:iifference. His father-in-law is the owner of the present home
on the lot and was at the hearing. Mr. Nikolai and his wife would
:e moving into the proposed house on the East side of the property.
:'here was some discussion whether the petitioner should be required
*_o submit a petition for public street improvements prior to the
`:nal plat approval. The City Public Works Director stated that
=here had been a number of problems with Highview Avenue lately
and that sewer, water and street improvements should be installed
in order to remedy them. Member Blomquist stated that she felt
requiring street improvements was not necessary because of the
°act that this has not been required of prior applicants for waiver
aF plat on that road. Member Blomquist moved that the Commission
r^commend approval of the waiver of plat subject to the following
conditions:
1. That the proposed new home on the East lot should be re-
cuired to connect to City sewer and water.
2. That a park contribution should be required on the newly
created lots.
3. That a five foot drainage and utility easements shall
be dedicated adjacent to all property lines and ten foot drainage
and utility easements shall be dedicated adjacent to public rights-
of-way.
' 4. That the driveway of the present home be relocated to bring
it within the new lot.

Mr. Douglas Moe., architect, was present on beahlf of the appli-
:=ion of Metram Properties for preliminary plat approval for Eagan-
?tro SeconB Addition consisting of Outlot A and Lot 2, Block 1,
:::an-Metro Center in Section 17 on Silver Bell Road. The APC recom-
-?ded approval subject to certain conditions. The report of the
Planner of August 22nd was reviewed including the APC recommenda-
,±ons at its meeting of August 28th. There were no objections to
' ::e project. The project would consist of 256 units on an 18.36
c_e oarcel. There was discussion concerning drainage problems to
:;hway #13 and it was recommended that storm sewer outfall be provided
,nnectinq ponds and drainage facilities to Hiqhway #13. It was
:?ther noted that the plan included a shortage of parking spaces
,.dthe applicant indicated that area will be provided for necessary
.;*king pursuant to the ordinance. Parranto moved and Egan seconded
,..e motion to continue the application to the next meeting with the
?ncierstanding that the staff and the applicants will study and
-e'-urn to the Council with further recommendations on how to provide
iiequate parking. All members voted yes.
JAMES NIKOLAI - HIGHVIEW ACRES WAIVER OF
Mr. James Nikolai appeared on behalf of his application for
-aiver of plat of Lot 6, Highview Acres. Also the lot owner was
'=esent and favored the application. There were no objections to.the
Ipolication. Smith moved and Wachter seconded the motion to approve
the application subject to the APC recommendations but that the owner
and applicant not be required to sign the application for upgrading
Highview Avenue. All members voted in favor.
