M466 11580 June 26, 2020 Kevin & Jane Brown 1381 Interlachen Dr. Eagan, MN 55123-2159 Re: Backyard drainage issues Dear Mr. & Mrs. Brown, The purpose of this letter is to summarize my observations from my site visit to your property this past Tuesday to review the drainage issues you are having in your backyard. The grading on your property appears to be in good working order and substantially conforms to the original grading of your neighborhood. As you already know, the source of your current issue is the result of "improvements" made on your neighbor's property at 1385 Interlachen Dr. The landscaping area that was installed along the southeasterly side property line is dissecting the drainage path, effectively creating a dam. This feature was constructed across a platted Drainage & Utility Easement, which was put in place at the time the neighborhood was constructed in order to facilitate drainage through the neighborhood. This feature should be removed as soon as possible so more serious damage does not occur. As this is a civil issue, the City has no authority to require anyone to remove said feature. If your neighbor is not willing to work with you to resolve this, then my advice is to take photos and document the water flow and subsequent damming. If the condition should worsen and water backs up into your home resulting in damage, you may need to take legal action in order to get it resolved. Having photo documentation and a timeline of events should significantly strengthen your case. I hope you find this information helpful.
