Re: Reqradinq Within Ohmann Park 8 Parkview Golf Course
Dear Mr. & Mrs. Carrison:
Sometime within the next week to 10 days, you will notice some
regrading activities occuring along your back property line within
Ohmann Park and around the 13th green of the Parkview Golf Course.
Enclosed with this letter is a grading plan that conceptually shows
the construction limits and the grading necessary to redirect
runoff from the Parkview Golf Course along your rear property lines
into the pond located within Ohmann Park. This work is necessary
to address some of the drainage concerns that have been raised by
the golf course as a result of the development of the Fairway Hills
subdivision and Ohmann Park. Many of the trees that are designated
to be transplanted from park property have already been done so.
While you can see the construction limits of this work is proposed
to be confined to the park property, final detail grading may
require some minor adjustments along your rear property line. Also
enclosed with this letter is a copy of the Certificate of Survey
that was submitted with your building permit application. You will
note that there is a 10' drainage and utility easement dedicated to
the City along your south property line. In no event, will the
grading activities go beyond this dedicated drainage easement. Any
disturbance to your private property will be restored to an equal
or better condition.
If you have any questions or concerns during the construction
activities associated with this work, please communicate with Mr.
Bruce Allen, Engineering Technician, who will be coordinating the
construction activities. His number is 454-8100.

DSDICATION OF RESTRICTED ACCESS
At the May 15 Council meeting, the City Council formally rescinded
the special maintenance agreement identified as Exhibit "E" to the
Fairway Hills 2nd Addition Development Agreement affecting Lots 4
and 5, Block 3, Fairway Hills 2nd Addition. Because this agreement
was recorded at the County against both referenced lots, please
take the appropriate action to have this agreement removed.
In consideration of rescinding this agreement, I concur with your
suggestion that the City should acquire a restricted access
easement across Lot 5. The description of this restricted access
easement can be written as follows:
The easterly 71.45 ft. of the north line of Lot 5, Block
3, Fairway Hills 2nd Addition.
I would appreciate it if you would proceed with the preparation of
this restricted access easement and the corresponding cancellation
of the previous maintenance agreement.
Please let me know if any additional action is required by myself
or the City Council to accomplish these issues. Thanks for your
anticipated help.

On June 15, 1989, a cover letter forwarding three copies of the

one executed copy of the Termination Agreement and the Access
Restriction Easement. As you will note, the June 5th letter
requested that all three cooies of each agreement should be
returned to my attention for counterexecution and/or recording by
the City. Subsequently, the City is awaiting two other original
copies to be returned.
Also, there was a request to receive a written commitment from you
agreeing to reimburse the City for all costs incurred through the
preparation and recording of these agreements per your request.
We have not yet received this written commitment either.
The City will await your prompt response in regards to this matter
so that we may facilitate compliance with your original request.
