While, in effect, the actual cost of the street improvement being referred to did exceed the $1,000 "estimate" that was used in allowing the lot split requested in that area, the City feels that the cost should have been more in line with the previous estimate than as final assessment amount. We do admit to the oversight that occurred during the pending assessment search when you sold this property. This occurred due to the fact that this improvement was requested and per- formed through the waiver of hearing request form that you had signed in which the $1,000 estimated cost was delineated. It is because this improvement was performed through the waiver of hearing procedure rather than the standard improvement process that this oversight occurred. We deeply regret that this oversight resulted in the confusion that it has. However, the City performed this work in response to a written request as a condition of allowing . the lot split to occur. Due to the fact that the estimated cost of $1,000 was incorporated in this waiver of hearing request, the City would accept payment from you in the amount of $1,000 as payment in full for this special assessment. Therefore, please consider this letter an official request along with the attached invoice for payment in the amount of $1,000 to be paid in full by you within 30 days of receipt of this letter. If you have any questions pertaining to the information contained in this letter, please feel free to contact me. Hedges City Administrator City of Eagan 3795 Pilot Knob Road Eagan, MN 55122 I recently received a letter from your attorneys for the street improvement done adjacent to a home I Avenue. requesting payment owned at 1451 Highview Just to set the record straight, I did not "request" the improvement. As you will recall, my neighbor pushed for the improvement for which he had no cost liability. I presented my opposition to the improvement at one of the City Council meetings. Of course, the two issues, from my stand point, were need and cost. I didn't feel there was a need to put in a paved road and I was not overjoyed with the prospect of paying for something there was no need for, especially when it was suggested that sewer, water and paved road be installed at a distance of 300 feet (depth of my property) to dead end at a golf course. The outcome was that I was liable for the cost of installing 100 feet of road. The City Engineer indicated that this would be done against a current road improvement contract in effect at that time for several road improvement projects. The cost was to be $10 per foot. This was written into the Request For Utility Improvements at my request. I think it is unfortunate that this liability was not identified when I sold the house and the title company did their assessment search. I have to believe that the City of Eagan was at fault for this oversight. It has been 2%2 years since the house was sold and for me to get a bill for this "improvement" that I never wanted seems unfair. Nevertheless, I accept the liability up to the agreed-to $1,000.00. I do not feel it is my responsibility to pay for a 44% overrun of the cost quote I was given by the City Engineer. I will wait for your response. Very truly yours, T.
