OBSERVATIONS:
• The Concrete garage siab in the front section showed some minor cracking and some slight
surface deterioration. Some of the cracking had been sBafed.
• There were two 8" concrete block walls that had besn recentiy constructed in the besement. One
was under the beam that ran side to side and the other between the beam and the front wall with a
doorvvay opening. Both walls were set an top of the slab.
• Thare were several areas whsre there was minor surface spalling of the underside of the concrete
slab. With the homeowners permission 1 removed some of the spalled materiai.

• The reinforcing of the slab section most probably runs between the beam and the front wall so that
the crack running front to back to the beam did not compromise the function of the slab.
• The slab appeared to be in good struCturai condition even though Mere were severel typical minor
cracks_
• The installatlon oi the 8" concrete block walls provide supplemental support for the slab and also
the section at the front wall is considered to be a shear wall.
• The spalling sections of the slab underside should be removed. Yau had agreed to do this and
also to cement wash the ceiling to Improve the eppaarance for the homeowner Sandra Marsyla.
When I contacted her on your behalf to schedule the work shs refused to have you do the work.
SUMMARY:
The slab and concrete block added masonry walls are considered to be structurapy sound.

Thank you for the copy of Lori Gardner's July 29 letter.
Ms. Gardner fails to understand one basic fact. Gardner Concrete knowingly breached
our contract by failing to seek a city permit. I think that they quite probably also violated
City and State law. And beyond that, Gerald Gardner personally lied to me about his
intention to seek a permit in order to convince me to accept a renovation method I'd been
specifically wamed against.
As you're aware from my June 3 email to Mazk Hanson, Steve Johnson had previously
told me that partial replacement of the floor, with a single shoring wall, was the best way
to go, and that there was only a 50150 chance the City would approve the stop-gap
measure of two shoring walls. Mr. Gardner claimed that replacement would create a
worse problem, and that shoring walls were sufficient. But he said he'd provide an
engineer if the City disageed.
As far as I'm aware, we are under no obiigation to allow Gardner Concrete to seek a
permit after the fact, and have been more than forbearing in allowing them to do so
despite the problems that have bothered me since the job was completed. It is almost
unbelievable that Ms. Gardner would assert a right, based on their bid, to charge
additional amounts if the City "wants something further." The contract made it crystal
clear that the bid was contingent upon the permit, and that the work was not to begin
until City approval (and recommendations) had been received. The time to change the
cost of the bid would have been after the permit was received and before work was
begun, not after the work was done under false pretenses and without regard to possible
injury that could be done to me and my home.
Ms. Gardner also claims that the company has been assured by a structural engineer that
their work was "adequate." How the engineer could have determined that fact without
ever having seen my home or speaking with me is beyond my level of understanding.
But I DO know that his opinion does not justify Gardner's failure to follow the demands
of the contract and local/state statutes. And it most certainly does not justify having
chosen to do something "adequate" when the home-owner had made it very clear that she
wanted full renovation.
In addition to the above, Mr. Gardner insisted to you that we never discussed anything
about replacement or permits or structural engrineers on June 4. I can cite the June 3
email to Mark Hanson, of course, and a June 4 email to Dakota County shortly after he
left. But I can't "prove" him wrong. Gardner told you that I had hired him specifically to
"build two shoring walls" so that I could "park the car in the garage" and that he'd never
planned on putting doors in the shoring walls. He referred to the bid sketch as proof of
his claim. Again, I can't really prove him wrong, although it doesn't make sense in light
of my conversations and emails and statements to a number of other people. Nor does it
make sense that I would allow someone to seal off almost 2,000 square foot of basement
area and diminish the value of my home.
Since I can't "prove" that his statements are false, however, leYs temporarily assume that
Gerald Gardner "believed" he had issued a bid on two full shoring walls, and included an
appropriate amount for cost of time, materials, & labor. If so, what happened to my
refund when two fairly large open spaces were substituted for azeas of planned
construction? Furthermore, why did Gardner fail to seek a written letter of authorization
from me, co-signed by CDA, before changing the plan and creating the open spaces?
Both actions are a clear breach of the contract. Nor did Randy Gardner inform you that
any changes had been made when you did a site check and spoke with him at some
length about the placement of the new gas pipe (through the new "doors").
I have no intention of rewarding Gardner Concrete for Mr. Gazdner's malfeasance. Nar
do I intend to let them play further games (like threatening a lien against my home if we
insisted on forcing them to apply for a permit). If the City of Eagan feels that more work
needs to be done, or points out that they would not have issued a permit for two shoring
walls had one been sought, then I will expect to pay Gardner the bid amount and will
expect them to "make good" on any necessary changes without additional cost. If they
refuse, I'll seek legal remedy.

Dear Mr. Gardner:
A stop work order and suspension is hereby issued for building pernvt #60620. This permit
was issued by the City of Eagan on August 27, 2003 for work at i1469 Highview Avenue. j
Based on a detailed shuctural analysis by WT McCalla P.E., the City of Eagan does not consider
the work performed by you at this address to be at a stage that would allow us to perform a
successful final inspection. According to the report referenced, the walls that were installed do
not appear to mitigate the struchual defects in the concrete slab above.
In addition to the above referenced issue, the following sections of the Minnesota Rules have
been violated:
1. 1300.0160 Subpt. 8 - A permit, as required by 1300.0120, was not secured prior to
construction commencing.
2. 1300.0160 Subpt. 3 - The pemut application completed by you indicated a valuation
of $1,000, which is a misrepresentation of the contract price.
3. 1300.0120 5ubpt. 1 - A permit has not been secured for the new gas line installed at
the premises.
As referenced by Minnesota Rules 1300A150, "A violation of this code is a misdemeanor under
Minnesota Statutes, Section 16B.69".

Council Members Correspondence was sent on October 1, 2003 informing you of deficiencies that exist with your
project at 1469 Highview Avenue in Eagan. Subsequent to this correspondence, a permit was

valuation of the project was also resolved tluough the issuance of an additional permit.

The concern that remains is the structural integrity of the concrete slab. The City issued a permit
for this project with the understanding that the scope of the project was to pettnanently stabilize
the concrete slab. The project, in its current state, doas not allow us to perform a successful final

3830 Pibr Knob Road We are willing to review any submittals that include a professional structural analysis of the
