Since another committment prevents me from attending tonight's council meeting, I am writing to make sure all members of the council are aware of certain facts when you vote on the subject lot split. First, certain members of the Planning Commission were concerned that they might not have discretion to deny the subject lot split if all of the subject lots met the minimum size requirements. However, this concern is rendered moot by the fact that the proposed lots do not meet the established minimum lot size requirements set forth in the City Code. A fair reading of Sections 11.03(45); 11.10, Subd. 19B; and 11.20, Subd. 6 makes clear that for a residential lot to be of the required size, it must be at least 85 feet wide at the average setback established by the existing dwellings on the block. Copies of these code sections are attached for your convenience. My home is set back about 100 feet from the street. The Solberg Home, on the other side of the subject property, is also set back about 100 feet. The Selby Home, directly across the street from the subject property, is set back about 150 feet. Finally, the present dwelling on the subject property is set back approximately 140 feet from the street. From a review of the survey information submitted regarding the subject property, it is clear that the two lots to be created are not 85 feet wide at the average setback. They are less than 75 feet wide. Therefore, the two new lots fail to meet the minimum lot size requirements established by the Code. The Honorable Mayor of the City of Eagan and the Eagan City Council August 16, 1988 Page 2 Second, Section 13.30E requires that side lot lines be at right angles to the street. Again, a review of the survey information submitted demonstrates that this is not the case with the proposed newly created lots. These lots, therefore, not only fail to meet the minimum lot size requirement, but this right angle requirement as well. Third, even if the facts set forth above were not a sufficient statutory basis for automatic denial of the subject request, the City Council has the discretion to deny the requested lot split under Section 13.30, Subd. 8 of the City Code. This provision was enacted to reserve to the council the right to exercise discretion to protect the character of Eagan neighborhoods. Further, the very fact that the Council has decided to consider matters such as this rather than simply leave the decision to staff is a clear indication that the Council has decided to retain the right to exercise discretion. As the Council should already be aware, a petition, signed by nearly all of the surrounding property owners, was submitted at the Planning commission meeting. The neighbors are unified in their opposition to the proposed lot split because the two new lots would: (a) be substantially smaller in area than the other lots in the neighborhood (the next smallest lot is comprised of 30,000 square feet); (b) have a substantially smaller front lot line than the other lots (100 or more feet vs. 85 feet); (c) have a smaller lot width at the home site than the other lots (100 feet or more vs. 75 feet or less); and (d) would have an odd shape not consistent with the neighborhood. These are all factors which should be considered by the Council under Section 13.30, Subd. 8 when the Council exercises its discretion to determine whether or not a proposed lot split should be approved. Finally, in an effort to demonstrate good faith and to show that the neighbors would not object to any reasonable plan, the Petition also offered a compromise. All of the neighbors who signed the Petition said they would not object to one newly created lot on the subject property so long as the newly created lot and the remaining lot both met the established minimum standard in the neighborhood; i.e. a rectangular shaped lot at least 100 feet wide by 300 feet deep with an The Honorable Mayor of the City of Eagan and the Eagan City Council August 16, 1988 Page 3 area of at least 30,000 square feet. The neighbors are unified in their belief that only a lot of this size and shape would maintain the character of the neighborhood. In summary, it is clear that the Council should vote down the subject proposal because the two newly created lots do not meet the minimum lot size and shape requirements established by the City Code. "Nonconforming Structures" - Any structure permitted by existing City Code provisions upon the effec- tive date of its construction which would not conform to the applicable regulations if the structure had been erected under the provisions of subsequent ordinance(s). 52. "Nonconforming Use" - Use of land, building or structures which does not comply with all the regulations of the City Code governing the zoning district in which such use is located, adopted subsequent to the initiation of said use. 53. "Nursery-Day" - A use where care is provided for pay for more children than those of one (1) family in addition to the family residing on the premises. 54. "Open.Sales Lot" - Land devoted to the display of goods for sale, rent, lease, advertising or trade, where such goods are not enclosed within a building. 269 A. The minimum twenty (20) foot wide yard abutting the public right-of-way shall be landscaped and said landscaping shall be separated from the usable portion of the lot by a curb. Said twenty (20) foot landscaped yard shall also be provided where such lot abuts a residential lot. B. All of the lot other than the portion occupied by a building or landscape treatment shall be surfaced to control dust and drainage. C. Lot shall be constructed according to a grading plan approved by the City Engineer. D. When such a lot is adjacent to a lot located in the "R" District, a fence of acceptable design shall be erected along the property line. E. The outdoor lighting system for a sales lot shall be so designed that no direct source of light is visible from the public right-of-way or adjacent land. F. A site plan for the lot, showing ingress and egress, storage, parking, fencing and other necessary features, required to understand the operation shall be filed for approval by the Council. Subd. 18. Hours of Operation. Hours of operation of any retail business, any restaurant or any motor fuel station, shall be confined to the period between 7:00 A.M. and 1:00 A.M., except for those located two hundred (200) feet or more from any residential use and fronting on a major thoroughfare or commercial service road unless other- wise specifically approved by the Council. The Council may direct the removal or otherwise limit the parking of any large vehicle upon or adjacent to any resi- dential use where it is determined that said parking has a detrimental effect upon residential use. Said large vehi- cles shall include, but not be limited to, buses, motor homes, cruisers, or trucks. F. Parking of Mobile Homes. Mobile homes shall not be permitted to be located for storage or habita- tion in any zoning district except in an approved mobile home park, without a special permit being issued by the Council as required by Section 4.40 of Chapter 4. G. Temporary Uses. The Council may grant a special permit for a period of not to exceed thirty (30) days for a temporary use not otherwise provided for by this Section. Said temporary use may include, but is not limited to, storage of materials for highway construction, Christmas tree sales, special promotions and/or similar uses. Subd. 20. Fences. A. Construction and Maintenance. Every boundary line fence shall be maintained in a condition of reasonable repair and shall not be allowed to become a public or private nuisance. Electric boundary fences shall only be permitted in the "A" District when related to farm- ing, and on farms in other districts when related to farming but not as boundary fences. B.
