 2. While each of these charges is required due to additional connections of dwelling units to the City's system, neither of these charges, has ever been the subject of any assessment notice (postponed or otherwise). 1 hope this clarifies the issues raised in your correspondence. The City is not seeking to assess the Bruestle propeny for any existing improvements on the property, and to the extent that no additional connections are made the City's utility systems, the City does not anticipate collecting any additional charges from the Bruestle property. The negotiating was delayed afier Mr. and Mrs. William Bruestle asked for cost studies on sanitary sewer connection to their home on Pilot Knob Road and after they determined the costs were excessive, we again approached the Bruestle family for the easements. Originally we offered about $1,100, which was based on the normal City policy for payment for ease- ments and then doubled tha[ to $2,284. The assessments againsi the property would be approximately $11,000 for storm sewer trunk purposes. At the time of the last Coimcil meeting, we were told by the Bruestle's attor- ney, James Blomquist of St. Paul, a copy of which letter I am enclosing with this letter, that the demand was then increased an additional $5,500 to compen- sate for what they determined to be excessive assessments against their land. The City Council requested that I retum to Mr. Blomquist and I have talked with him several times during the last two weeks. I indica[ed that the City will neither assess nor defer assessments, bu[ simply not assess the property at [he present time. I was authorized to again negotiate for $2,284 and I have been told that the Sruestles will not accept that offer. Mr. Blomquist has indicated to me that the Bruestles will not consent to the Ci[y's contractor entering upon their property and commencing construction and then permi[ the Ci[y to start condemnation proceedings because the Bruestles feel that the City has been unfair to them and that they then are now in a position to hold up the contractor for the City. In addition, it is my under- standing that Mr. and Mrs. Bruestle's son who lives on the Wes[ side of ?hemas F cl., Lake is now making claim for damages due to the high water on his property and Mr. Blomquist indicates that that claim could be substantial. It is my feeling that we have done everything in our power to try to work fa3rly with [he Bruestle family and early on we decided not to recoB¢nend condemnation because of the very tempermental situation and the fact that Mr. and Mrs. Bruestle are of an advanced age and condemnation would be a very difficult process for them to go through. d . i ' Eagan City Council August 18, 1980 Page 2.
